第一章　総則
Chapter I General Provisions
（この法律の目的）
(Purpose of this Law)
第一條　この法律は、特別調達廳の事務の範囲及び権限を明確に定めるとともに、その所掌する行政事務を能率的に遂行するに足る組織を定めることを目的とする。
Article 1.　The purpose of this Law is to define clearly the scope of responsibilities and the powers of the Special Procurement Agency and to provide an organization fit for the efficient conduct of the administrative affairs and enterprises under the jurisdiction of the Agency.
（設置）
(Establishment)
第二條　國家行政組織法（昭和二十三年法律第百二十号）第三條第二項の規定に基いて、総理府の外局として、特別調達廳を設置する。
Article 2.　The Special Procurement Agency shall be established under the provisions of Article 3 paragraph 2 of the National Government Organization Law (Law No.120 of 1948) as an external organ of the Prime Minister's Office.
２　特別調達廳の長は、特別調達廳長官とする。
2　The Special Procurement Agency shall be headed by the Director of the Special Procurement Agency.
（任務）
(Mission of the Special Procurement Agency)
第三條　特別調達廳は、左の事務を行うことを主たる任務とする。
Article 3.　The Special Procurement Agency shall be responsible chiefly for the administration of the following affairs:
一　連合國の需要する建造物及び設備の営繕並びに物及び役務の調達。但し、他の行政機関の所掌に属するものを除く。
(1)　Construction and repair of buildings and equipment and procurement of goods and services required by the Occupation Forces excepting those under the jurisdiction of other administrative organs;
二　連合國の需要を解除された建造物、設備及び物の保管、返還及び処分。但し、他の行政機関の所掌に属するものを除く。
(2)　Custody, restitution to their original owners, and disposition of buildings, equipment and goods released from the demands of the Occupation Forces excepting those under the jurisdiction of other administrative organs;
三　連合國占領軍の特に指示する事務
(3)　Affairs specially designated by the Occupation Forces of the Allied Powers.
２　前項第三号の指示があつた場合においては、内閣総理大臣は、その旨告示するものとする。
2　When the designation of affairs stated in item 3 of the preceding paragraph is made, the Prime Minister shall issue a notification to that effect.
（権限）
(Powers of the Agency)
第四條　特別調達廳は、その所掌事務を遂行するため、左の権限を行使する。
Article 4.　For the purpose of carrying out the responsibilities provided for in this Law, the Special Procurement Agency shall have the powers as listed below:
一　予算の範囲内で、所掌事務の遂行に必要な支出負担行爲をすること。
(1)　To make, within the limits of budgetary appropriations, acts to incur disbursement necessary for the carrying out of its responsibilities;
二　收入金を徴收し、所掌事務の遂行に必要な支拂をすること。
(2)　To collect revenues and make expenditures necessary for the carrying out of its responsibilities;
三　所掌事務遂行に直接必要な事務所等の施設を設置し、これを管理すること。
(3)　To establish and control offices directly required for the carrying out of its responsibilities;
四　所掌事務遂行に直接必要な業務資材、事務用品、研究用資材等を調達すること。
(4)　To procure materials for use in enterprises, office supplies, and other research materials which are directly required for the carrying out of its responsibilities;
五　不用財産を処分すること。
(5)　To dispose of unnecessary properties;
六　職員の任免及び賞罰を行い、その他職員の人事を管理すること。
(6)　To administer personnel affairs, including appointment, dismissal, awards and discipline:
七　職員の厚生及び保健のため必要な施設をし、これを管理すること。
(7)　To establish and control facilities required for the welfare and health of personnel;
八　職員に貸與する宿舍を設置し、これを管理すること。
(8)　To establish and maintain housing to be rented to personnel;
九　所掌事務に関する統計及び調査資料を頒布し、又は刊行すること。
(9)　To distribute or publish statistics and research data concerning the affairs under its jurisdiction;
十　所掌事務の監察を行い、法令の定めるところに從い、必要な措置をとること。
(10)　To inspect the affairs under its jurisdiction and to take such measures as may be required in accordance with the provisions of laws and orders;
十一　所掌事務の周知宣傳を行うこと。
(11)　To disseminate information to the public concerning the affairs under its jurisdiction;
十二　特別調達廳の公印を制定すること。
(12)　To adopt the official seals of the Special Procurement Agency.
第二章　内部部局
Chapter II Internal Subdivisions
（内部部局）
(Internal Subdivisions)
第五條　特別調達廳に、長官官房及び左の五部を置く。
Article 5.　The Special Procurement Agency shall have the Director's Secretariat and the following five Divisions:

(Special Positions)
第六條　特別調達廳に次長一人を置く。
Article 6.　The Special Procurement Agency shall have a Deputy Director.
２　次長は、長官を助け、廳務を整理する。
2　The Deputy Director shall assist the Director and regulate the affairs of the Special Procurement Agency.
３　特別調達廳に顧問二人を置く。
3　The Special Procurement Agency shall have two Advisors.
４　顧問は、重要な廳務に参画する。
4　The Advisors shall participate in the planning of important affairs of the Special Procurement Agency.
５　長官官房に官房長一人を置く。
5　The Director's Secretariat shall be headed by Chief of Secretariat.
６　官房長は、命を受けて長官官房の事務を掌理する。
6　The Chief of Secretariat shall administer, under orders, the affairs of the Director's Secretariat.
７　各部に左の通り、次長を置く。
7　Each Division shall have a Deputy Chief or Deputy Chiefs as follows:

８　次長は、部長を助け、部務を整理する。
8　The Deputy Chief of Division shall assist the Chief of Division and regulate the affairs of the Division.
（長官官房）
(Director's Secretariat)
第七條　長官官房においては、左の事務をつかさどる。
Article 7.　The Director's Secretariat saall administer the following affairs:
一　機密に関すること。
(1)　Confidential matters;
二　職員の職階、任免、分限、懲戒、服務その他の人事並びに教養及び訓練に関すること。
(2)　Classification, appointment and dismissal of personnel, their status, disciplinary punishment, performance of duty and other personnel affairs, as well as their refinement and training;
三　長官の官印及び廳印を管守すること。
(3)　Custody of the Director's and the Agency's official seals;
四　公文書類を接受、発送、編集、及び保存すること。
(4)　Receipt, despatch, compilation and custody of official documents;
五　特別調達廳の常用の経費（以下「廳費」という。）及びこれに伴う收入の予算、決算及び会計並びに会計の監査に関すること。
(5)　Budget estimates for the current expenditures (hereinafter referred to as "overhead expenditure" ) and revenues of the Special Procurement Agency, settlement of accounts, accounts and account audit;
六　行政財産及び物品を管理すること。但し、他部の所掌に属するものを除く。
(6)　Control over administrative properties and goods, excepting those under the jurisdiction of other Divisions;
七　職員の衞生、医療その他福利厚生に関すること。
(7)　Health, medical treatment and other welfare measures for personnel;
八　特別調達廳の組織及び運営に関すること。
(8)　Organization and operation of the Special Procurement Agency;
九　法令の立案その他特別調達廳の所掌事務に関し、一般的企画をし、及び各部の事務を調整すること。
(9)　Drafting of laws and orders, making of general recommendations regarding the responsibilities of the Special Procurement Agency and the coordination of responsibilities of other Divisions;
十　文書を審査すること。
(10)　Review of documents;
十一　渉外事務を行うこと。
(11)　Liaison with the Allied Authorities;
十二　こう報に関すること。
(12)　Dissemination of information;
十三　行政の考査を行うこと。
(13)　Administrative inspections;
十四　調査及び統計に関すること。
(14)　Surveys and statistics;
十五　前各号に掲げるものの外、特別調達廳の所掌事務で各部の所掌に属さないものを行うこと。
(15)　In addition to the affairs listed in each of the preceding items, such responsibilities of the Special Procurement Agency as are not in the charge of other Divisions.
（経理部）
(Fiscal Division)
第八條　経理部においては、特別調達廳の所掌事務遂行に必要な廳費以外の経費（以下「事業費」という。）及びこれに伴う收入の予算、決算及び会計並びに会計の監査に関することをつかさどる。
Article 8.　The Fiscal Division shall take the charge of the budget estimates for those expenditures other than overhead expenditures which are required for the carrying out of the responsibilities of the Special Procurement Agency (hereinafter referred to as "operations expenditures" ) and revenues corresponding thereto, settlement of accounts, accounts and account audit.
（契約部）
(Purchasing and Contracting Division)
第九條　契約部においては、左の事務をつかさどる。
Article 9.　The Purchasing and Contracting Division shall administer the following affairs:
一　事業費による建造物及び設備の営繕の契約を締結すること。
(1)　Conclusion of contracts for the construction and repair of buildings and equipment to be paid from the operations expenditures;
二　事業費による需品（不動産及びこれに附属する動産以外の物をいう。以下同じ。）の調達の契約を締結すること。
(2)　Conclusion of contracts for the procurement of supplies (meaning all goods other than real properties and movable properties attached thereto) to be paid from the operations expenditures;
三　事業費による役務の調達の契約を締結すること。
(3)　Conclusion of contracts for services to be paid from the operations expenditures;
四　事業費による不動産及び之に附属する動産の調達並びにこれらの物の返還に伴う契約及び補償に関すること。
(4)　Contracts and compensation for the procurement of real properties and movable properties attached thereto to be paid from the operations expenditures, as well as for the restitution thereof;
五　連合國の需要を解除された需品の処分の契約を締結すること。
(5)　Conclusion of contracts for the disposition of supplies released from the demands of the Occupation Forces.
（技術部）
(Engineering and Price Analysis Division)
第十條　技術部においては、左の事務をつかさどる。
Article 10.　The Engineering and Price Analysis Division shall administer the following affairs:
一　需品、工事及び役務に要する資材の需給に関すること。
(1)　Furnishing of supplies and materials required for construction work and services;
二　需品の設計図及び仕樣書に関すること。
(2)　Plans and specifications for supplies;
三　需品に要する材料、労務及び諸役務並びに費用を積算すること。
(3)　Estimation of materials, labor, services and expenses required for the manufacture of supplies;
四　需品の試驗、研究及び見本の審査を行うこと。
(4)　Examination and research regarding supplies and inspection of samples or pilot models of supplies;
五　工事及び役務の設計図及び仕樣書に関すること。
(5)　Plans and specifications for construction and services;
六　工事及び役務に要する材料、労務及び諸役務並びに費用を積算すること。
(6)　Estimation of materials, labor, services and expenses required for construction work and services;
七　不動産及びこれに附属する動産の調達及び返還に伴う評價に関すること。
(7)　Appraisal of the value of real properties and movable properties attached thereto incidental upon the procurement and restitution of such properties.
（促進監督部）
(Production and Inspecting Division)
第十一條　促進監督部においては、左の事務をつかさどる。
Article 11.　The Production and Inspecting Division shall administer the following affairs:
一　工事の実施及び役務の提供を促進監督すること。
(1)　Expediting and inspecting the execution of the construction work and supply of services;
二　需品の生産及び納入を促進すること。
(2)　Expediting of the manufacture and delivery of supplies;
三　工事の実施、役務の提供並びに需品の生産及び納入の実績を考査すること。
(3)　Consideration of the actual results of the execution of construction work, the performance of services and the manufacture and delivery of supplies;
四　契約に関する補償の請求その他の苦情の申出を受理し、その解決を図ること。
(4)　Receipt and settlement of complaints such as demands for compensation regarding contracts;
五　資材及び需品の輸送計画を樹立し、輸送を促進すること。
(5)　Establishment of plans for and expediting of the transportation of materials and supplies;
六　不動産の記録に関すること。
(6)　Records of real properties.
（事業部）
(Operation Division)
第十二條　事業部においては、左の事務をつかさどる。
Article 12.　The Operation Division shall administer the following affairs:
一　需品の管理、出納及び輸送に関すること。
(1)　Control, warehousing, shipment and transportation of supplies;
二　連合國の要求する労務者に関すること。
(2)　Employment of laborers required by the Occupation Forces.
第三章　地方支分部局
Chapter III Local Branch Offices
（特別調達局）
(Special Procurement Bureaus)
第十三條　特別調達廳の地方支分部局として、特別調達局を置く。
Article 13.　The Special Procurement Bureaus shall be established as local branch offices of the Special Procurement Agency.
（所掌事務）
(Responsibilities of the Special Procurement Bureaus)
第十四條　特別調達局は、特別調達廳の所掌事務を分掌する。
Article 14.　The Special Procurement Bureaus shall take charge of a part of the responsibilities of the Special Procurement Agency.
（名称、位置及び管轄区域）
(Names of the Special Procurement Bureaus, their locations and areas of jurisdiction)
第十五條　特別調達局の名称及び位置は、左の通りとし、その管轄区域は、各特別調達局に対應する連合國占領軍の管轄区域によることを例とする。
Article 15.　The names of the Special Procurement Bureaus and their locations shall be as listed below, and their area of jurisdiction shall, as a rule, conform to those of the Occupation Forces of Allied Powers corresponding to the respective Special Procurement Bureaus:

第十六條　特別調達局に、左の四部を置く。
Article 16.　The Special Procurement Bureau shall have the following four Divisions:

２　前項に定めるものの外、特別調達局の組織の細目は、総理府令で定める。
2　Particulars as to the organization of the Special Procurement Bureau other than those prescribed in the preceding paragraph shall be determined by Prime Minister's Office Ordinances.
附　則
Supplementary Provisions:
１　この法律は、昭和二十四年六月一日から施行する。
1　This Law shall come into force as from June 1, 1949.
２　特別調達廳法（昭和二十二年法律第七十八号。以下「旧法」という。）及び特別調達廳法施行令（昭和二十二年政令第六十六号。）は、廃止する。但し、法律（法律に基く命令を含む。）に別段の定めがある場合を除く外、從前の機関並びに役員及び職員は、この法律に基く相当の機関及び職員となるものとする。
2　The Special Procurement Board Law (Law No.78 of 1947;hereinafter referred to as "Old Law" ) and the Enforcement Ordinance for the Special Procurement Board Law (Cabinet Ordinance No.66 of 1947) shall be abolished. However, unless otherwise prescribed by laws (including orders issued thereunder), the organs existing heretofore and officers and personnel thereof shall become the corresponding organs and personnel under this Law and shall retain their respective identities.
３　前項但書の規定は、職員の定員に関する法律の適用に影響を及ぼすものではない。
3　The provisions of the proviso to the preceding paragraph shall not effect the application of the provisions of the law concerning the fixed number of personnel.
４　旧法による特別調達廳の法人格は、この法律施行の日に消滅する。
4　The juridical personality of the Special Procurement Board tinder the Old Law shall terminate on the day of the enforcement of this Law.
５　この法律施行の日において特別調達廳の有する権利義務は、同日において、國が承継する。
5　The rights enjoyed and the obligations owed by the Special Procurement Board on the day of the enforcement of this Law shall be succeeded to by the State on that same day.
６　第十六條の規定にかかわらず、当分の間、特別調達局の内部部局として管材部を置くことが出來る。
6　In spite of the provisions of Article 16, the Special Procurement Bureau may, for the time being, have the Warehousing Division.
７　内閣総理大臣は、特別調達廳又は特別調達局の所掌事務の一部を分掌させるため、当分の間、所要の地に特別調達廳又は特別調達局の連絡事務所を設置することができる。その名称、位置、管轄区域、所掌事務の範囲及び内部組織は総理府令で定める。
7　The Prime Minister may temporarily establish Liaison Offices of the Special Procurement Agency or the Special Procurement Bureaus at necessary places for the purpose of administering a portion of the affairs of the Special Procurement Agency or the Special Procurement Bureaus. The names of such Liaison Offices, their locations and areas of jurisdiction, the scope of their responsibilities, and their internal subdivisions shall be determined by Prime Minister's Office Ordinances.
