第一章　総則
Chapter I. General Provisions
（法律の目的）
(Object of Law)
第一條　この法律は、港内における船舶交通の安全及び港内の整とんを図ることを目的とする。
Article 1.　This Law shall have for its object to secure the safety of navigation of vessels, and to muntain good order within all ports.
（港域）
(Area of Port)
第二條　港の区域は、別に法律でこれを定める。
Article 2.　The areas of ports shall be defined by a separate Law.
（定義）
(Definition)
第三條　この法律において「雜種船」とは、汽艇、はしけ及び端舟その他ろかいのみをもつて運轉し、又は主としてろかいをもつて運轉する船舶をいう。
Article 3.　By the term "miscellaneous vessels" as is used in this Law is meant launches, lighters, small boats and all kinds of ships and boats wholly or chiefly propelled by oars.
２　この法律において「特定港」とは、きつ水の深い船舶が出入できる港又は外國船舶が常時出入する港であつて、別表に掲げるものをいう。
By the term "special port" is meant a part which is capable of admitting deep draft vessels and is customarily used for foreign vessels. A list of special parts is annexed hereto.
第二章　入出港及び停泊
Chapter II. Port Where Ships go in and out, and Anchorage
（入出港の届出）
(Report on Entrance and Departure)
第四條　船舶は、特定港に入港したとき又は特定港を出港しようとするときは、命令の定めるところにより、港長に届け出なければならない。
Article 4.　A vessel which has entered a special port or which intends to clear a special port shall make a report to the captain of the port in accordance with the provisions of Ministerial Ordinance.
（びよう地）
(Anchorage)
第五條　特定港内に停泊する船舶は、命令の定めるところにより、各々そのトン数又は積載物の種類に従い、当該特定港内の一定の区域内に停泊しなければならない。
Article 5.　Vessels anchoring in a special port shall anchor within the specified area of the said special port according to their respective tonnages or kinds of cargoes, in accordance with the provisions of a Ministerial Order.
２　命令の定める船舶は、命令の定める特定港に入港する際、港長からびよう地の指定を受けなければならない。この場合には、港長は、特別の事情がない限り、前項に規定する一定の区域内においてびよう地を指定しなければならない。
As to vessels specified by a Ministerial Order, the captain of the port shall designate their anchorage in cases where they enter any of the special ports as prescribed by a Ministerial Order. In such case, the captain of the port shall designate their anchorage within the specific area mentioned in the preceding paragraph, so far as there exist no special circumstances.
３　前項に規定する特定港以外の特定港でも、港長は、特に必要があると認めるときは、入港船舶に対しびよう地を指定することができる。
The captain of the port may, when deemed especially necessary, designate the anchorage for an entering vessel, even in any of the special ports other than those provided for in the preceding paragraph.
４　前二項の規定により、びよう地の指定を受けた船舶は、第一項の規定にかかわらず、当該びよう地に停泊しなければならない。
The vessel for which the anchorage has been designated in accordance with the provisions of the preceding two paragraphs shall anchor in the anchorage concerned notwithstanding the provisions of paragraph 1.
５　港長は、びよう地を指定するに当つては、けい船浮標、さん橋その他の施設で当該指定に係るものの管理者の意見を聽かなければならない。
In assigning the anchorage, the captain of the port shall take into consideration of the views of the persons in charge of mooring buoys, pier and other facilities.
（夜間入港の制限）
(Restriction on Entrance at Night)
第六條　前條第二項の規定によりびよう地の指定を受けなければならない船舶は、港長の許可のある場合又は海難を避けようとする場合その他やむを得ない事由のある場合を除いて、日沒から日出までの間は、同項に規定する港に入港してはならない。
Article 6.　A vessel whose anchorage shall be designated in accordance with the provisions of paragraph 2 of the preceding Article shall not, except in the case where the permission of the captain of the port has been obtained or where the vessel intends to ave t a sea disaster or where there exist unavoidable circumstances, enter any of the ports provided for in the same paragraph, during the period between sunset and sunrise.
（移動の制限）
(Restriction on Shifting)
第七條　雜種船以外の船舶は、第四條、第八條第一項、第十條及び第二十三條の場合を除いて、港長の許可を受けなければ、第五條第一項の規定により停泊した一定の区域外に移動し、又は港長から指定されたびよう地から移動してはならない。但し、海難を避けようとする場合その他やむを得ない事由のある場合は、この限りでない。
Article 7.　Any vessel other than miscellaneous vessels shall not, without the permission of the captain of the port except in cases as contemplated in Art.4, Art.8, par.1, Art.10 and Art.23 inclusive, shift her anchorage from the definite area where the said vessel has anchored according to the provisions of Article 5, paragraph 1, nor change her anchorage designated by the captain of the port;but this shall not apply to cases where the vessel intends to avert a sea disaster or where there exist unavoidable circumstances.
２　前項但書の規定により移動したときは、当該船舶は、遅滯なくその旨を港長に届け出なければならない。
In cases where a vessel has changed her anchorage in accordance with the provisions of the provisions of the preceding paragraph, the said vessel shall, without delay, make a report to the captain of the port to that effect.
（修繕及びけい船）
(Repairing and Mooring)
第八條　特定港内においては、雜種船以外の船舶を修繕し、又はけい船しようとする者は、その旨を港長に届け出なければならない。
Article 8.　A person intending to repair or to moor any vessel other than miscellaneous vessels in a special port shall make a report to the captain of the port to that effect.
２　修繕中又はけい船中の船舶は、特定港内においては、港長の指定する場所に停泊しなければならない。
Within a special port, a vessel under repairs or at her mooring shall anchor in the place as designated by the captain of the port.
３　港長は、危險を防止するため必要があると認めるときは、修繕中又はけい船中の船舶に対し、必要な員数の船員の乘船を命ずることができる。
If the captain of the port deems it necessary, in order to prevent the vessel under repairs or at anchor from being endangered, he may order a proper number of mariners to be on board the vessel.
（けい留等の制限）
(Restriction on Mooring, etc.)
第九條　雜種船及びいかだは、港内においては、みだりにこれをけい船浮標若しくは他の船舶にけい留し、又は他の船舶の交通の妨となる虞のある場所に停泊させ、若しくは停留させてはならない。
Article 9.　Within a port, any miscellaneous vessel or raft shall not, without justifiable reasons, be moored to a mooring buoy, or any other vessel, nor shall it be caused to anchor or stay in such a place as to threaten the safety of navigation of any other vessel.
（移動命令）
(Order concerning Shifting)
第十條　港長は、特に必要があると認めるときは、特定港内に停泊する船舶に対して移動を命ずることができる。
Article 10.　The captain of the port may, when deemed especially necessary, order a vessel at anchor in a special port to change her anchorage.
（停泊の制限）
(Registriction on Anchoring)
第十一條　特定港内における船舶の停泊及び停留を禁止する場所又は停泊の方法について必要な事項は、命令でこれを定める。
Article 11.　Necessary matters concerning the area in a special port wherein anchoring or temporary stay of any vessel is prohibited, or the method of anchoring shall be prescribed by a Ministerial Ordinance.
第三章　航路及び航法
Chapter III. Route and Rules of Sailing
（航路）
(Route)
第十二條　雜種船以外の船舶は、特定港に出入し、又は特定港を通過するには、命令の定める航路（以下單に航路という。）によらなければならない。但し、海難を避けようとする場合その他やむを得ない事由のある場合は、この限りでない。
Article 12.　Any vessel other than miscellaneous vessels shall not enter, clear or pass through a special port, without keeping the route prescribed by a Ministerial Ordinance (hereinafter referred to as the route), except in cases where the said vessel intends to avert a sea disaster or where there exist unavoidable circumstances.
第十三條　船舶は、航路内においては、左の各号の場合を除いては、投びようし、又はえい航している船舶を放してはならない。
Article 13.　Any vessel shall not, except in any of the following cases, anchor or release a vessel towed within a route:
一　海難を避けようとするとき。
1.　In cases where a vessel intends to avert a sea disaster;
二　運轉の自由を失つたとき。
2.　In cases where a vessel has lost the command of the control;
三　人命又は急迫した危險のある船舶の救助に従事するとき。
3.　In cases where a vessel is engaging in rescue of human life or in salving a vessel in impending danger;
四　第三十一條の規定による港長の許可を受けて工事又は作業に従事するとき。
4.　In cases where a vessel is engaging in some constructing work or operation with the permission of the captain of the port us provided for in Article 31.
（航法）
(Sailing)
第十四條　航路外から航路に入り、又は航路から航路外に出ようとする船舶は、航路を航行する他の船舶の進路を避けなければならない。
Article 14.　Any vessel intending to enter from the outside of a route into the inside thereof of from the inside of a route to the outside there of shall keep out of the way of another vessel sailing on the route.
２　船舶は、航路内においては、並列して航行してはならない。
Any vessel shall not sail in parallel with another vessel within a route.
３　船舶は、航路内において、他の船舶と行き会うときは、右側を航行しなければならない。
In narrow routes every vessel shall, when it passes by another vessel, keep to that side of the routes which liss on the standard side of such vessel.
４　船舶は、航路内においては、他の船舶を追い越してはならない。
Any vessel shall not overtake another vessel on a route.
５　命令で一定の特定港につき特別の定をした場合には、前二項の規定を適用しない。
The provisions of the two preceding paragraphs shall not apply in such case as specified by a Ministerial Ordinance in respect of definite special ports.
第十五條　汽船が港の防波堤の入口又は入口附近で他の汽船と出会う虞のあるときは、入航する汽船は、防波堤の外で出航する汽船の進路を避けなければならない。
Article 15.　In cases where steamships, are likely to meet with other steamsphips at or around the entrance to the breakwater of a port, the entering steamship shall keep out of the way of the clearing steamship outside the breakwater.
第十六條　船舶は、港内及び港の境界附近においては、他の船舶に危險を及ばさないような速力で航行しなければならない。
Article 16.　Any vessel shall sail, within or around the boundary of a port, in an appropriate speed and manner so as to entail no danger to other vessels.
２　帆船は、港内では、帆を減じ又は引船を用いて航行しなければならない。
A sailing vessel shall sail, by decreasing the number of sails, or being towed by a tugboat within a port.
第十七條　船舶は、港内においては、防波堤、ふとうその他の工作物の突端又は停泊船舶を右げんに見て航行するときは、できるだけこれに近寄り、左げんに見て航行するときは、できるだけこれに遠ざかつて航行しなければならない。
Article 17.　Within a port, any vessel sighting one end of a breakwater, quay, other structure or mooring vessels on her starboard side shall sail approaching it as near as practicable and any vessel sighting it on her port side shall sail departing from it as far as practicable.
第十八條　雜種船は、港内においては、汽船及び帆船の進路を避けなければならない。
Article 18.　A miscellaneous vessel shall, within a port, keep out of the way of steamship or sailing vessel.
第十九條　前五條に定めるものの外、運輸大臣は、命令で一定の特定港における航法に関して特別の定をすることができる。
Article 19.　The Minister of Transportation may establish the special rules of sailing in definite special ports by a Ministerial Order, in addition to those provided for in the preceding five Articles.
第二十條　この章並びに第十四條第五項及び前條の命令に定めるものの外、港内における航法については、海上衝突予防法（明治二十五年法律第五号）の定めるところによる。
Article 20.　The rules of sailing in a port, other than those stipulated in this Chapter, Article 14, paragraph 5, and the Order mentioned in the preceding Article, shall coincide with those provided for in the Law for the Prevention of Collision at Sea (Law No.5 of 1892).
第四章　危險物
Chapter IV. Dangerous Objects
第二十一條　爆発物その他の危險物（当該船舶の使用に供するものを除く。以下同じ。）を積載した船舶は、特定港に入港しようとするときは、港の境界外で港長の指揮を受けなければならない。
Article 21.　No vessel loaded with explosives, inflammables, or other dangerous objects (except those used by the Vessel concerned. The same shall apply hereinafter), shall enter a special port except by the permission and under the directions of the captain of the port outside the boundary of the port.
２　前項の危險物の種類は、命令でこれを定める。
The definition and restrictions pertaining to explosives and other dangerous objects as provided for in the preceding paragraph shall be specified by a Ministerial Ordinance.
第二十二條　危險物を積載した船舶は、特定港においては、びよう地の指定を受けるべき場合を除いて、港長の指定した場所でなければ停泊し、又は停留してはならない。但し、港長が爆発物以外の危險物を積載した船舶につきその停泊の期間並びに危險物の種類、数量及び保管方法に鑑み差支がないと認めて許可したときは、この限りでない。
Article 22.　Within a special port the movement of vessels referred to in the preceding Article shall be under the control of the captain of the port except in case where the anchorage of a ship shall be designated;provided that the captain of the port has, in view of the duration of anchorage, kind, and quantity of dangerous cargo and the methods of safeguarding, permitted a vessel or vessels to move without formal permission.
第二十三條　船舶は、特定港において危險物の積込、積替又は荷卸をするには、港長の許可を受けなければならない。
Article 23.　Any vessel shall not, in a special port, load, unload or tranship dangerous objects, without the permission of the captain of the port.
２　港長は、前項に規定する作業が特定港内においてされることが不適当であると認めるときは、港の境界外において適当の場所を指定して前項の許可をすることができる。
The captain of the port may, when he deems it improper to do such cargo works in a special port as provided for in the preceding paragraph, give the permission as mentioned in the preceding paragraph, by designating a proper place outside the boundary of the port.
３　前項の規定により指定された場所に停泊し、又は停留する船舶は、これを港の境界内にある船舶とみなす。
Any vessel mooring or temporarily staying at the place designated according to the provisions of the preceding paragraph shall be deemed to be staying in the boundary of a port.
４　船舶は、特定港内又は特定港の境界附近において危險物を運搬しようとするときは、港長の許可を受けなければならない。
Any vessel shall not, without the permission of the captain of the port, transport dangerous objects within or around the boundary of a special port.
第五章　水路の保全
Chapter V. Maintenance of Safety of Route
第二十四條　港内その他日本國の水域における水質の汚濁防止については、別に法律でこれを定める。
Article 24.　The matters concerning the prevention of the harbor and coastal pollution in the Japanese waters shall be datermined by a separate Law.
第二十五條　港内又は港の境界附近において発生した海難に因り他の船舶交通を阻害する状態が生じたときは、当該海難に係る船舶の船長は、遅滯なく標識の設定その他危險予防のため必要な措置をし、且つ、特定港にあつては、その旨を港長に報告しなければならない。
Article 25.　A captain of a vessel in distress within or near the boundaries of a special port shall, without delay, hoist the necessary signal and take such other measures as are necessary to prevent endangering other vessels and shall report the matter as soon as possible to the captain of of the port.
第二十六條　特定港内又は特定港の境界附近における漂流物、沈沒物その他の物件が船舶交通を阻害する虞のあるときは、港長は、当該物件の所有者又は占有者に対しその除去を命ずることができる。
Article 26.　In cases where a flotsam, sunken object or any others object threatens the navigation of vessels within the special port or around the boundary of the special port, the captain of the port may order the owner or the possessor there of to clear away such object.
第六章　船燈及び信号
Chapter VI. Lights and Signal
第二十七條　海上衝突予防法第七條第一項第三号及び第四号に規定する船舶は、夜間航行中それぞれ同項第三号又は第四号に規定する船燈を掲揚しなければならない。
Article 27.　Vessels as provided for in Article 7, paragraph 1, items 3 and 4 of the Law for Prevention of Collisions at Sea shall continually hoist, during the navigation at night, such lights as provided for in item 3 or 4 of the same paragraph respectively.
第二十八條　船舶は、港内においては、みだりに汽笛又は汽角を吹き鳴らしてはならない。
Article 28.　A vessel shall not, without justifiable reasons, blow a whistle or horn within the port.
第二十九條　特定港内において使用すべき私設信号を定めようとする者は、港長の許可を受けなければならない。
Article 29.　Any person who intends to use a signal code other than those provided bylaw within a special port shall apply to the captain of the port for the permission to do so.
第三十條　雜種船以外の船舶で信号符字を有するものは、入港しようとするときは、港の境界附近でこれを掲げなければならない。港を通過しようとするときも同樣である。
Article 30.　Those vessels other than miscellaneous vessels which have signal letters shall not enler a post without hoisting these signal letters around the boundary of the port. This shall also apply to the case where a vessel intends to pass through the port.
２　前項の船舶は、港内を航行するときは、信号符字を掲揚しなければならない。
The vessels as mentioned in the preceding paragraph shall have the signal letters hoisted during the navigation within a port.
第七章　雜則
Chapter VII. Miscellaneous Provisions
（工事等の許可及び進水等の届出）
(Permission for Works, etc. and Report on Launch, etc.)
第三十一條　特定港内又は特定港の境界附近で工事又は作業をしようとする者は、港長の許可を受けなければならない。
Article 31.　Any person intending to perform dredging, salvage, harbour construction or other work that might interfere with or restrict navigation within or near the boundary of a special port, shall obtain the permission of the captain of the port in advance of commencing such works.
２　港長は、前項の許可をするに当り、船舶交通の安全のために必要な措置を命ずることができる。
The captain of the port may, in giving the permission as mentioned in the preceding paragraph, issue an order concerning necessary measures for the safety of the navigation of vessels.
第三十二條　特定港内において端艇競爭その他の行事をしようとする者は、予め港長の許可を受けなければならない。
Article 32.　A person intending to hold a boat-race or give other performance within a special port, shall, in advance, obtain the permission of the captain of the port.
第三十三條　特定港内において船舶を進水させ、又はドックに出入させようとする者は、その旨を港長に届け出なければならない。
Article 33.　A person intending to launch, dock or undock a vessel within a special port shall, in advance, make a report to the captain of the port to that effect.
第三十四條　特定港内において竹木材を船舶から水上に卸そうとする者及び特定港内においていかだをけい留し、又は運行しようとする者は、港長の許可を受けなければならない。
Article 34.　A person intending to unload bamboos or lumber from a vessel down to the water within a special port, or to moor or tow a raft shall obtain the permission of the captain of the port.
２　港長は、前項の許可をするに当り船舶交通安全のために必要な措置を命ずることができる。
The captain of the port may, in giving the permission as mentioned in the preceding paragraph, issue an order concerning necessary measures for the fafety of the navigation of vessels.
（漁ろうの制限）
(Restriction on Fishing)
第三十五條　船舶交通の妨となる虞のある特定港内の場所においては、みだりに漁ろうをしてはならない。
Article 35.　Fishing shall not be performed at such a place as to threaten the safety of the navigation of vessels within a special port.
（燈火の制限）
(Restriction on Light)
第三十六條　何人も、港内又は港の境界附近における船舶交通の妨となる虞のある強力な燈火をみだりに使用してはならない。
Article 36.　Any person shall not use a powerful light which treatens the safety of the navigation of vessels within or around the boundary of a port.
２　港長は、特定港内又は特定港の境界附近における船舶交通の妨となる虞のある強力な燈火を使用している者に対し、その燈火の滅光又は被覆を命ずることができる。
The captain of the port may order a person using ful light which threatens the safety of the navigation of vessels within a special port or around the boundary of a special port to reduce the candle power of the light or to cover the light.
（船舶交通の制限）
(Restriction on Navigation of Vessels)
第三十七條　港長は、船舶交通の安全のため必要があると認めるときは、特定港内において航路又は区域を指定して、船舶の交通を制限し又は禁止することができる。
Article 37.　The captain of the port may, when deemed necessary for the safety of the navigation of vessels, restrict or prohibit the navigation of vessels within a special port, by designating the route or area.
２　前項の規定により指定した航路又は区域及び同項の規定による制限又は禁止の期間は、港長がこれを公示する。
The captain of the port shall give a public notice of the route or area designated according to the provisions of the preceding paragraph and the period of the restriction or prohibition as provided for in the same paragraph.
第八章　罰則
Chapter VIII. Penal Provisions
第三十八條　第二十二條又は第二十三條第一項若しくは第四項の規定に違反したときは、その行爲をした者は、これを六箇月以下の懲役又は五千円以下の罰金に処する。
Article 38.　Those who have violated the provisions of Art.22, Art.23, Paragraph 1 or Paragraph 4 shall be subject to imprisonment with hard labor not exceeding six (6) months or a fine not exceeding 5,000 yen.
第三十九條　左の場合にはその行爲をした者は、これを三箇月以下の懲役又は三千円以下の罰金に処する。
Article 39.　Those who come under any of the following items shall be subject to imprisonment with hard labor not exceeding three (3) months or a fine not exceeding 3,000 yen:
一　第五條第一項の規定に違反したとき。
1.　Those who have violated the provisions of Art.5, Paragraph 1.
二　第五條第二項の規定による指定を受けないで停泊したとき又は同條第四項のびよう地以外の場所に停泊したとき。
2.　Those who have anchored the vessel without being designated as provided for in Article 5, paragraph 2, or who have anchored the vessel at a prace outside of the designated anchorage prescribed in Paragraph 4 of the same Article.
三　第七條第一項、第十二條又は第十三條の規定に違反したとき。
3.　Those who have violated the provisions of Art.7, Paragraph 1, Art.12 or Art.13.
四　第八條第三項、第十條又は第三十七條第一項の規定による処分に違反したとき。
4.　Those who have violated the disposals as are provided for under the provisions of Art.8, Paragraph 3, Art.10 or Article 37, Paragraph 1.
第四十條　第二十五條の規定に違反した者は、これを三箇月以下の懲役又は三千円以下の罰金に処する。
Article 40.　Those who have violated the provision of Article 25 shall be subject to imprisonment with hard labor not exceeding three (3) months or a fine not exceeding 3,000 yen.
第四十一條　左の各号の一に該当する者は、これを三箇月以下の懲役又は三千円以下の罰金に処する。
Article 41.　Those who come under any of the following items shall be subject to imprisonment with hard labor not exceeding three (3) months or a fine not exceeding 3,000 yen:
一　第二十六條、第三十一條第二項又は第三十六條第二項の規定による処分に違反した者
1.　Those who have violated the disposals provided for in Article 26, Article 31, paragraph 2 or Article 36, Paragraph 2.
二　第三十一條第一項の規定に違反した者
2.　Those who have violated the provisions of Article 31, Paragraph 1.
第四十二條　第四條、第六條、第八條第二項、第二十一條、第三十條又は第三十五條の規定に違反したときは、その行爲をした者は、これを千円以下の罰金又は科料に処する。
Article 42.　Those who have violated the provisions of Article 4, Article 6, Article 8, paragraph 2, Article 21, Article 30 or Article 35 shall be subject to a fine or a minor fine not exceeding 1,000 yen.
第四十三條　左の各号の一に該当する者は、これを千円以下の罰金又は科料に処する。
Article 43.　Those who come under any of the following items shall be subject to a fine or a minor fine not exceeding 1,000 yen:
一　第八條第一項、第二十九條、第三十二條、第三十三條又は第三十四條第一項の規定に違反した者
1.　Those who have violated the provisions of Article 8, paragraph 1, Article 29, Article 32, Article 33 or Article 34, Paragraph 1.
二　第三十四條第二項の規定による処分に違反した者

第四十四條　第十一條の規定による命令の規定に違反したときは、その行爲をした者は、これを千円以下の罰金又は拘留若しくは科料にする。
Article 44.　In case any person has violated the provisions of the Ordinance provided for in Art.11, he shall be subject to a fine not exceeding 1,000 yen or detention or minor fives.
第四十五條　法人の代表者又は法人若しくは人の代理人、使用人その他の従業者がその法人又は人の業務に関して第四十一條又は第四十三條の違反をしたときは、行爲者を罰する外、その法人又は人に対しても各本條の罰金を科する。
Article 45.　If the representative of a juridical person, or the agent, employee or any other worker of a juridical or natural person, has come under the penalties specified in Article 41 or 43 in the performance of the business of the juridical or natural person, the juridical or natural person as well as such offender shall be subject to the fine in each Article.
附　則
Supplementary Provisions:
１　この法律施行の期日は、公布の日から六十日を超えない期間内において、政令でこれを定める。
The date of the enforcement of this law shall be fixed by a Cabinet Order within the period not exceeding sixty (60) days following the date of its promulgation.
２　開港港則（明治三十一年勅令第百三十九号）は、これを廃止する。
The Regulations for the Open Ports (Imperial Ordinance No.139 of 1898) shall hereby be abolished.
