Law concerning the Standard of Expenses Required for Execution of Elections for Members of the Diet, etc.
（目的）
(Purpose)
第一條　この法律は、都道府県及び市区町村の選挙管理委員会が管理する国会議員の選挙等の執行について国が負担する経費の基準を定めることを目的とする。
Article 1.　The purpose of this Law is to provide for the standard of the expenses to be charged to the National Treasury, which is required for carrying out the elections for the members of the Diet, etc. under the management of the election administration commission of To, Do, Fu or prefecture, city, town or village.
（定義）
(Definition)
第二條　この法律において「国会議員の選挙等」とは、国会議員の選挙、最高裁判所裁判官国民審査及び日本国憲法第九十五條の規定による投票をいう。
Article 2.　In this Law, the term "elections for members of the Diet, etc." shall mean the elections for members of the Diet and the People's examination of the Supreme Court Judges and voting under the provisions of Article 95 of the Constitution of Japan.
２　この法律において「大都市」とは、地方自治法（昭和二十二年法律第六十七号）第百五十五條第二項の市をいい、「区」とは、大都市の区及び都の特別区をいう。
2　In this Law, "large city" shall mean the city under Article 155 paragraph 2 of the Local Autonomy Law (Law No.67 of 1947) and "ward" shall mean the ward of the large city and the special ward of the metropolis.
（経費の基準の算定）
(Computation of the Standard of Expenses)
第三條　国会議員の選挙等の執行経費の基準は、左の各号に掲げる経費の種目について定める。
Article 3.　The Standard of expenses for execution of elections for members of the Diet, etc. shall be fixed with respect to the items of expenses listed below:
一　投票所経費
(1)　Expenses for polling office;
二　開票所経費
(2)　Expenses for ballot-counting office;
三　選挙会経費及び選挙分会経費
(3)　Expenses for election meeting and election submeeting;
四　選挙公報発行費
(4)　Expenses for issuance of election bulletins;
五　候補者氏名等掲示費
(5)　Expenses for public notice of names of candidates;
六　演説会施設公営費
(6)　Expenses for public management of facilities for speech meeting;
七　立会演説会費
(7)　Expenses for competitive speech meeting;
八　新聞広告公営費
(8)　Expenses for public management of newspaper advertisement;
九　ポスター用紙費
(9)　Expenses for poster paper;
十　事務費
(10)　Business expenses.
（投票所経費）
(Expenses for Polling Office)
第四條　投票所経費の基本額は、左の表に掲げる通りとする。
Article 4.　The basic amount of expenses for the polling office shall be as mentioned in the following chart:

２　一般職の職員の給與に関する法律（昭和二十五年法律第九十五号）に基く勤務地手当（以下「勤務地手当」という。）を支給する地域の投票所については、左の表に掲げる額に勤務地手当支給率を乘じて得た額を加算する。
2　With respect to the polling office in the district where the duty place allowance based upon the Law Administering the New Pay of Government Employees (Law No.46 of 1948)(hereinafter to be referred to as "the duty place allowance" ) is supplied, the following amount multiplied by the percentage of the duty place allowance shall be added:

３　投票日の翌日において投票箱を開票所に送致した場合においては、投票所の事務に従事する者の超過勤務手当費として、区にあつては九百四円、市にあつては八百円、町村にあつては六百九十六円をそれぞれ加算する。但し、勤務地手当を支給する地域にあつては、これらの額及びこれらの額に勤務地手当支給率を乘じて得た額の合計額を加算するものとする。
3　In case the persons engaged in the affairs of the polling office carries the ballot box to the ballot-counting office on the following day of the election 904 yen in case of the ward,800 yen in case of the city,696 yen in case of the town and village shall be added as the overtime allowance. However, in the district where the duty place allowance is supplied, the amount mentioned in the above plus the amount mentioned in the above multiplied by the percentage of the duty place allowance shall be added.
４　前項の場合においては、送致のための投票立会人に要する費用として、第十四條に規定する投票立会人に要する費用の額を加算する。
4　In case of the preceding paragraph, the amount of expense for the inspector of voting as referred to in the provisions of Article 14 shall be added for the expense required for the inspector of voting to carry the ballot box.
５　投票が十一月一日から三月三十一日までの間に行われる場合の投票所については、燃料費として、百八十円を加算する。但し、国家公務員に対する寒冷地手当及び石炭手当支給に関する法律（昭和二十四年法律第二百号）に基く寒冷地手当（以下「寒冷地手当」という。）を支給する地域における投票所については、一級地にあつては二百二十五円、二級地にあつては二百七十円、三級地にあつては三百十五円、四級地にあつては三百六十円をそれぞれ加算するものとする。
5　With respect to the polling office in case the election takes place during the time from November 1 to March 31,180 yen shall be added for the expense of the fuel. However, with respect to the polling office in the district where the cold district allowance based upon the Law concerning Payment of the Cold District Allowance and Coal Allowance to the National Public Service Personnel (Law No.200 of 1949)(hereinafter referred to as "the cold district allowance" ) is supplied,225 yen for the first class district,270 yen for the second class district,315 yen for the third class district,360 yen for the fourth class district shall be added.
６　投票区の区域内に市役所、区役所又は町村役場がある投票所については、旅費及び通信費の不要分として、左の表に掲げる額を減額する。
6　With respect to the polling office in the precinct where the municipal office, ward office or town and village office are established, the amount mentioned in the following chart shall be reduced as the unnecessary travelling expense and expense of communication:

７　投票所が市役所、区役所又は町村役場から十二粁以上離れた地に設けられた場合においては、特に要する旅費及び通信費を加算する。
7　In case the polling office is established 12km or more away from the municipal office, ward office or town and village office, the travelling expense and expense for communication specially required shall be added.
８　投票所が市町村（特別区を含む。）の管理に属しない建物に設けられた場合においては、都道府県の選挙管理委員会があらかじめ承認した借料を加算する。
8　In case the polling office is established in the building which does not belong to the management of the city, town or village (including the special ward), the amount of rent approved in advance by the election administration commission of To, Do, Fu or prefecture shall be added.
９　積雪のため投票箱の運搬にそりを使用する投票所については、特に要する運搬費を加算する。
9　With respect to the polling office in case the sleighs are required to carry the ballot box on account of the snow, the carriage expense specially required shall be added.

第五條　投票の当日において開票を行う開票所経費の基本額は、左の表に掲げる通りとする。

5　The provisions of paragraps 3 and 5 of the preceding Article shall apply mutatis mutandis to the expense of the duty place allowance for the persons engaged in business of the ballot-counting office under paragraph 3 and the expense of the fuel for the ballot-counting office under paragraphs 1 and 3.
６　市の開票所で都道府県庁所在地に設けられたもの又は町村の開票所で都道府県の支庁若しくは地方事務所所在地に設けられたものについては、旅費及び通信費の不要分として、六百六十六円を減額する。
6　With respect to the ballot-counting office of the city which is established in the place where the prefectural office is or the ballot-counting office of the town or village which is established in the place where the branch office or local branch office of To, Do, Fu or prefecture is,666 yen shall be reduced for the unnecessary travelling expense and expense for communication.
７　市の開票所が都道府県庁の所在地から、町村の開票所が都道府県庁の支庁又は地方事務所からそれぞれ十二粁以上距つた地に設けられた場合においては、特に要する旅費及び通信費を加算する。
7　In case the ballot-counting office of the city is established 12 km or more away from the prefectural office and the ballot-counting office of the town or village is established 12 km away from the branch office or local branch office of To, Do, Fu or prefecture the travelling expense and expense for communication specially required shall be added.
８　開票所が市町村（特別区を含む。）の管理に属しない建物に設けられた場合においては、都道府県の選挙管理委員会があらかじめ承認した借料を加算する。
8　In case the ballot-counting office is established in the building which does not belong to the management of the city, town or village (including the special ward), the amount of rent approved in advance by the election administration commission of To, Do, Fu or prefecture shall be added.
９　選挙人の数が三万人以上の開票区の開票所については、前各項の規定によつて計算した開票所経費の基準額に三万人をこえる数一万人ごとに百分の三十を乘じて得た額を加算する。
9　With regard to the ballot-counting office in the ballot-counting district having the voters of thirty thousand and more, the basic amount of expenses of the ballot-counting office computed in accordance with the provision of each of the preceding paragraphs, multiplied by thirty per cent shall be added per ten thousand voters exceeding over thirty thousand voters.

第六條　衆議院議員の選挙の選挙会経費の基本額は、十一万二千八百円とする。
Article 6.　The basic amount of expenses of the election meeting on the election of the members of the House of Representatives shall be 112.800 yen.
２　参議院地方選出議員の選挙と参議院全国選出議員の選挙を同時に行う場合における選挙会経費及び選挙分会経費の基本額は、四十二万八千四百四十六円とする。

２　演説会場が勤務地手当を支給する地域に在る場合において、演説会が夜間に行われるときは、区にあつては二百四十四円、市にあつては二百十六円、町村にあつては百二十五円に勤務地手当支給率を乘じて得た額を加算する。

３　演説会が日曜日の晝間に行われる場合においては、区にあつては百九十五円、市にあつては百七十三円、町村にあつては百円をそれぞれ加算する。但し、勤務地手当を支給する地域にあつては、これらの額及びこれらの額に勤務地手当支給率を乘じて得た額の合計額を加算するものとする。
3　In case the speech meeting is held in the daytime of Sunday,195 yen in case of the ward,173 yen in case of the city,100 yen in case of the town or village shall be added. However, in case of the district where the duty place allowance is supplied, the sum total of the amount plus this amount multiplied by the percentage of the duty place allowance shall be added.
４　演説会が休日の晝間に行われる場合の基本額は、夜間の基本額によるものとする。
4　In case the speech meeting is held in the daytime of a holiday, the basic amount shall be the same as the basic amount of expenses for night.
５　演説会を夜間に開催する場合において臨時に電球の取付けを必要とするときは、演説会場の施設の坪数が五十坪未満のものにあつては六十七円、五十坪以上百坪未満のものにあつては九十五円、百坪以上百五十坪未満のものにあつては百四十円、百五十坪以上のものにあつては二百四十円をそれぞれ加算する。
5　If the temporary installation of the electric lamp is required in case the speech meeting is held at night, 67 yen in case the meeting hall covers less than 50 tsubo area, 95 yen in case the hall covers 50 tsubo area and more and under 100 tsubo area,140 yen in case the hall covers 100 tsubo area and more and under 150 tsubo area,240 yen in case the hall covers 150 tsubo area and more shall be added.
６　前項の場合において配線の必要があるときは、四百四円を加算する。但し、当該演説会が開催される建物に電燈設備があり、且つ、その場所を使用する集会において臨時に電燈施設の取付けをすることを例とする場合に限るものとする。
6　If the wiring is required in the case of the preceding paragraph,404 yen shall be added. However, this applies only to the case where the building in which the speech meeting is held has the equipment of electric lamp and the temporary installation of the electric light is usually made for meeting therein.
７　演説会が十一月一日から三月三十一日までの間に行われる場合においては、燃料費として、七十二円を加算する。但し、寒冷地手当を支給する地域における演説会場については、一級地にあつては九十円、二級地にあつては百八円、三級地にあつては百二十六円、四級地にあつては百四十四円をそれぞれ加算するものとする。
7　In case the speech meeting is held during the time from November 1 to March 31, 72 yen shall be added for the expense of the fuel; provided that, with respect to the meeting hall in the district where the cold district allowance is supplied, 90 yen in case of the 1st class district,108 yen in case of the 2nd class district,126 yen in case of the 3rd class district and 144 yen in case of the 4th class district shall be added.
８　演説会場の廊下等が聽衆席として使用される場合においては、その面積は、当該演説会場の坪数に含めるものとする。
8　in case the corridor of the meeting hall is used for the audience's seats, the area of the corridor shall be counted as the area of the meeting hall.
９　演説会場の施設について使用料の定がある場合において、その料金が演説会開催のために必要な施設の費用を含むときは、その料金の額を基本額とする。

（ポスター用紙費）
(Expenses for Poster Paper)
第十二條　候補者が使用するポスター用紙の経費の額は、候補者一人についてそれぞれ左の各号に掲げる額とする。但し、参議院地方選出議員の選挙にあつては、当該選挙区の区域内の衆議院議員の選挙区の数が一をこえる場合においては、その一を増すごとに四百円を加算する。
Article 12.　The amount of expenses for poster paper to be used by the candidate shall be the amount mentioned in the following chart for each candidate, provided that, with respect to the election of the members of the House of Councillors from Local Constituency,400 yen shall be added to the basic amount for each district, in case the number of the election district for the members of the House of Representatives in the election district of the House of Councillors exceeds over two:

第十三條　第四條から第十二條までの規定による経費を除く外、都道府県及び市区町村の選挙管理委員会において選挙事務に要する経費（啓蒙宣伝の経費を含む。）は、左の各号の表に掲げる通りとする。但し、都道府県の選挙管理委員会は、選挙人及び世帶数、投票所及び開票所数並びに地域等について特別の事情がある市区町村については、全国選挙管理委員会と協議して別に基本額を定めることができる。

２　選挙長又は選挙分会長が職務のため旅行するときの費用は、鉄道賃、船賃、車馬賃、日当及び宿泊料とし、その額及び支給の方法は、全国選挙管理委員会の定めるところによるものとする。
2　The expense for travelling on duty of the presiding officer of the election or the presiding officer of the election submeeting shall be these for the railway fare, the passage fare, the car-fare, the daily allowance and the charge for the bed and board, and the amount and the method of payment of the said expenses shall be as prescribed by the National Election Administration Commission.
３　第一項の費用の額は、第四條から第六條までに規定する経費の基本額中に含めるものとする。
3　The amount of expense under paragraph 1 shall be included in the basic amount as referred to in Articles 4 to 6 inclusive.

(Expenses for the People's Examination of the Judges of the Supreme Court)
第十五條　最高裁判所裁判官国民審査（以下「国民審査」という。）に要する経費の額は、国民審査の審査分会の経費の額については、参議院地方選出議員の選挙会経費及び参議院全国選出議員の選挙分会経費の額の三分の一の額とし、審査公報発行費の額については、参議院地方選出議員の選挙公報発行費の額に準ずる額とし、裁判官氏名等掲示費の額については、参議院地方選出議員の候補者氏名等掲示費の額に準ずる額とする。
Article 15.　With regard to the amount of expenses required for the People's Examination of the Judges of the Supreme Court (hereinafter referred to as "the People's Examination" ), the amount of expenses for the examination submeeting of People's Examination shall be one-third of the House of Councillors from Local Constituency and the expenses for the election submeeting for the members of the House of Councillors from National Constituency;the amount of the expense for issuance of the examination bulletins shall be corresponding to the amount of the election expense for issuance of the election bulletins of members of the House of Councillors from Local Constituency;and the amount of the expense required for noticing of names of the judges shall be corresponding to the amount of the expense required for noticing of names of the candidates for the members of the House of Councillors from Local Constituency.
２　前項に規定する種目以外の国民審査に要する経費は、衆議院議員の総選挙の経費中に含めるものとする。
2　The expenses required for the People's Examination in addition to the items as referred to in the preceding paragraph shall be included in the expenses for the general election of the members of the House of Representatives.

第十六條　日本国憲法第九十五條の規定による投票に要する経費の額は、投票が一又は二以上の市町村（特別区を含む。）の区域にわたつて行われる場合においては、第四條、第五條及び第十三條の規定によつて算出した経費の額の二分の一に相当する額以内の額とし、投票が一又は二以上の都道府県の区域にわたつて行われる場合においては、都道府県並びに都道府県の支庁及び地方事務所については第十三條の規定による経費の額の、当該都道府県の区域内に在る市区町村については第四條、第五條及び第十三條の規定によつて算出した経費の額の、それぞれ二分の一に相当する額以内の額とする。
Article 16.　With regard to the amount of expenses necessary for the voting under the provisions of Article 95 of the Constitution of Japan, in case the voting is held in one city, town or village (including the special ward) or more, the amount of expenses shall be limited within the amount equal to one half amount of the expenses computed in accordance with the provisions of Article 4, Article 5 and Article 13;in case the voting is held in one To, Do, Fu or more, the expenses concerning the prefecture, the branch office and local branch office and local branch office of the prefecture shall be limited within the amount equal to one half amount of the expenses computed in accordance with the provisions of Article 13, and in the same case, the expenses concerning the city, town and village in To, Do, Fu or prefecture concerned shall be limited within the amount equal to one half amount of the expenses computed in accordance with the provisions of Article 4, Article 5 and Article 13.

第十七條　国会議員の再選挙及び補欠選挙並びに国民審査の再審査の執行に要する経費の額は、第四條から第十五條までの規定によつて算出した額の三分の二に相当する額以内の額とする。
Article 17.　The amount of the expenses required for the execution of re-elections and by-elections of the members of the Diet and the execution of people's re-examination shall be limited within the amount equal to two-thirds of the amount computed in accordance with the provisions of Articles 4 to 15 inclusive.

(Delivery)
第十八條　全国選挙管理委員会は、第四條から前條までの規定によつて算出した各都道府県の選挙管理委員会において要する経費及び当該都道府県の区域内に在る市区町村の選挙管理委員会において要する経費で予算をもつて定められたものを都道府県に交付し、都道府県は、当該都道府県の区域内に在る市町村において要する経費として交付を受けた額を市町村に交付するものとする。
Article 18.　The National Election Administration Commission shall deliver to To, Do, Fu or prefecture the expenses required for the election administration commission of the prefecture and the expenses required for the election administration commission of the city, town or village within the area of To, Do, Fu or prefecture concerned which were computed in accordance with the provisions of Article 4 to the preceding Article inclusive and provided for in the budget. To, Do, Fu or prefecture shall deliver to the city, town or village the amount which was delivered as the expenses required for the city, town or village in To, Do, Fu or prefecture concerned.
２　避けることのできない事故その他特別の事情によつて前項に規定する交付額をもつて国会議員の選挙等を執行することができない都道府県又は市町村に対しては、全国選挙管理委員会は、前項の交付額の百分の五以内の額で別に予算をもつて定められたものの範囲内において、必要な経費を追加して交付することができる。
2　In case To, Do, Fu or prefecture, or city, town or village can not manage the election of the members of the Diet, etc. with the grant as referred to the preceding paragraph owing to the unavoidable accident or other special circumstances, the National Election Administration Commission may deliver the additional expenses necessary, within the amount of five per cent of the grant, under the preceding paragraph which is provided for in the budget.
３　都道府県又は市町村が前二項の規定による交付金をもつて実施すべき国会議員の選挙等の事務の一部を実施することを要しなくなつた場合においては、全国選挙管理委員会は、既に交付した交付金のうちその事務の実施に要する経費に相当する額の全部又は一部を還付されることができる。
3　When To, Do, Fu or prefecture, or the city, town or village need not carry into effect a part of business affairs concerning the election of the members of the Diet, etc. which was expected to be carried out with the grant under the provisions of preceding two paragraphs, the National Election Administration Commission may demand To, Do, Fu or prefecture or the city, town or village to return the amount in part or whole, equal to the unnecessary business expense out of the grant which was already delivered.

第十九條　市区町村の選挙管理委員会が市区町村の区域を分けて数投票区を設け、若しくはその数を増加し、又は都道府県の選挙管理委員会が市の区域を分けて数開票区を設け、若しくはその数を増加しようとする場合においては、全国選挙管理委員会の定める基準に従つてしなければならない。
Article 19.　In case the election administration commission of the city, ward, town or village intends to divide the city, ward, town or village into a few polling districts or to increase the number of the polling district and the election administration commission of To, Do, Fu or prefecture intends to divide the city into a few ballot-counting districts or increase the number of the ballot-counting district, the election administration commission shall observe the standard thereof as provided for by the National Election Administration Commission.
（選挙人及び世帶数の意義）
(Meaning of the Number of Voters and Households)
第二十條　この法律における選挙人の数は、前年の十二月二十日をもつて確定した衆議院議員選挙人名簿に登載された選挙人の数とする。但し、当該選挙人名簿に登載された選挙人の数が選挙又は国民審査に用うべき選挙人名簿に登載された選挙人の数と著しく異るときは、その選挙人名簿に登載された選挙人の数とすることができる。
Article 20.　The Number of votes in this Law shall be the number of voters registered in the elector's list of the members of the House of Representatives, which shall be concluded on December 20 of the preceding year, provided that, it may be allowed to use the number of voters registered in the elector's list used in the election or people's examination, if the number of voters of the elector's list for the members of the House of Representatives is greatly different from the number of voters registered in the elector's list used in the election or people's examination.
２　この法律における世帶数は、官報で公示された最近の世帶数による。
2　The number of households in this law shall be prepared according to the latest number publicly noticed in the Official Gazette.
（地方公共団体の組合に対するこの法律の適用）
(Application of this Law to the Association of Local Public Bodies)
第二十一條　この法律の適用については、全部事務組合及び役場事務組合は一町村とみなし、その組合役場は町村役場とみなす。
Article 21.　With regard to the application of this Law, the all affairs association and the town or village office affairs association shall be regarded as a town or village and the office of such association shall be regarded as the office of town or village.
附　則
Supplementary Provisions:
１　この法律は、公布の日から施行する。
1.　This Law shall come into force as from the day of its promulgation.
２　公職選挙法（昭和二十五年法律第百号）施行の後初めて行う参議院議員の通常選挙に限り、第七條第一項の基本額は、左の表に掲げる額に当該都道府県の世帶数を乘じて得た額とする。
2.　Only in the case of the first regular election of the members of the House of Councillors to be held after the enforcement of the Public Offices Election Law (Law No.100 of 1950), the basic amount of expenses under Article 7 (expenses for issuance of election bulletins) paragraph 1 shall be the amount mentioned in the following chart multiplied by the number of house-holds in To, Do, Fu or prefecture concerned:
