第一章　総則
CHAPTER I General Provisions
（目的）
(Purpose)
第一條　この法律は、船舶職員として船舶に乘り組ますべき者の資格を定め、もつて船舶の航行の安全を図ることを目的とする。
Article 1.　The purpose of this Law is to secure the safety of navigation of vessels by prescribing the qualifications of those who are to man a vessel as ship's officers.
（定義）
(Definition)
第二條　この法律において「船舶」とは、日本船舶（船舶法（明治三十二年法律第四十六号）第一條に規定する日本船舶をいう。以下同じ。）、日本船舶を所有することができる者が借り入れた日本船舶以外の船舶又は本邦（本州、北海道、四国、九州及び運輸省令で定めるその附属の島をいう。以下同じ。）の各港間若しくは湖、川若しくは港のみを航行する日本船舶以外の船舶であつて、左の各号に掲げる船舶以外のものをいう。
Article 2.　In this Law "vessel" shall mean a Japanese vessel (a Japanese vessel as prescribed in Article 1 of the Ship's Law (Law No.46 of 1899);hereinafter the same), a vessel other than a Japanese vessel which has been chartered by a person who may possess a Japanese vessel or a vessel other than a Japanese vessel which navigates only between ports or on the lakes, rivers, or harbors of Japan (Honshu, Hokkaido, Shikoku, Kyushu and such other islands attached thereto as stipulated by Ministry of Transportation Ordinance;hereinafter the same), excepting those vessels given in the following items:
一　総トン数五トン未満の船舶
(1)　Vessels of less than 5 gross tons;
二　ろかい又は主としてろかいのみをもつて運転する舟
(2)　Vessels operated by oars or chiefly by oars;
三　日本船舶を所有することができない者に貸し付けた日本船舶その他運輸省令で定める船舶
(3)　Japanese vessels chartered by those who may not possess Japanese vessels or such other vessels an prescribed by Ministry of Transportation Ordinance.
２　この法律において「船舶職員」とは、船舶において、船長、一等航海士、二等航海士、三等航海士、機関長、一等機関士、二等機関士、三等機関士、一等船舶通信士、二等船舶通信士及び三等船舶通信士の職務を行う者をいう。
2　In this Law "ship's officer" shall mean a person who, in a vessel, performs the function of a Captain, First Mate, Second Mate, Third Mate, Chief Engineer, First Engineer, Second Engineer, Third Engineer, First Ship's Radio Operator, Second Ship's Radio Operator or Third Ship's Radio Operator.
３　この法律において「海技従事者」とは、第四條の規定による免許を受けた者をいう。
3　In this Law "marine technician" shall mean a person who has obtained the license mentioned in the provisions of Article 4.
（法の適用）
(Application of the Law)
第三條　この法律のうち船舶所有者に関する規定は、船舶共有の場合には船舶管理人に、船舶貸借の場合には船舶借入人に適用する。
Article 3.　In this Law the provisions in regard to the owner of a vessel shall apply to the manager in the case of a jointly owned vessel or the charterer in the case of a chartered vessel.
第二章　海技従事者の免許及び海技従事者国家試験
CHAPTER II Marine Technician's License and State Examination for Marine Technicians
（免許）
(License)
第四條　船舶職員になろうとする者は、海技従事者の免許を受けなければならない。
Article 4.　A person intending to be a ship's officer shall obtain a license as marine technician.
２　前項の海技従事者の免許は、海上保安庁長官が行う海技従事者国家試験（以下「試験」という。）に合格した者について行う。
2　The marine technician's license mentioned in the preceding paragraph shall be given by the Director of the Maritime Safety Agency to a person who has passed the State Examination for Marine Technicians (hereinafter referred to as "the examination" ).
３　第一項の免許の申請は、申請者が試験に合格した日から三箇月以内にこれをしなければならない。
3　The application for the license mentioned in paragraph 1 shall be made within three months from the day when the applicant passed the examination.
（資格）
(Qualifications)
第五條　前條の免許は、左に掲げる資格別に行う。
Article 5.　The license mentioned in the preceding Article shall be given in accordance with the following kinds of qualifications:

２　海上保安庁長官は、前項の甲種機関長、甲種一等機関士、甲種二等機関士、乙種機関長、乙種一等機関士、乙種二等機関士、丙種機関長又は丙種機関士の資格についての免許につき、運輸省令で定めるところにより、船舶の機関の種類についての限定をすることができる。
2　The Director of the Maritime Safety Agency may, as regards the license in respect of the qualifications of A Class Chief Engineer, A Class First Engineer, A Class Second Engineer, B Class Chief Engineer, B Class First Engineer, B Class Second Engineer, C Class Chief Engineer, or C Class Engineer, mentioned in the preceding paragraph, restrict the kind of ship's machinery, as may be fixed by Ministry of Transportation Ordinance.
（免許を與えない場合）
(Cases Not Licensed)
第六條　左の各号の一に該当する者には、免許を與えない。
Article 6.　Any person coming under any of the following items shall not be granted a license:
一　小型船舶操縦士の資格についての免許にあつては十八才に満たない者、小型船舶操縦士以外の資格についての免許にあつては二十才に満たない者
(1)　A person under 18 years of age in the case of the license in regard to the qualifications of a small-sized vessel operator and a person under 20 years of age in the case of the license in regard to the qualifications other than those of a small-sized vessel operator;
二　海難審判法（昭和二十二年法律第百三十五号）第四條第二項の裁決により海技従事者の免許を取り消された者
(2)　A person whose license as marine technician has been revoked by the decision mentioned in Article 4 paragraph 2 of the Marine Accident Inquiry Law (Law No.135 of 1947);
三　第十條第一項の規定により免許を取り消され、取消の日から二年を経過しない者
(3)　A person with respect to whom two years have not elapsed since the day when his license was revoked in accordance with the provisions of Article 10 paragraph 1.
（登録及び海技免状）
(Registration and Certificate of Competency)
第七條　海上保安庁長官は、免許を與えたときは、海技従事者免許原簿に登録し、且つ、海技免状を交付しなければならない。
Article 7.　The Director of the Maritime Safety Agency shall, when he has given a license to a person, register it in the Marine Technician License Register and issue a certificate of competency to such person.
２　海技従事者免許原簿は、海上保安庁に備える。
2　The Marine Technician License Register shall be kept by the Marine Safety Agency.
（免許の有効期間）
(Term of Validity of License)
第八條　免許の有効期間は、免許の日から起算して五年とする。但し、海技従事者が、免許の有効期間の満了の際本邦以外の地にある場合その他運輸省令で定める場合には、その者の有する免許は、有効期間満了後も、一年以内において運輸省令で定める期間、なお、その効力を有する。
Article 8.　The term of validity of a license shall be five (5) years reckoned from the day of the licensing; provided that, in the cases where a marine technician is, at the time of expiration of the effective term of his license, in a place outside Japan or in other cases prescribed by Ministry of Transportation Ordinance, the license held by such person shall continue to be valid for such period not exceeding one (1) year as may be fixed by Ministry of Transportation Ordinance even after expiration of the term of validity.
２　甲種船舶通信士、乙種船舶通信士又は丙種船舶通信士の資格についての免許は、前項の有効期間中であつても、電波法（昭和二十五年法律第百三十一号）第四十一條の規定による無線従事者の免許が効力を失つたときは、その効力を失う。
2　A license in regard to the qualifications of A Class Ship's Radio Operator, B Class Ship's Radio Operator or C Class Ship's Radio Operator shall lose its validity even during the effective term mentioned in the preceding paragraph in case a Radio Operator's License as provided for in Article 41 of the Radio Law (Law No.131 of 1950) has become invalid.
（免許の更新）
(Renewal of License)
第九條　海技従事者は、海上保安庁長官に対し、同一の資格について免許の更新を申請することができる。
Article 9.　A marine technician may apply to the Director of the Maritime Safety Agency for the renewal of his license for the same class of qualifications.
２　海上保安庁長官は、前項の申請があつた場合には、運輸省令で定めるところにより、免許の更新のために必要な範囲において試験を行う。
2　The Director of the Maritime Safety Agency shall, when there is an application mentioned in the preceding paragraph, give the examination to the applicant within the scope necessary for the renewal of license as may be fixed by Ministry of Transportation Ordinance.
３　前條第一項の規定は、免許の更新に準用する。
3　The provision of paragraph 1 of the preceding Article shall apply mutatis mutandis to the renewal of license.
（免許の取消等）
(Revocation, etc. of License)
第十條　海上保安庁長官は、海技従事者が左の各号の一に該当するときは、その免許を取り消し、一年以内の期間を定めてその業務の停止を命じ、又はその者を戒告することができる。但し、これらの事由によつて海難審判法第二條の海難が発生したときは、この限りでない。
Article 10.　The Director of the Maritime Safety Agency may, when a marine technician comes under any of the following items, revoke his license, order to suspend his duty during a fixed period of not more than one (1) year or give warning to such person;provided that this shall not apply to the case where the sea casualty mentioned in Article 2 of the Marine Accident Inquiry Law has been caused by one of these items:
一　この法律又はこの法律に基く命令の規定に違反したとき。
(1)　When he has violated the provisions of this Law or order based thereon;
二　船舶職員として職務を行うに当り、非行があつたとき。
(2)　When he has committed any malfeasance in performing his duty as a ship's officer.
２　海上保安庁長官は、前項の規定による処分をしようとするときは、海上保安審議会の意見を聞き、その意見を尊重してしなければならない。
2　The Director of the Maritime Safety Agency shall, in case he intends to make the disposition in accordance with the provisions of the preceding paragraph, hear the opinion of the Maritime Safety Council and put it into execution in deference to the opinion thereof.
（聽聞）
(Hearing)
第十一條　海上保安審議会は、前條第二項の規定による意見を決定しようとするときは、公開による聽聞を行わなければならない。
Article 11.　The Maritime Safety Council shall, in case it intends to decide the opinion under the provision of paragraph 2 of the preceding Article, hold a public hearing.
２　前項の場合においては、海上保安審議会は、当該処分に係る者に対し、処分をしようとする事由並びに聽聞の期日及び場所を期日の十五日前までに通知し、且つ、聽聞の期日及び場所を公示しなければならない。
2　In the case of the preceding paragraph the Maritime Safety Council shall notify the parties connected with the disposition concerned of the reason wherefor the disposition is going to be made and the date and place of the hearing by 15 days prior to the date, and make public the date and place of the hearing.
３　聽聞に際しては、当該処分に係る者若しくはその代理人又は利害関係人は、当該事案について、意見を述べ、及び証拠を提出することができる。
3　At the hearing the parties connected with the disposition or proxies thereof or those interested in the case may state their opinions and produce evidences in regard to the case concerned.
（試験の実施）
(Execution of the Examination)
第十二條　試験は、海上保安庁長官が第五條第一項に掲げる資格別（同條第二項の規定により免許について船舶の機関の種類についての限定をする場合においては、資格別且つ船舶の機関の種類別）に行う。
Article 12.　The examination shall be conducted by the Director of the Maritime Safety Agency according to the different kinds of qualifications mentioned in Article 5 paragraph 1 (in case he restricts the kinds of ship's machinery as regards the license in accordance with the provision of paragraph 2 of the same Article, the different kinds of qualifications and also the different kinds of ship's machinery).
（試験の内容）
(Contents of the Examination)
第十三條　試験は、船舶職員として必要な知識及び能力を有するかどうかを判定することを目的として行う。
Article 13.　The examination shall be conducted for the purpose of deciding whether the applicant has knowledge and ability required for a ship's officer.
２　試験は、身体検査及び学術試験とする。
2　The examination shall consist of the physical examination and the technical examination.
（受験資格）
(Qualifications for the Examination)
第十四條　試験は、第五條第一項に掲げる資格別（同條第二項の規定により免許について船舶の機関の種類についての限定をする場合においては、資格別且つ船舶の機関の種類別）に、運輸省令で定める乘船履歴を有する者でなければ、受けることができない。
Article 14.　No person other than those who have such experience of having been on board a vessel as fixed by Ministry of Transportation Ordinance according to the different kinds of qualifications mentioned in Article 5 paragraph 1 (in case the restriction of the kinds of ship's machinery is made as regards the license in accordance with the provision of paragraph 2 of the same Article, the different kinds of the qualifications and also the different kinds of ship's machinery), shall take the examination.
２　外国政府の授與した船舶の運航又は機関の運転に関する資格証書を有する者であつて、海上保安庁長官の承認を受けた者は、前項の規定にかかわらず、海上保安庁長官が相当と認める資格について試験を受けることができる。
2　A person who holds a certificate granted by a foreign government as regards seamanship or operation of ship's machinery and who has been approved by the Director of the Maritime Safety Agency may take the examination in regard to such qualifications as recognized by the Director of the Maritime Safety Agency as corresponding, regardless of the provision of the preceding paragraph.
３　甲種船舶通信士、乙種船舶通信士又は丙種船舶通信士の資格についての試験は、第一項の規定による外、運輸省令で定める電波法第四十條の資格について同法第四十一條の免許を受けた者でなければ、受けることができない。
3　The examination in regard to the qualifications of A Class Ship's Radio Operator, B Class Ship's Radio Operator or C Class Ship's Radio Operator shall not be taken by any person other than those who have obtained the license mentioned in Article 41 of the Radio Law as fixed by Ministry of Transportation Ordinance as regards the qualifications mentioned in Article 40 of the same Law, in addition to those as provided for in paragraph 1.
（海上保安審議会への諮問）
(Consultation with the Maritime Safety Council)
第十五條　海上保安庁長官は、試験の実施に関する重要事項については、海上保安審議会の意見を聞き、その意見を尊重しなければならない。
Article 15.　With regard to the important matters relating to the execution of the examination, the Director of the Maritime Safety Agency, shall hear the opinion of the Maritime Safety Council and have a regard therefor.
（不正受験者の処分）
(Disposition of a Dishonest Examine)
第十六條　試験に関して不正の行為があつたときは、海上保安庁長官は、当該不正行為に関係ある者について、その試験を停止し、又はその合格を無効とすることができる。この場合において、その者について二年以内の期間を定めて試験を受けさせないことができる。
Article 16.　In case any dishonest conduct is found relating to the examination, the Director of the Maritime Safety Agency may suspend the person connected with the unjust conduct from receiving the examination or annul his success in the examination. In such case he may cause such dishonest person not to be take the examination for a fixed period not exceeding two (2) years.
（命令への委任）
(Delegation to the Order)
第十七條　この法律に定めるものの外、免許の申請、登録、海技免状の様式、交付、再交付、提出及び返納その他の免許に関する実施細目並びに試験科目、受験手続、身体検査の合格標準その他の試験に関する実施細目は、運輸省令で定める。
Article 17.　Besides the matters prescribed by this Law, the details related to the license application for and registry of license, form, issuing, reissuing, presentation and return of certificate of competency, etc. and the details for giving the examination such as subjects and formalities of the examination, standards of the physical examination, etc. shall be prescribed by Ministry of Transportation Ordinance.

CHAPTER III Ship's Officer
（船舶職員として船舶に乘り組ますべき者の資格）
(Qualifications of Those to Man a Vessel as Ship's Officers)
第十八條　船舶所有者は、別表第一、別表第二、別表第三　別表第四又は別表第五の船舶の欄に掲げる船舶には、同表の船舶職員の欄に掲げる船舶職員として、同表の資格の欄に掲げる資格又はこれより上級の資格の海技従事者を乘り組ませなければならない。但し、無線電信の施設を有しない船舶にあつては、一等船舶通信士、二等船舶通信士又は三等船舶通信士の職務を行う者を乘り組ませることを要しない。
Article 18.　The owner of a vessel shall cause any of the vessels given in the Vessel column of Annexed Table No.1, No.2, No.3, No.4 or No.5 to be manned with marine technicians having qualifications mentioned in the Qualification column of the same Table or upper grade thereof, as ship's officers enumerated in the Ship's Officer column of the same Table;provided that vessels having no wireless facilities shall require no person to be on board to perform the duty of A Class Snip's Radio Operator, B Class Ship's Radio Operator or C Class Ship's Radio Operator.
２　船舶所有者は、海技従事者が第五條第二項の規定によりその免許について船舶の機関の種類についての限定をされた者である場合においては、その限定をされた種類の機関の船舶でなければ、別表第一又は別表第二の船舶職員の欄に掲げる船舶職員として乘り組ませてはならない。
2　In the case of marine technicians having been restricted with respect to the kinds of ship's machinery as regards the license in accordance with the provision of Article 5 paragraph 2, the owner of vessel shall not cause those vessels other than those equipped with the restricted kind of ship's machinery to be manned with such marine technicians as any of the ship's officers enumerated in the Ship's Officers column of Annexed Table No.1 or No.2.
３　第一項の資格の上級及び下級の別は、別表第六による。
3　The classification of upper and lower grades of qualifications mentioned in paragraph 1 shall be in accordance with Annexed Table No.6.
第十九條　前條の規定は、左の各号に掲げる場合には、適用しない。
Article 19.　The provisions of the preceding Article shall not apply to the case given in each of the following items:
一　外国（本邦以外の地をいう。以下同じ。）において所有権を取得し、又は借り入れた船舶を、外国の港から本邦の港まで回航するとき。
(1)　When a vessel the ownership of which has been obtained or which has been chartered in a foreign country (any place outside Japan;hereinafter the same) is brought to a port of Japan from a port of the foreign country;
二　外国の各港間を航行する船舶が、船舶職員に欠員を生じ、その補充が困難であるとき。
(2)　When a vessel sailing between ports of a foreign country has caused a vacancy in her ship's officers and replenishment thereof is difficult;
三　本邦の港と外国の港との間を航行する船舶が、本邦外で船舶職員に欠員を生じ、本邦の港まで航行するとき。
(3)　When a vessel sailing between a port of Japan and that of a foreign country has caused a vacancy in her ship's officers outside Japan and sails back to the port of Japan;
四　前二号に定める場合を除く外、船舶が、航行中に船舶職員に欠員を生じ、その補充が困難であるとき。
(4)　Besides the cases prescribed in the preceding two items, when a vessel has, while navigating, caused a vacancy in her ship's officers and replenishment thereof is difficult.
第二十條　船舶所有者は、船舶が左の各号の事由に該当する場合において、海上保安庁長官の承認を受けたときは、第十八條の規定にかかわらず、その指定する資格の海技従事者をその指定する職の船舶職員として船舶に乘り組ませることをもつて足りる。
Article 20.　The owner of a vessel shall, when the approval of the Director of the Maritime Safety Agency has been obtained in case his vessel falls under any of the following items, be satisfied with manning the vessel with the marine technicians of the designated qualifications as ship's officers of the designated duty, regardless of the provisions of Article 18:
一　他の船舶にひかれて航行する場合
(1)　When a vessel is being towed by another vessel;
二　入きよ、修繕その他の事由により航行の用に供しない場合
(2)　When a vessel is not employed for navigation on account of docking, repair or any other reason;
三　特殊の構造又は装置を有する場合
(3)　When a vessel is of a peculiar structure or equipment.
（海技従事者がなることができる船舶職員）
(Ship's Officership which a Marine Technician May Assume)
第二十一條　別表第一、別表第二、別表第三、別表第四又は別表第五の資格の欄に掲げる資格又はこれより上級の資格の海技従事者でなければ、同表の船舶の欄に掲げる船舶の同表の船舶職員の欄に掲げる船舶職員の業務を行つてはならない。
Article 21.　No person other than marine techinicians who have the qualifications mentioned in the Qualifications column of Annexed Table No.1, No.2, No.3, No.4 or No.5 or upper grade thereof shall perform the duty of the ship's officers enumerated in the Ship's Officer column of the same Table on board the vessel given in the Vessel column of the same Table.
２　第五條第二項の規定によりその免許について船舶の機関の種類についての限定をされた海技従事者は、その限定をされた種類の機関の船舶でなければ、別表第一又は別表第二の船舶職員の欄に掲げる船舶職員の業務を行つてはならない。
2　The marine technicians who are restricted with respect to the kind of ship's machinery as regards the license in accordance with the provision of Article 5 paragraph 2 shall not perform the duty of the ship's officers enumerated in the Ship's Officer column of Annexed Table No.1 or No.2 on board the vessels other than those equipped with the restricted kind of machinery.
３　第十八條第三項の規定は、第一項の資格の上級及び下級の別に準用する。
3　The provisions of Article 18 paragraph 3 shall apply mutatis mutandis to the classification of upper and lower grades of qualifications of paragraph 1.
第二十二條　船舶所有者が第二十條の規定により海上保安庁長官の承認を受けた場合には、その指定する資格の海技従事者は、前條の規定にかかわらず、当該船舶においてその指定する職の船舶職員の業務を行つてもよい。
Article 22.　In case the owner of a vessel has obtained the approval of the Director of the Maritime Safety Agency in accordance with the provisions of Article 20, the marine technician of the designated qualifications may perform the duty of the ship's officer of the designated duty in the vessel concerned, regardless of the provisions of the preceding Article.
（海技免状の携行）
(Carrying of Certificate of Competency)
第二十三條　海技従事者は、船舶職員の業務を行う場合には、船内に海技免状を備え置かなければならない。
Article 23.　A marine technician shall, when he performs the duty of a ship's officer, keep his certificate of competency in the vessel.
第四章　雑則

（海技免状の讓渡等の禁止）
(Prohibition of Transfer, etc. of Certificate of Competency)
第二十四條　海技従事者は、その受有する海技免状を他人に讓渡し、又は貸與してはならない。
Article 24.　The marine technician shall not transfer or lend his certificate of competency to others.
（訴願）
(Appeal)
第二十五條　この法律又はこの法律に基く命令により海上保安庁長官がした処分に不服のある者は、運輸大臣に訴願をすることができる。
Article 25.　A person who is dissatisfied with the dispositions made by the Director of the Maritime Safety Agency in accordance with this Law or orders based thereon, may appeal to the Minister of Transportation.
（手数料）
(Fees)
第二十六條　試験を受ける者、海技免状の再交付を申請する者又は小型船舶操縦士の資格についての免許を申請する者は、手数料を納めなければならない。
Article 26.　Those who apply for the examination, who apply for reissuing of their certificate of competency or who apply for the license in regard to the qualifications of a small-sized vessel operator shall pay the fees.
２　前項の手数料の額は、試験を受ける者については五百円、海技免状の再交付を申請する者については三百円、小型船舶操縦士の資格についての免許を申請する者については百円をこえない範囲内で政令で定める。
2　The amount of the fees of the preceding paragraph shall be fixed by Cabinet Order within the limit not exceeding five hundred (500) yen for the applicant for the examination, three hundred (300) yen for the applicant for the reissuing of the certificate of competency and of not more than one hundred (100) yen for the applicant for the license as regards the qualifications of a small-sized vessel operator.
（事務の委任）
(Delegation of Business)
第二十七條　海技従事者の免許及び試験に関する事務であつて小型船舶操縦士の資格に係るものは、政令で定めるところにより、都道府県知事に行わせることができる。
Article 27.　The authority to conduct such business concerning the license and examination of a marine technician as related to the qualification of a small-sized vessel operator may, as may be fixed by Cabinet Order, be delegated to the governor of To, Do, Fu or prefecture.
（外国における事務）
(Affairs in Foreign Countries)
第二十八條　第二十條の事務その他運輸省令で定める事務は、外国においては、領事官が行う。
Article 28.　Affairs mentioned in Article 20 and such other matters as may be provided for by Ministry of Transportation Ordinance shall, in a foreign country, be handled by a consul.
（命令の制定）
(Establishment of Orders)
第二十九條　運輸大臣は、この法律に基く命令を制定しようとするときは、農林大臣に協議しなければならない。
Article 29.　The Minister of Transportation shall confer with the Minister of Agriculture and Forestry in case he intends to establish any order based on this Law.
第五章　罰則
CHAPTER V Penal Provisions
（罰則）
(Penal Provisions)
第三十條　左の各号の一に該当する者は、二十万円以下の罰金に処する。
Article 30.　Any person who comes under any of the following items shall be punished with a fine not exceeding two hundred thousand (200,000) yen:
一　第十八條第一項又は第二項の規定に違反した者
(1)　Any person who has violated the provisions of Article 18 paragraph 1 or paragraph 2;
二　第十條第一項又は海難審判法第五條の規定による業務の停止の処分を受けている者を船舶職員として船舶に乘り組ませた者
(2)　Any person who has caused vessels to be manned as ship's officer with those who have been disposed of with the suspension of work as provided for in Article 10 paragraph 1 of this Law or in Article 5 of the Marine Accident Inquiry Law.
第三十一條　左の各号の一に該当する者は、三万円以下の罰金に処する。
Article 31.　Any person who comes under any of the following items shall be punished with a fine not exceeding thirty thousand (30,000) yen:
一　第二十一條第一項又は第二項の規定に違反した者
(1)　Any person who has violated the provisions of Article 21 paragraph 1 or paragraph 2;
二　第十條第一項又は海難審判法第五條の規定による業務の停止の処分に違反して船舶職員の業務を行つた者
(2)　Any person who has been engaged in the work of a ship's officer in violation of the disposition of suspension of work as provided for in Article 10 paragraph 1 of this Law or in Article 5 of the Marine Accident Inquiry Law.
第三十二條　第二十三條又は第二十四條の規定に違反した者は、五千円以下の過料に処する。
Article 32.　Any person who has violated the provision of Article 23 or Article 24 shall be punished with a non-criminal fine not exceeding five thousand (5,000) yen.
（両罰規定）
(Dual Punishment Provisions)
第三十三條　法人の代表者又は法人若しくは人の代理人、使用人その他の従業者が、その法人又は人の業務に関して、第三十條の違反行為をしたときは、行為者を罰する外、その法人又は人に対しても同條の刑を科する。但し、法人又は人の代理人、使用人その他の従業者の当該違反行為を防止するため当該業務に対し相当の注意及び監督が盡されたことの証明があつたときは、その法人又は人については、この限りでない。
Article 33.　When a representative of a juridical person or an agent, employee or other workers of a juridical person or an individual has perpetrated the offences under Article 30 in connection with the business of the juridical person or individual, not only the perpetrator shall be punished, but also the juridical person or individual shall be subjected to the punishment under the same Article. However, this shall not apply to the juridical person or individual who has been proved to have exerted due attention and supervision regarding the business in order to prevent such offence of the agent, employee or other workers of the juridical person or individual.

Supplementary Provisions:
（施行期日）
(Date of Enforcement)
１　この法律施行の期日は、公布の日から起算して六箇月をこえない期間内において政令で定める。
1　The date of enforcement of this Law shall be so fixed by Cabinet Order as to be within a period not exceeding six (6) months calculating from the date of its promulgation.
（適用の特例）
(Special Cases of Application)
２　第十八條第一項及び第二項並びに第二十一條第一項及び第二項の規定の適用については、昭和二十九年八月三十一日までは、これらの規定中「別表第一、別表第二、別表第三、別表第四又は別表第五」とあり又は「別表第一又は別表第二」とあるのは、「別表第七」と読み替えるものとする。
2　With regard to the application of the provisions of Article 18 paragraphs 1 and 2 and Article 21 paragraphs 1 and 2, "Annexed Table No.1, No.2, No.3, No.4 or No.5" or "Annexed Table No.1 or No.2" in these provisions shall read "Annexed Table No.7" till August 31, 1954.
（船舶職員法の廃止）

３　船舶職員法（明治二十九年法律第六十八号。以下「旧法」という。）は、廃止する。
3　The Ship's Officer Law (Law No.68 of 1896;hereinafter referred to as "the old Law" ) shall be abolished.

４　臨時船舶管理法（昭和十二年法律第九十三号）の一部を次のように改正する。

６　水先法（昭和二十四年法律第百二十一号）の一部を次のように改正する。
6　The Marine Pilot Law (Law No.121 of 1949) shall be partially amended as follows:
第五條第三号を次のように改める。
Article 5 item (3) shall be amended as follows:
三　船舶職員法（昭和二十六年法律第百四十九号）の規定による海技従事者の免許を取り消され、又は船長の職務につき三回以上業務の停止を命ぜられた者
(3)　A person who has had his license as a marine technician under the Ship's Officer Law (Law No.149 of 1951) revoked or has had his duty of a captain suspended three times or more;
第十四條第二項中「免許を停止されている」を「業務の停止の処分を受けている」に改める。
In Article 14 paragraph 2, "suspended his license" shall be amended as "disposed of with the suspension of the work" .
第二十三條中「停止し」を「業務の停止を命じ」に改める。
In Article 23, "revoke or suspend a pilot's license" shall be amended as "revoke a pilot's license or order to suspend the work" .
第二十四條第一項中「免許を停止された者」を「業務の停止の処分を受けた者」に、同條第二項中「停止する」を「業務の停止を命ずる」に改める。
In Article 24 paragraph 1, "who has been suspended" shall be amended as "who has been disposed of with the suspension of the work," and in paragraph 2 of the same Article, "revoke or suspend the pilot's license." shall be amended as "revoke the pilot's license or order to suspend the work."
７　海難審判法の一部を次のように改正する。
7　The Marine Accident Inquiry Law shall be partially amended as follows:
第四條第二項中「海技免状を受有する者」を「海技従事者」に改める。
In Article 4 paragraph 2, "the holder of a certificate of competency" shall be amended as "the marine technician" .
第五條を次のように改める。
Article 5 shall be amended as follows:
第五條　懲戒は、左の三種とし、その適用は、所為の軽重に従つてこれを定める。
Article 5.　The disciplinary punishment shall be divided into the following three kinds, the application of which shall be decided according to the relative degree of offences:
一　免許の取消
(1)　Revocation of license;
二　業務の停止
(2)　Suspension of work;
三　戒告
(3)　Warning.
業務の停止の期間は、一箇月以上三年以下とする。
The period of suspension of work shall be not less than one (1) month but not more than three (3) years.
第三十四條第一項中「海技免状を受有する者」を「海技従事者」に、第五十九條中「海技免状の行使の禁止又は水先人の免許の取消」を「免許の取消」に、第六十條中「海技免状の行使の停止又は水先人の免許の停止」を「業務の停止」に、第六十一條中「海技免状の行使の禁止若しくは停止又は水先人の免許の取消若しくは停止」を「免許の取消又は業務の停止」に改める。
In Article 34 paragraph 1, "the holder of a certificate of competency" shall be amended as "the marine technician" ;in Article 59, "prohibition of a certificate of competency or revocation of a pilot's license" shall be amended as "revocation of license" ;in Article 60, "a certificate of competency or pilot's license" shall be amended as "the work" ;and in Article 61, "whose certificate of competency or pilot's license" shall be amended as "whose license or work" .
（経過規定）
(Transitional Provisions)
８　この法律施行の際、現に旧法第三條に定める種類の海技免状（船舶職員法中改正法律（昭和十九年法律第五号）附則第三項の規定に基いて旧法による海技免状に代用できるものを含む。以下「旧免状」という。）を受有する者は、この法律施行の日において、旧免状の種類と同一の名称の資格につきこの法律に基き免許を受けた者とみなし、これらの者についての旧法による海技免状原簿に対する登録は、この法律に基く海技従事者免許原簿に対する登録とみなし、且つ、その者の受有する海技免状は、この法律に基く海技免状とみなす。
8　A person who holds at the time of enforcement of this Law a certificate of competency of such kinds as provided for in Article 3 of the old Law (including such other certificate as may be used it lieu of the certificate of competency under the old Law in accordance with the provisions of paragraph 3 of Supplementary Provisions of the Law for Partial Amendments to the Ship's Officer Law (Law No.5 of 1944);hereinafter referred to as "the old certificate" ) shall, on the date of enforcement of this Law, be regarded as a person licensed in accordance with this Law in regard to the qualifications of the same title as that of the old certificate, and the registry on the Ship's Officer License Register for such person in accordance with the old Law shall be regarded as the registry on the Marine Technician License Register under this Law and also the certificate of competency held by such person shall be regarded as the certificate of competency under this Law.
９　海上保安庁長官は、前項の規定により丙種航海士又は丙種機関士の資格についての免許を受けた者とみなされた者であつて、昭和二十九年八月三十一日までの運輸省令で定める乘船履歴を有するものに対しては、その者の申請により、試験を行わないで、丙種船長又は丙種機関長の資格についての免許を與えることができる。
9　The Director of the Maritime Safety Agency may, when applied by a person who is regarded as licensed in regard to the qualification of a C Class Mate or C Class Engineer in accordance with the provision of the preceding paragraph and who has such sea experience until August 31, 1954 as provided for by Ministry of Transportation Ordinance, give to such person a license in regard to the qualification of a C Class Captain or C Class Chief Engineer without conducting the examination.
10　海上保安庁長官は、この法律施行の際、現に左に掲げる船舶において船長の職務を行つている者に対しては、その居住する市町村の長（特別区にあつては特別区の長）のその旨の証明があつた場合に限り、昭和二十九年八月三十一日までのその者の申請により、試験を行わないで、小型船舶操縦士の資格についての免許を與えることができる。
10　The Director of the Maritime Safety Agency may issue without examination the license with respect to the qualification of small-sized vessel operator on the application filed by August 31, 1954 to the person who, at the time of the enforcement of this Law, is actually engaging in the exercise of the duties of captain on the following ships, only in case a head of a city, town or village (a head of a special ward in the case of a special ward) of his residence has certified to that effect:
一　総トン数二十トン未満の帆船
(1)　Sailing vessels under 20 G/T;
二　総トン数二十トン未満の漁船
(2)　Fishing vessels under 20 G/T;
三　平水区域を航行区域とする帆船
(3)　Sailing vessels whose navigation area is the smooth water area.
11　海上保安庁長官は、この法律施行の際、現に船舶の運航、機関の運転又は無線電信による通信に関する学術を教授する学校であつて、運輸省令で定めるものに在学している者がその学校を卒業後初めて試験を受ける場合又は現にその学校を卒業している者がその学校を卒業後初めて試験を受ける場合若しくは昭和二十九年八月三十一日までに試験を受ける場合には、運輸省令で定めるところにより、学術試験を免除することができる。
11　In case a person who, at the time of the enforcement of this Law, is a student of a school authorized by Ministry of Transportation Ordinance where technical knowledge is given in respect of seamanship, operation of ship's machinery or wireless telegraphy and who applies for the examination only for the first time after graduating from such school or in case a person who, at the time of the enforcement of this Law, is a graduate of such school and who applies for the examination only for the first time after graduating from such school, or who applies for such examination before August 31, 1954, the Director of the Maritime Safety Agency may exempt such person from taking the technical examination as may be fixed by Ministry of Transportation Ordinance.
12　この法律施行前にした行為に対する罰則の適用については、この法律施行後も、なお、従前の例による。
12　The application of penal provisions to acts committed prior to the enforcement of this Law shall still be as heretofore even after the enforcement of this Law.
13　この法律施行前に水先法の規定によつてした免許の停止の処分は、水先法の改正規定によつてした業務の停止の処分とみなす。この場合において、停止の期間は、なお、従前の例による。
13　The disposition of suspension of license made in accordance with the provisions of the Marine Pilot Law prior to the enforcement of this Law shall be regarded as the disposition of suspension of work made in accordance with the amended provisions of the Marine Pilot Law. In this case, the term of suspension shall still be as heretofore.
14　この法律施行前に旧海員懲戒法（明治二十五年法律第六十九号）又は海難審判法の規定によつてした海技免状の行使の禁止又は停止の処分は、それぞれ海難審判法の改正規定によつてした海技従事者の免許の取消又は業務の停止の処分とみなす。この場合において、停止の期間は、なお、従前の例による。
14　The disposition of prohibition or suspension of use of the certificate of competency made in accordance with the provisions of the former Seamen Discipline Law (Law No.69 of 1892) or the Marine Accident Inquiry Law shall respectively be regarded as the disposition or revocation of marine technician's license or suspension of work made in accordance with the provisions as amended of the Marine Accident Inquiry Law. In this case, the term of suspension shall still be as heretofore.
