平和条約の発効が近づく中、日本政府は在外公館の早期設置の必要性を認識し、平和関係回復が見込まれる諸外国と協議を重ねた結果、昭和27年度に設置予定の在外公館についての見通しが立ったため、本法案を提出することとした。法案では大使館21、公使館18、総領事館11、領事館6の計56の在外公館を規定している。ただし、これらは平和条約発効と同時に一斉に設置されるものではなく、相手国との関係回復と合意に応じて順次設置される。また、館長や館員については、隣接国の在外公館との兼任も想定されている。平和条約発効時には批准済みの6カ国への設置が先行し、その他は政令で随時設置を進める方針である。
