朕は、昭和二十年勅令第五百四十二号ポツダム宣言の受諾に伴い発する命令に関する件に基く肥料配給公團令を裁可し、ここにこれを公布せしめる。
I hereby give My sanction to the Imperial Ordinance concerning the Fertilizer Distribution Kodan (Public Corporation), under Imperial Ordinance No. 542 of 1945 relating to the Orders to be issued in consequence of the Acceptance of the Potsdam Declaration and cause the same to be promulgated.

The Fertilizer Distribution Kodan (Public corporation) Ordinance
第一章　総則
Chapter 1 General Provisions
第一條　肥料配給公團は、経済安定本部総務長官の定める割当計画及び配給手続に從い、命令で定める肥料の適正な配給に関する業務を行うことを目的とする。
Art. 1.　The Fertilizer Distribution Kodan shall have for its object the performance of the business relative to appropriate and equitable distribution of such fertilizers as prescribed by the order in accordance with quota programs and rationing procedures set up or to be set up by the Director-General of the Economic Stabilization Board.
肥料配給公團は、法人とする。
The Fertilizer Distribution Kodan shall be a juridical person.
第二條　肥料配給公團は、主たる事務所を東京都に置く。
Art. 2.　The main office of the Fertilizer Distribution Kodan shall be established in Tokyo.
肥料配給公團は、主務大臣の認可を受けて、配給に関する業務を行うため必要の地に從たる事務所を設置することができる。
The Fertilizer Distribution Kodan may with the approval of the competent Minister, establish branch offices at a place necessary for the performance of business relative to distribution.
第三條　肥料配給公團の基本金は、六千五百万円とする。
Art. 3.　The authorized fixed capital of the Fertilizer Distribution Kodan shall be ¥ 65,000,000.
前項の基本金は、政府が全額これを出資しなければならない。
The authorized fixed capital prescribed in the preceding paragraph shall be subscribed exclusively by the Government.
肥料配給公團の運営資金は、必要があるときには、復興金融金庫から借り入れるものとする。
Working capital of the Fertilizer Distribution Kodan shall be obtained by loan, when necessary, from the Reconstruction Finance Bank.
第四條　肥料配給公團は、定款を以て、左の事項を規定しなければならない。
Art. 4.　The Fertilizer Distribution Kodan shall stipulate the following matters in its Articles of Incorporation:
一　目的
1.　Object
二　名称
2.　Firm name
三　事務所の所在地
3.　Location of Office
四　基本金額に関する事項
4.　Matters relative to capital
五　役員に関する事項
5.　Matters relative to officers
六　業務及びその執行に関する事項
6.　Matters relative to business and its execution
七　会計に関する事項
7.　Matters relative to accounting
八　公吿の方法
8.　Matters relative to public notice
定款は、主務大臣及び経済安定本部総務長官の認可を受けて、これを変更することができる。
The Articles of Incorporation may be revised with the approval of the Director-General of the Economic Stabilization Board, and the competent Minister.
第五條　肥料配給公團は、別に勅令の定める所により、登記しなければならない。
Art. 5.　The Fertilizer Distribution Kodan shall register in accordance with the special provisions of an Imperial Ordinance.
前項の規定によつて登記を必要とする事項は、登記の後でなければ、これを以て第三者に対抗することができない。
The matters required to be registered as provided for in the preceding paragraph shall not be valid against a third person unless they are registered.
第六條　肥料配給公團には、所得稅及び法人稅を課さない。
Art. 6.　The Fertilizer Distribution Kodan shall not be levied income tax and corporation tax.
都道府縣、市町村その他これに準ずるものは、肥料配給公團の事業に対しては、地方稅を課することはできない。但し、特別の事情に基いて、內務大臣及び大藏大臣の認可を受けた場合にはこの限りでない。
The prefecture, city, town, village and those corresponding to them shall not levy local taxes on the enterprise of the Fertilizer Distribution Kodan. This shall, however, not apply where the Ministers of Home Affairs and Finance have approved under a special circumstance.
第七條　肥料配給公團は、臨時物資需給調整法の失効又は経済安定本部総務長官の命令に因つて解散する。
Art. 7.　The Fertilizer Distribution Kodan shall be dissolved by the nullification of the Temporary Demand Supply Adjustment Law or by the order of the Director-General of the Economic Stabilization Board.
前項に定めるものの外、肥料配給公團の解散に関して必要な事項は、別に勅令でこれを定める。
In addition to the matters referred to in the preceding paragraph, those necessary for dissolution of the Fertilizer Distribution Kodan shall be prescribed separately by the ordinance.
第八條　肥料配給公團でない者は、肥料配給公團又はこれに類似する名称を用いることができない。
Art. 8.　Any person other than the Fertilizer Distribution Kodan shall not use the words Fertilizer Distribution Kodan or similar words in his firm name.
第九條　民法第四十四條、第五十條、第五十四條及び第五十七條並びに非訟事件手続法第三十五條第一項の規定は、肥料配給公團にこれを準用する。
Art. 9.　The provisions of Articles 44, 50, 54 and 57 of the Civil Code and Art. 35, paragraph 1 of the non-litigant case Procedural Law shall apply correspondingly to the Fertilizer Distribution Kodan.
第二章　役員及び職員
Chapter 2 Officers and Employees
第十條　肥料配給公團に、役員として総裁副総裁各一名、理事二名以上及び監事一名以上を置く。
Art. 10.　The Fertilizer Distribution Kodan shall have as its officers one president, one vice-president, two or more directors and one or more auditors.
総裁は、肥料配給公團を代表し、第十五條の規定に基き、その業務を総理する。
The president shall represent the Fertilizer Distribution Kodan and supervise its business in accordance with the provisions of Art. 15.
副総裁は、定款の定めるところにより、肥料配給公團を代表し、総裁を補佐して肥料配給公團の業務を掌理し、総裁に事故のあるときにはその職務を代理し、総裁が欠員のときにはその職務を行う。
The vice-president shall, as prescribed in the Articles of Incorporation, represent the Fertilizer Distribution Kodan, assist the president in conducting business, act for him in case he cannot take his duty and perform his function in case his post becomes vacant.
理事は、定款の定めるところにより、肥料配給公團を代表し、総裁及び副総裁を補佐して肥料配給公團の業務を掌理し、総裁及び副総裁に事故のあるときにはその職務を代理し、総裁及び副総裁が欠員のときにはその職務を行う。
The directors shall, as prescribed in the Articles of Incorporation, represent the Fertilizer Distribution Kodan, assist the president and vice-president in control of its affairs, and act for them in case their positions become vacant.
監事は、肥料配給公團の業務を監査する。
The auditors shall inspect the business of the Fertilizer Distribution Kodan.
第十一條　総裁、副総裁、理事及び監事は、主務大臣がこれを任命する。
Art. 11.　The president, vice-president directors and auditors shall be appointed by the competent Minister.
第十二條　総裁、副総裁及び理事は、定款の定めるところにより、肥料配給公團の職員のうちから、主たる事務所又は從たる事務所の業務に関して、一切の裁判上又は裁判外の行爲をする権限を有する代理人を選任することができる。
Art. 12.　The president, vice-president and directors may, in accordance with the provisions of the Articles of Incorporation, delegate power to employees of the Fertilizer Distribution Kodan, who shall have authority to perform all juridical and non-juridical matters in regard to the affairs of the main or subordinate offices.
第十三條　肥料配給公團の役員及び職員は、肥料の生產、保管若しくは賣買を業とする会社の株式を所有し、又はこれらの会社その他の企業の業務に從事し、若しくはその営業につき一切の利害関係を有してはならない。
Art. 13.　The officers and employees shall not be permitted to be stockholders or employees or to have any beneficial interest in any company or enterprise engaged in the production, storage, purchase, sale and transport of fertilizer.
第十四條　肥料配給公團の役員及び職員は、官吏その他の政府職員とする。
Art 14.　The officers and employees of the Fertilizer Distribution Kodan shall be Government officials or other Government employees.
総裁たる者は、農林次官と同級又はこれを同格とし、その他の役員たる者は、一級又はこれと同格とし、職員たる者は、一級、二級若しくは三級又はこれらと同格とし、これらの定員は、主務大臣が、これを定める。
The president shall be of the same class or rank with Vice-Minister of Agriculture and Forestry, and the officials other than the president shall be of first class officials. Other employees shall be of first, second or third class officials. The Competent Minister shall fix the number of the above staff.
肥料配給公團の役員及び職員は、官吏に関する一般法令に從うものとする。但し、主務大臣が経済安定本部総務長官の承認を受けて、給與、服務その他必要な事項に関して特例を定めたときには、これによるものとする。
The officials and employees of the Fertilizer Distribution Kodan shall be governed by all laws and ordinances relating to the Government employees, provided the cases that the special exception concerning the amount of salaries, service rules, and any other necessary matters with approval of the Director-General of Economic Stabilization Board, may be exempted.
第三章　業務
Chapter 3 Business
第十五條　肥料配給公團は、経済安定本部総務長官の定める割当計画及び配給手続並びにこれらに関する指示に基き、主務大臣の監督に從い、左の業務を行う。
Art. 15.　The Fertilizer Distribution Kodan shall perform the following business under the supervision of the competent Minister in accordance with the quota programs, rationing procedures and directions relating thereto set up and issued by the Director-General of the Economic Stabilization Board:
一　物價廳の定める價格による國內產肥料及び輸入肥料の一手買取及び一手賣渡
1.　Sale purchase and sale of domestic and imported fertilizers at prices established by the Price Board.
二　肥料の保管
2.　Storage of fertilizers
三　輸送施設の配置及び使用に関する法令に基き、肥料の適切な輸送を行うために必要な措置
3.　Necessary arrangement for adequate transportation of fertilizers in accordance with laws and regulations governing the allocation and use of transportation facilities.
四　肥料取扱業者の指定
4.　Appointment of authorized dealers of fertilizers.
五　肥料の配給及び價格に関する法令の施行に対する協力
5.　Assist in the enforcement of law and ordinances governing the distribution and price of fertilizer set by the Economic Stabilization Board and Ministry of Agriculture and Forestry.
六　第一号及び第二号に附帶する業務
6.　Enterprises in pursuance with item 1 and item 2.
前項第四号の指定は、経済安定本部総務長官の定める條件に基く主務大臣の認可を受けなければならない。
The appointment of item 4 of the preceding paragraph shall be made with the approval of the competent Minister and within terms and conditions set forth by the Director-General of the Economic Stabilization Board.
第十六條　肥料配給公團は、業務開始の際、業務の方法を定めて、経済安定本部総務長官に提出し、その認可を受けなければならない。これを変更しようとするときも同樣である。
Art. 16.　The Fertilizer Distribution Kodan shall at the commencement of its functioning establish its method of doing business and submit same to the Director-General of the Economic Stabilization Board for his approval. This shall also apply to where a change is to be made thereto.
経済安定本部総務長官は、前項の認可を行うときには、主務大臣及び大藏大臣に協議しなければならない。この場合において認可の最終責任は、経済安定本部総務長官にあるものとする。
The Director-General of the Economic Stabilization Board shall inquire to the competent Minister and Minister of Finance, in case he approves by the preceding paragraph. In this case the final responsibility for approval shall lay with the Director-General of the Economic Stabilization Board.
第十七條　肥料配給公團は、每事業年度の前期及び後期の初において六箇月每の事業計画及び資金計画を作成し、これを経済安定本部総務長官に提出し、その認可を受けなければならない。これを変更しようとするときも同樣である。
Art. 17.　The Fertilizer Distribution Kodan shall, at the beginning of the first term and the second term of each business year, establish a business programs and a financial program for every six months and submit same to the Director-General of the Economic Stabilization Board for his approval. This shall also apply where a change is to be made thereto.
経済安定本部総務長官は、前項の認可を行うときには、主務大臣及び大藏大臣に協議しなければならない。この場合において認可の最終責任は、経済安定本部総務長官にあるものとする。
The Director-General of the Economic Stabilization Board shall inquire to the competent Minister and the Minister of Finance, in case he approves by the preceding paragraph. In this case, the final responsibility for approval shall lay with the Director-General of the Economic Stabilization Board.
第四章　会計
Chapter 4 Accounting
第十八條　肥料配給公團の事業年度は、每年四月から翌年三月までとし、これを前期及び後期に分ける。
Art. 18.　The business year of the Fertilizer Distribution Kodan shall be from 1 April each year to 31 March of the following year, and divided into the first term and the second term.
第十九條　肥料配給公團は、前條の各期每に財產目錄、貸借対照表及び損益計算書を作成し、每事業年度経過後二箇月以內に、これを経済安定本部総務長官に提出し、その承認を受けなければならない。
Art. 19.　The Fertilizer Distribution Kodan shall prepare a statement of assets, a balance sheet, and a statement of profit and loss for each term of the preceding Article and submit them to the Director-General of the Economic Stabilization Board for his approval within three months after the conclusion of the business year.
経済安定本部総務長官は、前項の承認を行うときには、主務大臣及び大藏大臣に協議しなければならない。この場合において承認の最終責任は、経済安定本部総務長官にあるものとする。
The Director-General of the Economic Stabilization Board shall inquire to the competent Minister and the Minister of Finance in case he approves by the preceding paragraph. In this case the final responsibility for approval shall lay with the Director-General of the Economic Stabilization Board.
肥料配給公團は、第一項の規定による経済安定本部総務長官の承認を受けたときには、その財產目錄、貸借対照表及び損益計算書を公吿し、且つ、これを定款とともに、各事務所に備えて置かなければならない。
The Fertilizer Distribution Kodan shall, when it has obtained the approval of the Director-General of the Economic Stabilization Board prescribed in the first paragraph, make a public notice of the statement of assets, balance sheet, and a statement of profit and loss and keep them together with the Articles of Incorporation in each office.
前項の財產目錄、貸借対照表及び損益計算書は、会計檢査院の檢査を受け、その承認を受けなければならない。
The statement of assets, balance sheet, and statement of profit and loss of the preceding paragraph shall be audited and approved by the Board of Audit.
肥料配給公團は、経済安定本部総務長官の承認を受けて、命令の定めるところにより、剩余金を國庫に納付しなければならない。
The Fertilizer Distribution Kodan shall, when it has obtained the approval of the Director-General of the Economic Stabilization Board, pay to the National Treasury, the entire profit as determined by stipulations of Ordinance.
肥料配給公團は、帳簿、書類その他一切の記錄を整然且つ明確に記載し、会計檢査院、経済安定本部及び主務官廳の檢査を受けることができるように整備しなければならない。
All books, documents and records of the Fertilizer Distribution Kodan shall be clearly written and available for inspection by the Board of Audit, the Economic Stabilization Board and the competent Ministry
会計檢査院は、常に適確に前項の檢査を行わなければならない。
The Board of Audit shall make a continual and accurate audit of the preceding paragraph
第五章　監督及び助成
Chapter 5 Supervision and Fostering
第二十條　経済安定本部総務長官は、割当計画及び配給手続に関して、肥料配給公團を指導監督する。
Art. 20.　The Director-General of the Economic Stabilization Board shall direct and supervise the Fertilizer Distribution Kodan in regard to quota program and rationing procedures.
経済安定本部総務長官は、肥料の適正な配給を確保するため必要があると認めるときには、肥料配給公團に対して、監督上必要な命令をなすことができる。
The Director-General of the Economic Stabilization Board may, when deemed necessary to secure appropriate distribution of fertilizer, issue for supervision a necessary order to the Fertilizer Distribution Kodan.
主務大臣は、肥料の適正な配給を確保するため必要があると認めるときには、肥料配給公團に対して経済安定本部総務長官の定める割当計画及び配給手続に基いて、監督上必要な命令をなすことができる。
The competent Minister may, when deemed necessary to secure appropriate distribution of fertilizers, issue for supervision a necessary order to the Fertilizer Distribution Kodan within the quota program and rationing procedures set up or to be set up by the Director General of the Economic Stabilization Board.
主務大臣又は経済安定本部総務長官は、必要があると認めるときには、肥料配給公團に対して報吿をさせ、又は当該官吏に、必要な場所に臨檢し、業務の狀況若しくは帳簿、書類その他必要な物件を檢査させることができる。
The competent Minister or the Director-General of the Economic Stabilization Board may, when deemed necessary, have the Fertilizer Distribution Kodan submit a report or have an official concerned inspect a place deemed necessary to examine the state of business, books, documents or any other necessary matters.
前項の規定により、当該官吏に臨檢檢査させる場合には、命令の定めるところにより、その身分を示す証票を携帶させなければならない。
In case the official concerned is sent for inspection and examination in accordance with the provisions of the preceding paragraph, he shall carry an identification certificate to prove his post as prescribed by orders.
第二十一條　肥料配給公團は、その役員及び職員に対して、特別の報酬を與える必要があるときには、その報酬規程を定め、経済安定本部総務長官の認可を受けなければならない。
Art. 21.　The Fertilizer Distribution Kodan shall prepare rules on remuneration for its officers and employees, when deemed necessary to pay special payment to them, and submit to the Director General of the Economic Stabilization Board for his approval.
これを変更しようとするときも同樣である。
This shall be applied to where a change is to be made thereto.
経済安定本部総務長官は、前項の認可を行うときには、主務大臣及び大藏大臣に協議しなければならない。この場合において認可の最終責任は、経済安定本部総務長官にあるものとする。
The Director General of the Economic Stabilization Board shall inquire to the competent Minister and the Finance Minister, when he approves by the preceding paragraph. In this case, the final responsibility for approval shall lay with the Director General of the Economic Stabilization Board.
第二十二條　主務大臣は、肥料配給公團の役員が法令若しくは定款又はこの勅令に基いてなす命令に違反したときには、これを解任することができる。
Art. 22.　The competent Minister may remove an officer of the Fertilizer Distribution Kodan in case he violates laws and ordinances, Articles of Incorporaion or orders issued on the basis of this Imperial Ordinance.
経済安定本部総務長官は、肥料配給公團の役員が肥料配給公團の目的及び業務に関して、その任に適せず、又はその職務を適切に遂行していないと認めるときには、これを解任することができる。
The Director General of the Economic Stabilization Board may remove an officer of the Fertilizer Distribution Kodan, if he considers that he is not suitable or preperly carrying out his duties in connection with the objects and business of the Fertilizer Distribution Kodan
第二十三條　主務大臣は、肥料配給公團の業務を行うため必要があると認めるときには、日本肥料株式会社の淸算人に対し、当該会社の所有に属する施設の全部又は一部を肥料配給公團に貸與することを命ずることができる。
Art. 23.　The competent Minister may, when deemed necessary for the operation of the Fertilizer Distribution Kodan, order the liquidater of the Japan Fertilizer Company Ltd. to lease any or all facilities owned by the Company to the Fertilizer Distribution Kodan.
主務大臣は、肥料配給公團の業務を行うため必要があると認めるときには、肥料配給公團に必要な施設の所有者若しくは占有者又は大藏大臣を含む管理者に対して、当該施設を肥料配給公團に貸與することを命じ、又は求めることができる。
The competent Minister may, when deemed necessary for the operation of the Fertilizer Distribution Kodan, order owners, exclusive holders or persons having custody, including the Minister of Finance, of facilities requireed by the Fertilizer Distribution Kodan to lease them to the Fertilizer Distribution Kodan.
前二項の規定による施設の使用料は、経済安定本部総務長官がそのあらかじめ定める方針に基いて、適正に定めるものとする。
A fair and adequate rental for the use of such facilities prescribed in the preceding two paragraphs shall be determined by the Director General of the Economic Stabilization Board based on policies established by him.
前項の規定によつて使用料が定められたときには、肥料配給公團は、第七條第一項に定められた存続期間を超えない範囲において、経済安定本部総務長官の承認を受けて第一項又は第二項の施設を賃借するものとする。
When the rental is determined in accordance with the provisions of the preceding paragraph, the Fertilizer Distribution Kodan shall lease the facilities referred to in the 1st or 2nd paragraph for period of time not exceeding its life, prescribed in Art. 7, paragraph 1, with approval of the Director General of the Economic Stabilization Board.
主務大臣は、肥料配給公團の業務を行うため必要があると認めるときには、日本肥料株式会社の淸算人に対して、当該会社が所有し、又は占有している資材の全部又は一部を肥料配給公團に讓り渡し、又は引き渡すことを命ずることができる。
The competent Minister may, when deemed necessary for the operation of the Fertilizer Distribution Kodan, order the liquidator of the Japan Fertilizen Company Ltd. to hand over to the Fertilizer Distribution Kodan any or all materials owned by or in possession of the Japan Fertilizer Company.
前項の命令があつたときには、肥料配給公團は、同項の資材の讓受又は引渡を受けた日から一箇月以內に関係者に対して、正当な補償を支拂わなければならない。
In case the order of the preceding paragraph is issued the Fertilizer Distribution Kodan shall pay fair compensations to the parties concerned within one month of the materials, referred to in the preceding paragraph, being taken over by the Fertilizer Distribution Kodan.
主務大臣は、経済安定本部総務長官の承認を受けて、前項の補償に関し必要な規程を定めた後でなければ、第五項の命令をなすことができない。
The competent Minister shall not issue the order of the 5th paragraph, unless necessary rules are made for compensation of the preceding paragraph with the approval of the Director General of the Economic Stabilization Board.
主務大臣は、肥料配給公團の業務を行うため必要があると認めるときには、経済安定本部総務長官の定める方針に基き、運輸大臣の同意を得て、必要な輸送施設の所有者若しくは占有者又は運輸大臣を含む管理者に対して、当該輸送施設を肥料配給公團の使用に供することを命じ、又は求めることができる。
The competent Minister may, when deemed necessary for the operation of the Fertilizer Distribution Kodan, in accordance with policies established by the Director General of the Economic Stabilization Board and with the approval of the Minister of Transportation, order owners, exclusive holders or persons having custody, including the Minister of Transportation of transportation facilities to make them available for use by the Fertilizer Distribution Kodan.
前項の場合においては、肥料配給公團は、関係者に対し正当な補償を支拂わなければならない。
In case of the preceding paragraph, the Fertilizer Distribution Kodan shall pay fair compensation to the parties concerned.
主務大臣は、経済安定本部総務長官の承認を受けて、前項の補償に関し必要な規程を定めた後でなければ第八項の命令又は要求をなすことができない。
The competent Minister shall not issue the order of the 8th paragraph, unless necessry rules are made for compensation of the preceding paragraph with the approval of the Director General of the Economic Stabilization Board.
主務大臣は、肥料配給公團が賃借した施設を管理し、又は必要があると認めるときには、保險を附する等の措置を肥料配給公團にとらしめることに関し、責任あるものとする。
The competent minister shall be responsible to have the Fertilizer Distribution Kodan arrange for care and where deemed necessary, for insurance of all facilities leased by it.
主務大臣は、前各項の実施について肥料配給公團又は関係各大臣を含む関係者に対して迅速な措置を命じ、又は求めることができる。
The competent Minister may order the Fertilizer Distribution Kodan or other parties concerned, including any Minister, to make prompt arrangements for execution of the preceding paragraph.
第六章　罰則
Chapter 6 Penalties
第二十四條　前條第一項、第二項、第五項又は第八項の規定による命令に違反した者は、これを五年以下の懲役又は五万円以下の罰金に処する。
Art. 24.　Those who violate the provisions prescribed in paragraph 1, 2, 5 or 8 of the preceding Article shall be liable to penal servitude not exceeding five years and, or a fine not exceeding ¥ 50,000.
第二十五條　左の場合においては、その違反行爲をなした肥料配給公團の役員又は職員は、これを五年以下の懲役又は五万円以下の罰金に処する。
Art. 25　The Fertilizer Distribution officers and employees who come under and commits an act contrary to one of the following items shall be liable to penal servitude not exceeding 5 years and, or a fine not exceeding 50,000 yen.
一　第十五條第一項に規定しない業務を行つた場合
1.　Those who perform business which is not prescribed in Art. 15.
二　第二十條第二項又は第三項に規定する経済安定本部総務長官又は主務大臣の監督上の命令に違反した場合
2.　Those who violate an order relative to supervision of the Director General of the Fconomic Stabilization Board or the competent Minister, prescribed in Art 20, paragraph 2 or 3.
第二十六條　この勅令の規定による報吿を怠り、若しくは虛僞の報吿をなし、又は檢査を拒み、妨げ、若しくは忌避した者は、これを一年以下の懲役又は一万円以下の罰金に処する。
Art. 26.　Those who fail to report as required under Imperial Ordinance or submit a falsified report or refuse, interfere, or evade inspections shall be liable to a penal servitude not exceeding one year and, or a fine not exceeding ¥ 10,000.
第二十七條　前三條の罰を犯した者には、情狀に因り、懲役及び罰金を併科することができる。
Art. 27.　Those who violate the provisions of the preceding three paragraphs may, according to cireumstances, be liable concurrently to a penal servitude and a fine
第二十八條　法人の代表者又は法人若しくは人の代理人、使用人その他の從業者がその法人又は人の業務に関して第二十四條の違反行爲をなしたときには、行爲者を罰する外、その法人又は人に対して同條の罰金刑を科する。
Art. 28.　In case representative of a juridical person or an agent, employee or any other person except the Fertilizer Distribution Kodan engaged by juridical person or a person commits the violation mentioned in Art. 24, with regard to the business of the respective juridical person or the person, the respective juridical person or the person shall be liable to fine of Art. 24, in addition that the offender shall be punished.
第二十九條　第八條の規定に違反して、肥料配給公團又はこれに類似する名称を用いた者は、これを一万円以下の過料に処する。
Art. 29.　Those who used the name of the Fertilizer Distribution Kodan or any other similar name in violation of the provisions of Art. 8 shall be liable to a fine not exceeding 10,000 yen.
附　則
Supplementary Provisions:
第三十條　この勅令施行の期日は、別に勅令でこれを定める。
Art. 30.　The date of the enforcement of this Imperial Ordinance shall be set forth separately by an Imperial Ordinance.
第三十一條　日本肥料株式会社法及び臨時肥料配給統制法は、肥料配給公團成立の日において、これを廃止する。但し、これらの法令廃止以前にこれらの法令に基いてなした行爲に対する罰則の適用については、これらの法令は、その廃止後もなおその効力を有する。
Art. 31.　The Japan Fertilizer Company Ltd. Law and Special Fertilizer Distribution Control Law shall become null and void at the date of the establishment of the Fertilizer Distribution Kodan. However, as for the application of penalties to acts done by that date, these Laws shall be effective after that date
第三十二條　この勅令は、昭和二十三年四月一日又は経済安定本部廃止のときの何れか早いときにその効力を失う。
Art. 32.　This Imperial Ordinance shall become null and void as of April 1, 1948, or at the time of the dissolution of the Economic Stabilization Board, whichever the earlier date.
肥料配給公團は、前項の時に解散する。但し、その時までになした行爲に対する罰則の適用及び肥料配給公團の淸算に関しては、この勅令は、その時以後もなおその効力を有する。
The Fertilizer Distribution Kodan shall be dissolved at the time prescribed in the preceding paragraph. In so far as the application of penal regulations for commitments done up to that time and liquidation of the Fertilizer Distribution Kodan are concerned, however, this Imperial Ordinance shall hold good even after that date.
第三十三條　肥料配給公團が成立したときには、日本肥料株式会社は、解散する。
Art. 33.　When the Fertilizer Distribution Kodan is established, the Japan Fertilizer Company shall be dissolved.
前項の規定による日本肥料株式会社の淸算は、昭和二十三年四月一日までに結了せしめるものとする。
The liquidation of the Japan Fertilizer Company Ltd., in accordance with the provisions of the preceding paragraph shall be finished by the 1st of April, 1948.
第三十四條　政府は、設立委員を命じて、肥料配給公團の設立に関する事務を処理させる。
Art. 34.　The government shall appoint an organizing committee to take charge of works relative to the establishment of the Fertilizer Distribution Kodan.
第三十五條　設立委員は、定款を作成して、主務大臣及び経済安定本部総務長官の認可を受けなければならない。
Art. 35.　The organizing committee shall prepare Articles of Incorporation and obtain the approval of the competent Minister and the Director General of the Economic Stabilization Board.
前項の認可があつたときには、設立委員は、遅滯なく基本金の拂込を請求しなければならない。
The organizing committee shall, when the approval referred to in the preceding paragraph has been given, demand payment of the authorized fixed capital without delay.
第三十六條　基本金の拂込があつたときには、設立委員は、遅滯なくその事務を肥料配給公團の総裁に引き継がなければならない。
Art. 36.　The organizing committee, shall when payment of the authorized fixed capital has heen made, transfer its work to the President of the Fertilizer Distribution Kodan without delay.
総裁が前項の事務の引継を受けたときには、総裁、副総裁、理事及び監事の全員は、遅滯なく設立の登記をしなければならない
When the President has taken over the work referred to in the preceding paragraph, all of the President, Vice-President, Directors and Auditors shall effect the registration of the establishment without delay.
肥料配給公團は、設立の登記をすることに因つて成立する。
The Fertilizer Distribution Kodan shall come into being upon the registration of the establishment.
第三十七條　肥料配給公團でない者でこの勅令施行の際現に肥料配給公團又はこれに類似する名称を用いているものについては、この勅令施行後六箇月を限り、第八條の規定を適用しない。
Art. 37.　The provisions of Art. 8 shall not apply for 6 mcnths from the date of the enforcement of this Imperial Ordinance to those other than the Fertilizer Distribution Kodan who use the name of Fertilizer Distribution Kodan or similar names at the time this Imperial Ordinance is put into effect.
第三十八條　登錄稅法の一部を次のように改正する。
Art. 38.　Part of Registration Tax law shall be amended as follows:
第六條第一項第十一号中「肥料債券、」を削る。
In Art. 6, par. 1, item 11, "Fertilizer Bond" shall be beleted.
