提案理由 (AIによる要約)

日本学術会議法
The Science Council of Japan Law
日本学術会議は、科学が文化國家の基礎であるという確信に立つて、科学者の総意の下に、わが國の平和的復興、人類社会の福祉に貢献し、世界の学界と提携して学術の進歩に寄與することを使命とし、ここに設立される。
The Science Council of Japan shall hereby be established, on the conviction that science provides the basis of a cultural country and with a view to fulfilling its mission of contributing by the joint will of the scientists throughout Japan to the peaceful rehabilitation of this country and promotion of the welfare of human society as well as to the advancement of science of the world, in co-operative relations with academic societies of foreign countries.
第一章　設立及び目的
Chapter I. Establishment and Aim
第一條　この法律により日本学術会議を設立し、この法律を日本学術会議法と称する。
Article 1.　The Science Council of Japan shall be established by this Law which shall be called the Science Council of Japan Law.
２　日本学術会議は、内閣総理大臣の所轄とする。
2.　All transactions of the Science Council of Japan with the Government shall be through the Prime Minister.
３　日本学術会議に関する経費は、國庫の負担とする。
3.　Expenditure on the Science Council of Japan shall be defrayed from the National Treasury.
第二條　日本学術会議は、わが國の科学者の内外に対する代表機関として、科学の向上発達を図り、行政、産業及び國民生活に科学を反映浸透させることを目的とする。
Article 2.　The Science Council of Japan shall aim at promoting the development of science and permeate it into administration, industry and nation's life as the representative organ, internal and international, of the scientists of this country.
第二章　職務及び権限
Chapter II. Functions and Powers
第三條　日本学術会議は、独立して左の職務を行う。
Article 3.　The Science Council of Japan shall perform the following independently:
一　科学に関する重要事項を審議し、その実現を図ること。
1)　To discuss important matters concerning science, and to make exertion for the realization thereof;
二　科学に関する研究の連絡を図り、その能率を向上させること。
2)　To co-ordinate scientific researches for the enhancement of their efficiency.
第四條　政府は、左の事項について、日本学術会議に諮問することができる。
Article 4.　The Government may seek the opinions of the Science Council of Japan on the following matters:
一　科学に関する研究、試驗等の助成、その他科学の振興を図るために政府の支出する交付金、補助金等の予算及びその配分
1)　Compilation of budget for and distritution of the government grants and subsidies in order to help scientific researches and experiments or to promote science in general;
二　政府所管の研究所、試驗所及び委託研究費等に関する予算編成の方針
2)　The policies on the compilation of budgets concerning the expenditures of the institutes, laboratories under the jurisdiction of Government and of commissioned researches;
三　特に專門科学者の檢討を要する重要施策
3)　Important measures particularly requiring deliberations by expert scientists;
四　その他日本学術会議に諮問することを適当と認める事項
4)　Other matters recognized as proper to be referred to the Science Council of Japan for deliberation.
第五條　日本学術会議は、左の事項について、政府に勧告することができる。
Article 5.　The Science Council of Japan shall place itself available to the Government for recommendations on the following:
一　科学の振興及び技術の発達に関する方策
1)　The schemes for promotion of science and advancement of technology;
二　科学に関する研究成果の活用に関する方策
2)　Measures for the utilization of the results of scientific researches;
三　科学研究者の養成に関する方策
3)　The schemes concerning the training of scientific researchers;
四　科学を行政に反映させる方策
4)　Reflection of science on administration;
五　科学を産業及び國民生活に浸透させる方策
5)　Permeation of science into national life and industry;
六　その他日本学術会議の目的の遂行に適当な事項
6)　Other matters necessary for the fulfilment of the aims of the Science Council of Japan.
第六條　政府は、日本学術会議の求に應じて、資料の提出、意見の開陳又は説明をすることができる。
Article 6.　The Government on request from the Science Council of Japan, may submit data or explanations or set forth their views.
第三章　組織
Chapter III. Structure
第七條　日本学術会議は、選挙された二百十人の日本学術会議会員（以下会員という。）をもつて、これを組織する。
Article 7.　The Science Council of Japan shall consist of 210 elected members of the Science Council of Japan (To be called hereinafter "members" ).
２　会員の任期は、三年とする。但し、再選を妨げない。
2.　The tenure of office shall be 3 years and re-election shall be unobjectionable.
３　会員には、手当を支給することができる。
3.　Members of the Council may get compensatory allowances for their office.
第八條　日本学術会議に、会長一人及び副会長二人を置く。
Article 8.　The Science Council of Japan shall have one President and two Vice-presidents.
２　会長は、会員の互選によつて、これを定める。
2.　The President shall be a member elected by mutual vote of the members.
３　副会長は、人文科学部門又は自然科学部門に属する会員のうちから、それぞれ一人を全部の会員の互選によつて定める。
3.　Vice-presidents shall be elected from each of the cultural science department and the natural science department by mutual vote of the whole members.
４　会長及び副会長の任期は、会員としての在任期間とする。但し、再選を妨げない。
4.　The President and Vice-presidents shall hold office for the tenure of their present term as members, but re-election shall be unobjectionable.
５　会長又は副会長が欠員となつたときは、新たにこれを互選する。
5.　In event of President's or Vice-president's post becoming vacant a new election by members for the office shall be held.
第九條　会長は、会務を総理し、日本学術会議を代表する。
Article 9.　The President shall supervise the Council affairs and represent the Council.
２　副会長は、会長を補佐し、会長に事故があるときは、会長の指名により、いずれかの一人が、その職務を代理する。
2.　The Vice-presidents shall assist the President and in event of the President being incapacitated, the Vice-president nominated by the President shall deputize for the President.
第十條　日本学術会議に、左の区分により、左の七部を置く。
Article 10.　The following seven division shall be set up in the Science Council of Japan according to the following classification:
人文科学部門
Cultural Science Department:
第一部（文学、哲学、史学）
The First Division (Literature, philosophy and history)
第二部（法律学、政治学）
The Second Division (Law and politics)
第三部（経済学、商学）
The Third Division (Economics and commerce)
自然科学部門第四部（理学）
Natural Science Department:
第五部（工学）
The Fifth Division (Engineering)
第六部（農学）
The Sixth Division (Agriculture)
第七部（医学、歯学、藥学）
The Seventh Division (Medicine, dentistry and pharmacology)
第十一條　会員は、前條に掲げる部のいずれかに分属するものとし、各部の定員は、それぞれ三十人とする。
Article 11.　Every member shall belong to one of the above divisions, and the fixed number of the members of each division shall be 30.
２　各部の定員は、別表の定めるところにより、これを全國区定員と地方区定員とに、全國区定員は、これを專門別定員と專門にかかわらない定員とに分ける。
2.　As is shown in the annexed table, the fixed number of each division shall consist of the fixed number from the nation-wide constituency and that from the district constituency and the fixed number from the nation-wide constituency shall consist of fixed number by profession and fixed number regardless profession.
３　地方区定員は、各地方区において選出された会員一人ずつで、満たされるものとする。
3.　Fixed number from district constituency shall consist of each one member selected from each district constituency.
第十二條　各部に、部長及び副部長各々一人並びに幹事二人を置き、その部に属する会員の互選によつて、これを定める。
Article 12.　Each Division shall have one chief, one vice-chief and two managers who shall be chosen by mutual vote from among the members of the division concerned.
２　第八條第四項及び第五項の規定は、部長、副部長及び幹事について、これを準用する。
2.　The provisions of Paragraphs 4 and 5, Article 8 shall be applied to the chief of division, Vice-chief of division and the manager.
第十三條　部長は、部務を掌理する。
Article 13.　The Chief of the division shall take charge of the division affairs.
２　副部長は、部長を補佐し、部長に事故があるときは、その職務を代理する。
2.　The vice-chief of the division shall assist the chief, and exercise the function of the chief when the chief is incapacitated.
３　幹事は、部長の命を受け、部務に從事する。
3.　The manager shall engage in division affairs by order of the chief of the division.
第十四條　日本学術会議に、その運営に関する事項を審議させるため、運営審議会を置く。
Article 14.　The management committee shall be set up in the Science Council of Japan in order to deliberate on matters with respect to the management of the Council.
２　運営審議会は、会長、副会長、部長、副部長及び幹事をもつて、これを組織する。
2.　The Committee shall be composed of the President, the Vice-presidents, chiefs and vicechiefs and managers of respective divisions.
第十五條　日本学術会議に、常置又は臨時の委員会を置くことができる。
Article 15.　The Science Council of Japan shall be able to create standing or temporary committee within itself.
２　前項の委員会の委員には、手当を支給することができる。
2.　Members of the committee referred to above in the preceding paragraph may get compensatory allowances for their office.
第十六條　日本学術会議に、事務局を置き、日本学術会議に関する事務を処理させる。
Article 16.　The Science Council of Japan shall maintain an office where the business of the Council is to be executed.
２　事務局に、政令の定めるところにより、局長その他所要の職員を置く。
2.　The Council office shall have a director and other necessary officers in accordance with the Cabinet Order.
３　前項の職員中、局長並びに一級及び二級の官吏の任免は、会長の申出を考慮して内閣総理大臣がこれを行い、三級官吏以下の任免は、局長がこれを行う。
3.　The Director and officers referred to in the preceding paragraph and the officials of 1st and 2nd class shall be appointed or discharged by the Prime Minister with the due consideration for the recommendation of the President of the Council and officials of 3rd class and of lower grades shall be appointed or discharged by the Director.
第四章　会員の選挙
Chapter IV. Election of the Members
第十七條　科学者であつて、左の資格の一を有する者は、会員の選挙権及び被選挙権を有する。
Article 17.　The scientists having any one of the following qualifications shall have suffrage of the members and eligibility:
一　学校教育法（昭和二十二年法律第二十六号）又は旧大学令（大正七年勅令第三百八十八号）による大学卒業後二年以上の者
1)　Persons two or more years after graduation from a university under the School Education Law (Law No.26, 1947) or the University Ordinance (Imperial Ordinance No.388, 1918).
二　旧專門学校令（明治三十六年勅令第六十一号）による專門学校、旧師範教育令（昭和十八年勅令第百九号）による教員養成諸学校又はこれらの学校と同等以上の学校、養成所等を卒業後四年以上の者
2)　Persons four or more years after graduation from a college under the College Ordinance (Imperial Ordinance No.61, 1903), a teacher training school under the Normal Education Ordinance Imperial Ordinance No.109, 1943), or any school or teacher training institute on or above the level of such schools.
三　その他研究歴五年以上の者
3)　Others having five or more years of research experiences.
２　前項の科学者は、科学又は技術の研究者であつて、研究論文若しくは業績報告又はこれに代るべき所属の学会若しくは研究機関の責任者の証明により、研究者であることが証明される者でなければならない。
2.　The scientists referred to in the preceding paragraph shall be those researchers of science or technology who have certification by research treatise or achievement report or substituting certificate of responsible persons of professional societies or research bodies to which they belong.
第十八條　前條の規定により選挙権を有する者（以下有権者という。）は、事務局に備えた各部ごとの名簿に登録しなければ、選挙権を行使することができない。
Article 18.　Those persons who have suffrage according to the provisions of the preceding Article (to be called voters hereinafter) shall not use their suffrage before making an entry in the division register at the Business Office.
第十九條　会員の選挙は、全國区と地方区とに分け、各部ごとに、同時に、これを行う。
Article 19.　Election of the members shall consist of election from the nation-wide constituency and election from the district constituency and shall be conducted by division simultaneously.
第二十條　日本学術会議に、選挙管理会を設け、有権者の資格審査、選挙の実施、投票の効力の決定その他選挙に関する事務を行わせる。
Article 20.　The Returning Committee shall be established in the Science Council of Japan to conduct screening of the qualification of voters, execution of election decision of the effect of votes and other business regarding election.
第二十一條　前四條に定めるものの外、会員の選挙に関して必要な事項は、日本学術会議の定める選挙規則で、これを定める。
Article 21.　Necessary matters concerning election of members besides those provided for in the four preceding Articles, shall be stipulated by the Election Regulations of the Science Council of Japan.
第五章　会議
Chapter V. Meetings
第二十二條　日本学術会議の会議は、総会、部会及び連合部会とする。
Article 22.　The Science Countil of Japan shall have General Meetings,Division Meeting and Joint Division Meetings.
２　総会は、日本学術会議の最高議決機関とし、年二回会長がこれを招集する。但し、必要があるときは、臨時にこれを招集することができる。
2.　The General meeting shall be the highest legislative organ of the Science Council of Japan and shall be convocated by the President twice year regularly, and at any other time if necessary.
３　部会は、各部に関する事項を審議し、部長がこれを招集する。
3.　The Division Meeting shall deliberate on matters concerning respective divisions and shall be convocated by the division chief concerned.
４　連合部会は、二以上の部門に関連する事項を審議し、関係する部の部長が、共同してこれを招集する。
4.　The Joint-Division Meetings shall deliberate on matters concerning two or more divisions and shall be convocated by the joint will of the division chiefs concerned.
第二十三條　総会は、会員の二分の一以上の出席がなければ、これを開くことができない。
Article 23.　The quorum of the general meeting of the Science Council cf Japan shall be one half or more of the total members of the Council.
２　総会の議決は、出席会員の多数決による。
2.　Decisions of the general meeting shall be made with at least the majority present.
３　部会及び連合部会の会議については、前二項の規定を準用する。
3.　To the division meeting and the joint-division meeting shall be applied the provisions of the above two preceding paragraphs.
第六章　日本学士院
Chapter VI. The Japan Academy
第二十四條　日本学術会議に、学術上の功績顯著な科学者を優遇するために、日本学士院を置く。
Article 24.　The Japan Academy shall be set up in the Science Council of Japan for the purpose of giving preferential treatment to the scientists who made a remarkable contribution to the country.
２　日本学士院は、学術の研究を奨励するため、特にすぐれた論文、著書その他特定の研究業績に対して授賞することができる。
2.　The Japan Academy may, for the purpose of promoting scientific research, make commendation on the specially excellent treatises, works, or other achievements in specific researches.
３　日本学士院は、日本学士院会員をもつてこれを組織する。
3.　The Japan Academy shall consist of members of the Japan Academy.
４　日本学士院会員の数は、百五十人とし、日本学術会議がこれを選定する。
4.　The number of the members of the Japan Academy shall be,150, selected by the Science Council of Japan.
５　日本学士院会員は、終身とする。
5.　Members of the Japan Academy shall be of life membership.
６　日本学士院会員には、予算の範囲内で、内閣総理大臣の定めるところにより、年金を支給することができる。
6.　Members of the Japan Academy can get pension, the amount specified by the Prime Minister and in accordance with budgetary provisions.
第七章　雜則
Chapter VII. Miscellaneous Rules
第二十五條　会員は、病氣その他やむを得ない事由があるときは、総会の議決によつて退職することができる。
Article 25.　Members of the Science Council of Japan may resign by the decision of the general meeting when necessitated by illness or other inevitable reasons.
第二十六條　会員に、会員として不適当な行爲があるときは、総会における出席会員三分の二以上の議決によつて退職させることができる。
Article 26.　Members of the Science Council of Japan are subject to dismissal by the decision of two-thirds or more of the total members present at the general meeting when their conducts bring disgrace on their position.
第二十七條　会員に欠員を生じたときは、全國区、地方区ともに、あらかじめ選挙管理会の指定する次点者をもつて補充する。
Article 27.　Whether it be the nation-wide constituency or the district electorate, when there occurs a vacancy in membership, the candidate who obtained the next highest votes and who was designated as such by the Returning Committee beforehand shall fill the vacancy.
２　前項による補欠会員の任期は、前任者の残任期間とする。
2.　The tenure of office of the substituted member referred to above shall be the remaining period of that of the former.
第二十八條　会長は、総会の議決を経て、日本学術会議の運営に関し、必要な運営規則を定めることができる。
Article 28.　The President of the Council may lay down management rules necessary for the operation of the Science Council of Japan through the decision of the general meeting of the Council.
附　則
Supplementary Provisions:
第二十九條　この法律のうち、第三十四條及び第三十五條の規定は、この法律の公布の日から、これを施行し、その他の規定は、昭和二十四年一月二十日から、これを施行する。
Article 29.　The provisions of Articles 34 and 35 of the present Law shall come into force on the day of its promulgation, and the provisions of the other Articles of the present Law shall come into force on January 20, 1949.
第三十條　日本学士院規程（明治三十九年勅令第百四十九号）、学術研究会議官制（大正九年勅令第二百九十七号）及び日本学士院会員の待遇に関する件（大正三年勅令第二百五十八号）は、これを廃止する。
Article 30.　The Japan Academy Regulations (Imperial Ordinance No.149 of 1906), the Regulations governing the Organization of the National Research Council (Imperial Ordinance No.297 of 1920) and the Provision for matters concerning Treatment of Members of the Japan Academy (Imperial Ordinance No.258 of 1914) shall be abolished.
第三十一條　從前、日本学士院及び学術研究会議において所掌した事務でその廃止の日に残存するものは、日本学術会議においてこれを処理する。
Article 31.　The Science Council of Japan shall dispose of all the affairs which are left unsettled by the old Japan Academy and the National Research Council on the day of their abolishment.
第三十二條　第二十四條及び第三十條の規定施行の際、日本学士院規程によつて任命された日本学士院会員は、引き続きこの法律による日本学士院会員となつたものとする。
Article 32.　Those who have been appointed members of the Japan Academy regulations on the day of enforcement of the stipulation of Articles 24 and 30 shall remain members of the Japan Academy regulated by the present Law.
第三十三條　第一回に選出された会員の任期は、第七條第二項の規定にかかわらず、これを二年とする。
Article 33.　The tenure of office of the members of the Science Council of Japan who will be selected by the first election shall be two years despite the stipulation of Paragraph 2, Article 7.
第三十四條　第一回の会員選挙は、第四章の規定に從い、学術体制刷新委員会がこれを行う。この場合において、第四項中「日本学術会議」とあるのは、「学術体制刷新委員会」と読み替えるものとする。
Article 34.　The first election of the members shall be held by the Renewal Committee for the Organization of Science based on the provisions of Chapter IV, and "The Science Council of Japan" mentioned in Chapter IV, in this case, shall read "The Renewal Committee for the Organization of Science."
２　日本学術会議の第一回総会は、学術体制刷新委員会委員長が、これを招集する。
2.　The first general meeting of the Science Council of Japan shall be convoked by the chairman of the Renewal Committee for the Organization of Science.
３　前二項に要する経費は、國庫の負担とする。
3.　The expenses necessitated by the activities referred to in the two preceding paragraphs shall be defrayed from the National treasury.
第三十五條　第一回の会員選挙のための選挙管理会は、中央選挙管理会及び地方選挙管理会とする。
Article 35.　The Returning Committees for the first election of the members shall be the Central Returning Committee and the District Returning Committees.
２　地方選挙管理会は、各地方区にこれを置き、中央選挙管理会の事務の執行に協力するものとする。
2.　The District Returning Committees shall be set up in each district and shall cooperate with the Central Returning Committee in the execution of election business.
３　中央選挙管理会の委員は百四人とし、学術体制刷新委員会において、これを選定する。但し、うち七人は各地方選挙管理会の委員のうちから一人づゝを選定するものとする。
3.　The number of the members of the Central Returning Committee shall be 104 who shall be selected by the Renewal Committee for the Organization of Science and 7 among them shall be selected from among the members of the District Returning Committees.
４　地方選挙管理会の委員は、各地方区ごとに十四人以内とし、学術体制刷新委員会地方連絡委員会において、これを選定する。
4.　The number of the members of the District Returning Committees shall be 14 or less in each district, and they shall be selected by the respective District Liaison Committees of the Renewal Committee for the Organization of Science.
