National Diet Library Law
國立國会図書館は、眞理がわれらを自由にするという確信に立つて、憲法の誓約する日本の民主化と世界平和とに寄與することを使命として、ここに設立される。
The National Diet Library is hereby established as a result of the firm conviction that truth makes us free and with the subject of contributing to international peace and the democratization of Japan as promised in our Constitution.
第一章　設立及び目的
Chapter I. Establishment and Purposes.
第一條　この法律により國立國会図書館を設立し、この法律を國立國会図書館法と称する。
Article 1.　The National Diet Library is hereby established and this Law shall be shown and cited as the National Diet Library Law.
第二條　國立國会図書館は、図書及びその他の図書館資料を蒐集し、國会議員の職務の遂行に資するとともに、行政及び司法の各部門に対し、更に日本國民に対し、この法律に規定する図書館奉仕を提供することを目的とする。
Article 2.　The National Diet Library shall collect books and other library materials for the purpose of assisting the members of the National Diet in the performance of their duties and also for the purpose of providing certain library services as hereinafter specified for the executive and judicial branches of the National government and for the people of Japan.
第三條　國立國会図書館は、中央の図書館並びにこの法律に規定されている支部図書館及び今後設立される支部図書館で構成する。
Article 3.　The National Diet Library shall consist of a central library and of such branch libraries as are provided for herein or as may hereafter be established.
第二章　館長
Chapter II. Chief Librarian
第四條　國立國会図書館の館長は、一人とする。館長は、両議院の議長が、両議院の図書館運営委員会と協議の後、國会の承認を得て、これを任命する。
Article 4.　The Chief Librarian of the National Diet Library shall be one only in number. He shall be appointed by the Presidents of the Houses with the approval of the Houses on their consultation with the Standing Committees on Library Management of the Houses.
館長は、職務の執行上過失がない限り在職する。館長は、政治活動を愼み、政治的理由により罷免されることはない。館長は、両議院の議長の共同提議によつては罷免されることがある。館長の待遇は、國務大臣と同等とする。
He shall continue in office so long as he performs his duties satisfactorily. He shall refrain from political activities and he shall not be dismissed for political reasons. He may be dismissed by joint action of the Presidents of both Houses. His treatment shall be equal to that of Minister of State.
第五條　館長は、図書館事務を統理し、所属職員及び雇傭人の職務執行を監督する。
Article 5.　The Chief Librarian shall supervise the administration of the Library and direct the officials and employees thereof in the performance of their duties.
館長は、事前に、時宜によつては事後に、両議院の図書館運営委員会の承認を経て図書館管理上必要な諸規程を定める。
He shall make all rules and regulations for the government of the library. Such rules and regulations shall be subject to the approval of the Standing Committees on Library Management meeting in Joint Committee;provided, however, that such rules and regulations shall be effective as promulgated by the Chief Librarian unless specifically disapproved by said Joint Committee.
前項の規程は公示によつて施行される。
The provisions of the preceding paragraph shall be enforced by giving out public notice.
第六條　館長は、毎会計年度の始めに両議院の議長に対し、前会計年度の図書館の経営及び財政状態につき報告する。
Article 6.　The Chief Librarian shall make at the beginning of each fiscal year a report to the Presidents of both Houses on the operations and financial condition of the Library for the previous fiscal year.
第七條　館長は、一年を越えない定期間毎に、前期間中に、日本國内で刊行された出版物の目録又は索引の出版を行うものとする。
Article 7.　The Chief Librarian shall arrange for the publication, at periodic intervals not longer than one year, of a catalogue or index of the publications issued within Japan during the preceding year or period.
第八條　館長は、出版に適する樣式で日本の法律の索引を作るものとする。
Article 8.　The Chief Librarian is authorized to arrange for the preparation, in form suitable for publication, of an index to the laws of Japan.
第三章　副館長並びにその他の職員及び雇傭人
Chapter III. Assistant Chief Librarian and other Officials and Employees
第九條　國立國会図書館の副館長は、一人とする。副館長は、館長が両議院の議長の承認を得て、これを任免する。副館長は、図書館事務につき館長を補佐する。館長に事故があるとき、又は館長が欠けたときは、副館長が館長の職務を行う。副館長の待遇は、各省次官と同等とする。
Article 9.　The Assistant Chief Librarian shall be one only in number. He shall be appointed and dismissed by the Chief Librarian with the approval of the Presidents of both Houses. He shall assist the Chief Librarian in the administration of the Library. When the Chief Librarian is unable to attend to his duties or when his post is vacant, the Assistant Chief Librarian shall perform the duties of Chief Librarian. His treatment shall be not less than that of a Vice-minister of State.
第十條　國立國会図書館のその他の職員及び雇傭人は、職務を行うに適当な者につき、國会職員法の規定により館長が、これを任命する。その職員及び雇傭人の職責は館長が、これを定める。
Artiele 10.　All other officials and employees of the National Diet Library shall be appointed by the Chief Librarian on the sole basis of their qualifications to perform the puties of their respective offices, and in accordance with the provisions of the Diet Secretariat Personnel Law. The Chief Librarian shall prescribe the duties of such officials and employees.
図書館の職員は、國会議員と兼ねることができない。又、行政若しくは司法の各部門の地位を兼ねることができない。但し、行政又は司法の各部門の支部図書館の館員となることは、これを妨げない。
No officials of the[Library shall be, concurrently, members of the Diet, nor shall they held other posts in executive or judicial branch of the national government, provided, however, that such posts in government branch libraries of executive or judicial branch are not included.
第四章　図書館運営委員会及び國立國会図書館連絡調整委員会
Chapter IV. The Standing Committees on Library Management and the Coordinating Committee on the National Diet Library
第十一條　両議院の図書館運営委員会は、少くとも六箇月に一回以上これを開会し、図書館の経過に関する館長の報告、図書館の管理上館長の定める諸規程、図書館の予算及びその他の事務につき審査する。
Article 11.　The Standing Committees on Library Management of both Houses shall meet in Joint Committee not less frequently than once in every six months to consider reports from the Chief Librarian on the progress of the Library, the rules and regulations made by the Chief Librarian for the government of the Library, the budget of the Library, and of other business relating to the Library.
各議院の図書館運営委員長は前項の審査の結果をその院に報告する。
The Committee shall report thereon to the Houses.
第十二條　國立國会図書館に連絡調整委員会を設ける。この委員会は、四人の委員でこれを組織し、各議院の図書館運営委員長、最高裁判所長官の任命する最高裁判所裁判官一人及び内閣総理大臣が任命する國務大臣一人をこれに充てる。委員長は委員の互選とする。
Article 12.　There is hereby established a Coordinating Committee on the National Diet Library. This Committee shall consist of four members who shall be the Chairman of the Standing Committees on Library Management of the two Houses, a Judge of the Supreme Court appointed by the Chief Justice, and Minister of State appointed by the Prime Minister. They shall elect their own Chairman.
委員長及び委員は、その職務につき報酬を受けない。
The Chairman and members shall serve without additional compensation.
館長は、委員会に出席できるが、表決に加わることができない。
The Chief Librarian may attend meetings of the Committee, but shall have no vote in its proceedings.
第十三條　連絡調整委員会は、両議院の図書館運営委員会に対し、國会並びに行政及び司法の各部門に対する國立國会図書館の奉仕の改善につき勧告する。
Article 13.　The Coordinating Committee shall make recommendations to the Standing Committees on Library Management of both Houses for the improvement of the services of the National Diet Library to the Diet and the executive and judicial branches of the government.
第五章　図書館の部局
Chapter V. Departments of the Library
第十四條　館長は、管理事務を効率化するに必要とする部局及びその他の單位を図書館に設ける。
Article 14.　The Chief Librarian shall organize the Library into such departments, divisions and other units as are neccessary for its efficient administration.
第六章　調査及び立法考査局
Chapter VI. Research and Legislative Reference Department
第十五條　館長は、國立國会図書館内に調査及び立法考査局と名附ける一局を置く。この局の職務は、左の通りである。
Article 15.　The Chief Librarian shall establish within the National Diet Library a department to be known as the Research and Legislative Reference Department. The functions of this department shall be as follows:
一　要求に應じ、両議院の委員会に懸案中の法案又は内閣から國会に送付せられた案件を、分析又は評價して、両議院の委員会に進言し補佐するとともに、妥当な決定のための根拠を提供して援助すること。
(1)　Upon request, to advise and assist any committee of the Diet in the analysis, appraisal or evaluation of, legislation pending before it, or of proposals submitted to the Diet by the Cabinet, and otherwise to assist in furnishing a basis for the proper determination of measures before the committee.
二　要求に應じ、又は要求を予測して自発的に、立法資料又はその関連資料の蒐集、分類、分析、飜訳、索引、摘録、編集、報告及びその他の準備をし、その資料の選択又は提出には党派的、官僚的偏見に捉われることなく、両議院、委員会及び議員に役立ち得る資料を提供すること。
(2)　Upon request, or upon its own initiative in anticipation of requests, to gather, classify, analyze and make available in translations, indexes, digests, compilations, bulletins and otherwise, data for or bearing upon legislation, and to render such data serviceable to the Diet and to the committees and members thereof, without partisan or bureaucratic basis in selection or presentation.
三　立法の準備に際し、両議院、委員会及び議員を補佐して、議案起草の奉仕を提供すること。但し、この補佐は委員会又は議員の要求ある場合に限つて提供され、調査及び立法考査局職員はいかなる場合にも立法の発議又は督促をしてはならない。
(3)　To provide a bill-drafting service for the assistance of the Diet, its committees and members in the preparation of legislation, provided, however, that this assistance shall be supplied only upon request of a committee or a member of the Diet, and that the staff of the Research and Legislative Reference Department shall in no case initiate or urge legislation.
四　両議院、委員会及び議員の必要が妨げられない範囲において行政及び司法の各部門又は一般公衆に蒐集資料を提供して利用させること。
(4)　To make the information which it gathers available to other branches of the national government or to the public to the extent that the needs of the Diet and of its committees and members permit this to be done.
第十六條　この局に必要な局長、次長及びその他の職員は、政党に加入していても加入していなくても、その職務を行うに適当な者につき、國会職員法の規定により館長がこれを任命する。
Article 16.　The Chief Librarian shall appoint a director, assistant director and all other personnel necessary for this Department without reference to political affiliations and solely on the ground of fitness to perform the duties of their office and in accordance with the provisions of the Diet Secretariat Personnel Law.
館長は、更にこの局の職員に、両議院の常任委員会の必要とする廣汎な関連分野に專門調査員を任命することができる。この專門調査員の待遇は、行政及び司法の各部門の一級官吏と同等とする。
The Chief Librarian is further authorized to appoint to the staff of this Department senior specialists in the broad fields of interest which coincide with the fields of interest of the several Standing Committees of the Diet, provided, however, that the treatment of the specialists shall be equal with that of the First Class officials of the national government.
第七章　行政及び司法の各部門への奉仕
Chapter VII. Services to the Executive and Judicial Branches of the Government
第十七條　館長は、行政及び司法の各部門に図書館奉仕の連繋をしなければならない。この目的のために館長は左の権能を有する。
Article 17.　The Chief Librarian shall be responsible for the coordination of the library service to all branches of the national government. To this end he shall:
一　行政及び司法の各部門の図書館長を、これらの部門を各代表する連絡調整委員会の委員の推薦によつて任命する。但し、國家公務員法の適用を受ける者については、同法の規定に從い、且つ、当該部門の長官の同意を得なければならない。
(1)　Appoint the librarians of the agencies of the judicial and executive branches of the Government upon the recommendation of the members of the Coordinating Committee who respectively represent these branches. However, the appointment from among the persons who are governed by the National Public Service Law shall be made in accordance with the provisions of the same law, and with the consent of the chief of the agency concerned.
二　行政及び司法の各部門の図書館で使用に供するため、目録法、図書館相互間の貸出及び資料の交換、綜合目録及び綜合一覽表の作成等を含む図書館運営の方法及び制度を定めることができる。これによつて國の図書館資料を行政及び司法の各部門のいかなる職員にも利用できるようにする。
(2)　Have authority to prescribe, for the use of the libraries of the agencies of the several branches of the national government, methods and systems of library management, including, for example, methods relating to cataloging, inter-library loans and inter-changeability of collections, union catalogues and union lists;with a view to making;the government library resources of the whole government available for the use of any official of any branch of the national government.
三　行政及び司法の各部門の図書館長に年報又は特報の提出を要求することができる。
(3)　Have authority to require annual or special reports from the librarians of the several agencies of any branch of the national government.
第十八條　行政及び司法の各部門に在る図書館の予算は当該各部門の予算の中に「図書館」の費用の下に、明白に区分して計上する。この費目の経費は、行政及び司法の各部門を各々代表する連絡調整委員会の委員及び館長の承認を得なければ他の費目に流用し又は減額することができない。
Article 18.　The budget for each library of the several agencies of the government shall be included as a distinct item under the title "library" in the budget of the agency concerned, and appropriations made thereunder shall not be transferable to any other item in the budget of the agency nor be reduced without the approval of the member of the Coordinating Committee representing that branch of the national government and the Chief Librarian.
第十九條　行政及び司法の各部門の図書館長は、当該各部門に充分な図書館奉仕を提供しなければならない。当該各図書館長は、その職員を、國会職員法又は國家公務員法若しくは裁判所法の規定により任免することができる。当該各図書館長は、國立國会図書館長の定める規程に從い、図書及びその他の図書館資料を購入その他の方法による受入方を当該各部門の長官若しくは館長に勧告し、又は直接に購入若しくは受入をすることができる。
Article 19.　The librarian of each agency of any branch of the national government shall be responsible for satisfactory library service to his agency. He shall have authority to appoint and dismiss the members of his staff subject to the provisions of the Diet Secretariat Personnel Law or of the National Public Service Law, or of the Court of Justice Law as the case may be. He shall have authority, under regulations to be made by the Chief Librarian, to recommend the purchase or acquisition by other means of books and other library materials to the chief of respective branches of the national government as well as the Chief Librarian, or to make such purchases or other acquisitions directly.
第二十條　館長が最初に任命された後六箇月以内に行政及び司法の各部門に現存するすべての図書館は、本章の規定による國立國会図書館の支部図書館となる。なお、現に図書館を有しない各廳においては一箇年以内に支部図書館を設置するものとする。
Article 20.　Not later than six months after the first appointment to the post of Chief Librarian, all existing libraries of the executive and judicial branches of the government shall become branches of the National Diet Library under the provisions of this Chapter. The Ministries of the National government which have no existing libraries shall establish the library within not later than one year.
第八章　その他の図書館及び一般公衆に対する奉仕
Chapter VIII. Services to Other Libraries and to the Public
第二十一條　國立國会図書館の奉仕及び蒐集資料は、直接に又は公立その他の図書館を経由して、両議院、委員会及び議員並びに行政及び司法の各部門からの要求を妨げない限り、日本國民にこれを最大限に利用させる。この目的のために、館長は左の権能を有する。
Article 21.　The services and collections of the National Diet Library shall be available to the people of Japan either directly or through prefectural or other libraries to the fullest extent consistent with the requirement of the Diet, its committees and members and of the other branches of the government. To this and the Chief Librarian is authorized as follows:
一　館長の定める諸規程に從い、図書館の蒐集資料を國立國会図書館建物内で若しくは図書館相互間の貸出で、又は複写若しくは陳列によつて、一般公衆の使用並びに研究の用に供する。且つ、時宜に應じて図書館奉仕の改善上必要と認めるその他の奉仕を提供する。
(1)　To make the collections of the Library available for public use and study either in the National Diet Library Building, or by interlibrary loan, or through copying services or by exhibition, under rules and regulations to be made by him;and to provide such other services as he may, according to circumstances, find to be necessary for the improvement of the library services of Japan.
二　あらゆる適切な方法により、図書館の組織及び図書館奉仕の改善につき、都道府縣の議会その他の地方議会、公務員又は図書館人を援助する。
(2)　To assist, by every appropriate means, prefectural and other local assemblies, government officials and librarians in the organization of libraries and in the development of library services.
三　國立國会図書館で印刷した目録票又はその他の出版物を他の図書館及び個人が購入しようとする際には、館長の定める價格でこれを賣り渡す。
(3)　To make available, to other libraries and individuals desiring to purchase them, copies of the printed catalogue cards and other publications of the library, and to charge the same prices as to be determined by the Chief Librarian.
四　日本の図書館資料資源に関する綜合目録、並びに全國の図書館資料資源の連繋ある使用を実現するために必要な他の目録及び一覽表の作成のために、あらゆる方策を講ずる。
(4)　To take measures toward the establishment of a union catalogue of the library resources of Japan and of such other catalogue and lists an may be necessary to effect coordinated usefulness of the library resources of the country.
第二十二條　上野公園の國立図書館は、昭和二十四年四月一日までに、國立國会図書館の支部図書館となり、特に東京都民の用に供するよう有効に運用される。この図書館はできる限り速かに、東京都に移管し、移管前に制定される法律及び諸規程に從つて運用される。
Article 22.　Effective not later than April 1, 1949, the National Library at Ueno Park shall be operated as a branch of the National Diet Library, especially for the benefit of the citizens of Tokyo. As soon as praticable thereafter, this Library shall be transferred to Tokyo Metoroplis to be operated under such laws and regulations as may be enacted prior to the date of transfer.
第九章　蒐集資料
Chapter IX. Collections
第二十三條　館長は、國立國会図書館の蒐集資料として図書及びその他の図書館資料を購入、納本、寄贈、遺贈若しくは交換によつて、又は行政及び司法の各部門からの移管によつて受入することができる。行政及び司法の各部門の長官は、その部門においては必ずしも必要としないが、館長が國会図書館においての使用には充て得ると認める図書及びその他の図書館資料を國立國会図書館に移管することができる。館長は、國立國会図書館では必ずしも必要としない図書及びその他の図書館資料を、行政若しくは司法の各部門に移管し、又は交換用に利用し、若しくは処分することができる。
Araticle 23.　The Chief Librarian is authorized to acquire, for the collections of the National Diet Library, books and other library materials by purchase, deposit, gift, bequest and exchange, or by transfer from other agencies of the government. The heads of all agencies of the government are authorized to transfer to the National Diet Library books and other library materials not needed for their use but in the judgement of the Chief Librarian appropriate to the uses of the National Diet Library. The Chief Librarian is authorized to transfer to the uses of the National Diet Library. The Chief Librarian is authorized to transfer to other governmental agencies books and materials in exchange or otherwise to dispose of them.
第十章　國の出版物の納入
Chapter X. Deposit of Governmental Publications
第二十四條　國の諸機関により又は國の諸機関のため、図書、小册子、定期刊行物、地図、映画その他のものを、印刷又は複写により、五百部以上発行する場合には、（機密扱のもの及び書式用紙を除く）公用のため並びに外國政府出版物との國際的交換の用又はその他の國際的交換の用に供するために、直ちに國立國会図書館に五十部を納入させるものとする。五百部未満のものを発行する場合には、館長の定める規程によつて五十部未満の部数を國立國会図書館に納入させるものとする。
Article 24.　Of each book, pamphlet, periodical, map, motion picture or other work, printed or otherwise reproduced by or for any agency of the government in an edition of five hundred (500) copies or more (except confidential matter and blank forms), fifty (50) copies shall be furnished immediately to the National Diet Library for its Official use in Tokyo and for its use in international exchange for the publications of other governments and in other international exchanges. Of such works reproduced in editions of less than five hundred (500) copies, a number of copies less than fifty (50) shall be furnished to the National Diet Library in accordance with regulations to be made by the Chief Librarian.
第十一章　その他の出版物の納本
Chapter XI. Deposit of Other Publications
第二十五條　前條の規定による以外の出版物については、その発行者から一部を國立國会図書館に納本させて、その代償として定期に作成する全日本出版物の目録で、当該出版物を登載した分を館長は、遅滯なく納本者に送付する。
Article 25.　The Chief Librarian shall have a copy of each current publication other than those of Article 24 in the National Diet Library from its publisher, to whom he shall gives for his compensation, a part of the national publication catalogue to be issued at periodical intervals, in which above publication is recorded.
第十二章　金銭の受入及び支出並びに予算
Chapter XII. Gifts of Money-Disbursements-Budget
第二十六條　館長は、國立國会図書館に関し、その奉仕又は蒐集資料に関連し、直ちに支拂に供し得る金銭の寄贈を受けることができる。
Article 26.　The Chief Librarian shall have authority to accept gifts of money for immediate disburesement in connection with the National Diet Library, its services or collections, subject in each case to the approval of the Standing Committees on Library Management of the Houses meeting as a Joint Committee.
この場合には両議院の図書館運営委員会の承認を得なければならない。
第二十七條　國立國会図書館に充当されているあらゆる経費は、館長の監督の下に、その任命した支出官によつて支出される。
Article 27.　All appropriations made to the National Diet Library shall be disbursed under the supervision of the Chief Librarian by a disbursing officer to be appointed by him.
第二十八條　國立國会図書館の予算は、館長がこれを調製し、両議院の図書館運営委員会に提出する。委員会はこの予算を審査して勧告を附し、又は勧告を附さないで、両議院の議長に送付する。
Article 28.　The annual budget of the National Diet Library shall be prepared by the Chief Librarian and shall be transmitted by him to the Standing Committees on Library Management of the Houses. Said budget shall be transmitted to the Presidents of the Houses, with or without the recommandations of the joint Committee.
附　則
Supplementary Provisions:
第二十九條　この法律は、公布の日から、これを施行する。
Article 29.　This Law shall come into force as from the day of its promulgation.
昭和二十二年法律第八十四号國会図書館法は、これを廃止する。
Law No.84 of 1947 concerning its Diet Library shall be abolished.
第三十條　この法律施行の日に、両議院の図書館は各々分離した図書館としての存在を終止し、その蒐集資料は、國立國会図書館に移管される。
Article 30.　Upon the effective date of this law the Library of the House of Representatives and the Library of the House of Councillors shall cease to exist as separate Library, and their collections shall be transferred to the National Diet Library.
第三十一條　國立國会図書館の各種の地位への任命に完全な有資格者が得られない場合には、館長は、二年を越えない期間内で、臨時にその職員を任命することができる。その期間終了の際、その地位に優れた有資格者が得られるならば、その臨時の任命は更新せられないものとする。
Article 31.　When fully qualified persons are not available for appointment to positions, the Chief Librarian shall make temporary appointments within the period not exceeding two years duration;and no such appointment shall be renewed if at its termination a better qualified person is available for the position.
