道路運送車両法の一部を改正する法律
Law for Partial Amendments to Vehicles for Road Transportation Law
道路運送車両法（昭和二十六年法律第百八十五号）の一部を次のように改正する。
The Vehicles for Road Transportation Law (Law No.185 of 1951) shall be partially amended as follows:
第四條中「自動車」を「自動車（軽自動車及び二輪の小型自動車を除く。以下第二十九條から第三十二條までを除き本章において同じ。）」に改める。
In Article 4, "motor vehicle" shall be amended as "motor vehicle (except light motor vehicles and two-wheel small-size motor vehicles;hereinafter the same in this Chapter except Article 29 to Article 32 inclusive)" .
第五條中「登録を受けた自動車で、軽自動車及び二輪の小型自動車以外のもの」を「登録を受けた自動車」に改める。
Article 5 shall be amended as follows: "The acquisition and forfeiture of possessory right of motor vehicles which obtained registration shall not be set up against a third person unless registration therefor is obtained" .
第二十九條第一項中「自動車の製作を業とする者」を「自動車の製作を業とする者、自動車の車台又は原動機の製作を業とする者及び運輸大臣が指定した者」に改め、同條第二項中「自動車の製作を業とする者」を「自動車の製作を業とする者、自動車の車台又は原動機の製作を業とする者及び前項の指定を受けた者」に、「運輸大臣の指定を受け」を「予め運輸大臣に届け出て」に改め、同項の次に次の一項を加える。
In Article 29 paragraph 1, "No person other than those who make it their business to manufacture motor vehicles" shall be amended as "No person other than those who make it their business to manufacture motor vehicles, those who make it their business to manufacture motor vehicle chassis or prime mover thereof, as well as those who have been designated by the Minister of Transportation" , and in paragraph 2 of the same Article, "any person who makes it his business to manufacture motor vehicles" , as "any person who makes it his business to manufacture motor vehicles, any person who makes it his business to manufacture motor vehicle chassis or prime mover thereof, as well as those who have been designated as referred to in the preceding paragraph" , and "he shall obtain the designation of the Minister of Transportation" , as "he shall report previously to the Minister of Transportation" , and next to the same paragraph, the following one paragraph shall be added:
３　運輸大臣は、前項の届出に係る自動車の車台番号又は原動機番号の様式、番号、位置及び方法が適当でないと認めるときは、その変更を命ずることができる。
3　The Minister of Transportation may, in cases where the form, number, position and method of chassis number or prime mover number of motor vehicles which have been reported as referred to in the preceding paragraph, are deemed not proper, order the alteration thereof.
第三十條に次の一項を加える。
The following one paragraph shall be added to Article 30:
２　前項の者が、その輸入しようとする自動車又は自動車の車台若しくは原動機の車台番号又は原動機番号の様式、番号及び位置について、その事実を証明するに足る当該自動車又は自動車の車台若しくは原動機の製作者の書面を添えて、運輸大臣に届け出たときは、同項の規定による届出はしなくてもよい。
2　In cases where the person referred to in the preceding paragraph reported to the Minister of Transportation as to the form, number and position of chassis number of prime mover number of motor vehicle, motor vehicle chassis or prime mover which he intends to import, accompanied with the documents sufficiently proving the fact which are prepared by the manufacturer of the motor vehicle, motor vehicle chassis or prime mover thereof concerned, the report in accordance with the provisions of the same paragraph may not be submitted.
第四十一條第六号を次のように改める。
Article 41 item (6) shall be amended as follows:

第五十七條を次のように改める。

第五十八條中「自動車は」を「自動車（軽自動車を除く。以下本章において同じ。）は」に改める。
In Article 58, "No motor vehicle" shall be amended as "No motor vehicle (except light motor vehicles;hereinafter the same in this Chapter)" .
第六十條中「申請者に交付しなければならない。」の次に「この場合において、二輪の小型自動車については車両番号を指定しなければならない。」を加え、同條第一号を次のように改める。
In Article 60, next to "deliver to the applicant the motor vehicle inspection certificate on which are entered the matters enumerated in each of the following items:" , "In this case, as regards two-wheel small-size motor, vehicles, the vehicle number shall be designated therefor" , shall be added and item (1) of the same Article shall be amended as follows:
一　自動車検査証番号及び登録自動車にあつては自動車登録番号、二輪の小型自動車にあつては車両番号
(1)　Motor vehicle inspection certificate number, and, with respect to registered motor vehicles, motor vehicle registration number, and vehicle number in the case of two-wheel smallsize motor vehicles.
第六十條第十七号を次のように改める。
Article 60 item (17) shall be amended as follows:
十七　被け丶ん丶引自動車にあつては、け丶ん丶引自動車の車名及び型式
(17)　With respect to a trailer, the name and type of the tractor;
第六十一條第一項を次のように改める。
Article 61 paragraph 1 shall be amended as follows:
自動車検査証の有効期間は、旅客を運送する自動車運送事業の用に供する自動車にあつては九箇月、貨物の運送の用に供する自動車にあつては一年、その他の自動車にあつては二年とする。
The period of validity of a motor vehicle inspection certificate shall be respectively nine months, one year and two years, with respect to motor vehicles served for motor carrier business transporting passengers, motor vehicles served for freight transportation, and other motor vehicles.
第六十一條第二項中「一年を経過しない前」を「前項の有効期間を経過しない前」に、「前項の有効期間を一年未満に定める」を「同項の有効期間を短縮する」に改める。
In Article 61 paragraph 2, "before the lapse of one year" shall be amended as "before the lapse of the period of validity referred to in the preceding paragraph" , and "fix the period of validity referred to in the preceding paragraph to less than one year" , as "reduce the period of validity referred to in the same paragraph" .
第六十四條第一項中「（軽自動車を除く。）」を削る。
In Article 64 paragraph 1, "(excluding light motor vehicles)" shall be deleted.
第六十七條第二項中第四号を第五号とし、第三号の次に次の一号を加える。
In Article 67 paragraph 2, item (4) shall be made item (5), and next to item (3), the following one item shall be added:
四　自動車運送事業の用に供するかどうかの別に変更があつたとき。
(4)　When any alteration has been made as to whether the motor vehicle is served for motor carrier business or not.
第七十三條を次のように改める。

第七十三條　二輪の小型自動車は、その後面の見易い位置に第六十條後段の車両番号を記載した車両番号標を表示しなければ、これを運行の用に供してはならない。
Article 73.　No two-wheel small-size motor vehicle shall be served for operation unless the vehicle number plate thereof bearing the vehicle number referred to in the latter clause of Article 60 is indicated at a visible position at the rear of the vehicle.
２　第三十四條から第三十六條までの規定は、二輪の小型自動車について準用する。この場合において、第三十四條第一項中「第四條」とあるのは「第五十八條本文」と、第三十六條第二項中「第十九條」とあるのは「第七十三條第一項」と読み替える。
2　The provisions of Article 34 to Article 36 inclusive shall apply mutatis mutandis to twowheel small-size motor vehicles. In this case, in Article 34 paragraph 1, "Article 4" shall read "the text of Article 58" , and in Article 36 paragraph 2, "Article 19" shall read "Article 73 paragraph 1" .
第七十六條中「第七十三條第一項の検査の手続、原動機付自転車検査証及び旅客軽車両検査証の記載事項及び返納に関する事項」を「第七十三條第一項の車両番号標に関する事項」に改める。
In Article 76, "the procedure of inspection referred to in Article 73 paragraph 1, matters of entry as well as matters concerning the return of motor bike inspection certificate and passenger light vehicle inspection certificate" shall be amended as "matters concerning vehicle number plate referred to in Article 73 paragraph 1" .
第九十七條第一項及び第三項中「登録自動車であつて軽自動車及び二輪の小型自動車以外のもの」を「登録自動車」に改め、同條の次に次の一條を加える。
In Article 97 paragraph 1 and paragraph 3, "As to compulsory execution to registered motor vehicles other than light motor vehicles and two-wheel small-size motor vehicles" , shall be amended as "As to compulsory execution to registered motor vehicles" , and next to the same Article, the following one Article shall be added:
（軽自動車の使用の届出等）
(Report on the Use of Light Motor Vehicles, etc.)
第九十七條の二　軽自動車は、その使用者が、その使用の本拠の位置を管轄する陸運局長に届け出て、車両番号の指定を受けなければ、これを運行の用に供してはならない。
Article 97-(2).　No light motor vehicle shall be served for operation unless its user has reported to the chief of Land Transportation Bureau having jurisdiction over the locality of abode of use thereof and obtained the designation of vehicle number.
２　第七十三條第一項の規定は、軽自動車について準用する。
2　The provisions of Article 73 paragraph 1 shall apply mutatis mutandis to the light motor vehicles.
第九十八條中「、臨時運行許可番号標、原動機付自転車番号標又は旅客軽車両番号標」を「又は臨時運行許可番号標」に改める。
In Article 98, ", number plate permitting temporary operation, motor bike number plate or passenger light vehicle number plate" shall be amended as "or number plate permitting temporary operation" .
第百條第一項第三号を次のように改める。
Article 100 paragraph 1 item (3) shall be amended as follows:
三　第二十九條第二項又は第三十條の規定により届出をした者
(3)　Any person who has reported in accordance with the provisions of Article 29 paragraph 2 or Article 30.
第百二條の表中「
七　第七十五條第一項の指定を申請する者 八千円
八　第九十四條第一項の規定による認定を申請する者 三千円
」を「
七　第五十八條、第六十二條第一項、第六十四條第一項、第六十七條第二項又は第七十一條第一項の規定による検査を受けようとする者 二輪の小型自動車にあつては百円、その他の自動車にあつては二百円

第百五條第二項中「及び第五十四條」を「、第五十四條及び第九十七條の二第一項」に改める。
In Article 105 paragraph 2, "and 54" shall be amended as "and 54, and Article 97-(2) paragraph 1" .
第百七條第一号中「、第二十九條第二項」を削り、「第三十四條第一項」の下に「（第七十三條第二項において準用する場合を含む。）」を加える。
In Article 107 item (1), ", Article 29 paragraph 2" shall be deleted, and next to "Article 34 para-graph 1" , "(including the cases where this applies mutatis mutandis under Article 73 paragraph 2)" shall be added.
第百八條第一号中「、第六十九條第二項又は第七十三條第一項」を「又は第六十九條第二項」に改め、同條第二号中「（第五十七條において準用する場合を含む。）」を削る。
In Article 108 item (1), ", Article 69 paragraph 2 or Article 73 paragraph 1" shall be amended as "or Article 69 paragraph 2" , and in item (2) of the same Article, "(including the cases where this applies mutatis mutandis under Article 57)" shall be deleted.
第百九條第一号中「、第二十九條第二項」を削り、「第七十三條第二項」を「第七十三條第一項（第九十七條の二第二項において準用する場合を含む。）」に改める。
In Article 109 item (1), ", Article 29 paragraph 2" shall be deleted, and "Article 73 paragraph 2" shall be amended as "Article 73 paragraph 1 (including the cases where this applies mutatis mutandis under Article 97-(2) paragraph 2)" .
第百十條第一号中「第二十八條第二項、」の下に「第二十九條第二項、」を、「第九十六條」の下に「、第九十七條の二第一項」を加え、同條第三号中「第三十條」を「第三十條第一項」に改め、同條第六号中「第五十三條」を「第二十九條第三項、第五十三條」に改める。
In Article 110 item (1), next to "Article 28 paragraph 2" , "Article 29 paragraph 2," shall be added, and next to "Article 96" , ", Article 97-(2) paragraph 1" shall be added;in item (3) of the same Article, "Article 30" shall be amended as "Article 30 paragraph 1;and in item (6) of the same Article." Article 53 "shall be amended as" Article 29 paragraph 3, Article 53".
附　則
Supplementary Provisions:
１　この法律は、公布の日から施行する。
1　This Law shall come into force as from the day of its promulgation.
２　この法律の施行の際、現に改正前の道路運送車両法（以下「法」という。）第二十九條第二項の規定により指定を受けた車台番号又は原動機番号の様式、番号、位置及び方法は、それぞれ、改正後の同項の規定により届け出た車台番号又は原動機番号の様式、番号、位置及び方法とみなす。
2　The form, number, position and method of chassis number or prime mover number which have been actually designated under the provisions of Article 29 paragraph 2 of the Vehicles for Road Transportation Law before amendments (hereinafter referred to as "Law" ) at the time of the enforcement of this Law shall be deemed respectively to be the form, number, position and method of chassis number or prime mover number which have been reported under the provisions of the same paragraph after amendments thereto.
３　この法律の施行の際、現に有効な自動車検査証の有効期間は、改正後の法第六十一條の規定にかかわらず、現に記載されている有効期間によるものとする。
3　The period of validity of motor vehicle inspection certificate actually valid at the time of the enforcement of this Law shall be based upon the period of validity actually entered thereon, irrespective of the provisions of Article 61 of the Law after amendments thereto.
４　この法律の施行の際、現に軽自動車又は二輪の小型自動車に表示した自動車登録番号標は、改正後の法第七十三條第一項（法第九十七條の二第二項において準用する場合を含む。）の規定により表示した車両番号標とみなす。
4　The motor vehicle registration number plates actually indicated on the light motor vehicles or two-wheel small-size motor vehicles at the time of the enforcement of this Law shall be deemed the vehicle number plates indicated under the provisions after amendments thereto of Article 73 paragraph 1 (including the cases where this applies mutatis mutandis under Article 97-(2) paragraph 2) of the Law after amendments thereto.
５　この法律の施行前にした行為に対する罰則の適用については、この法律の施行後も、なお従前の例による。
5　As regards the application of penal provisions to the acts committed before the enforcement of this Law, the former instances shall still apply even after the enforement of this Law.
６　運輸省設置法（昭和二十四年法律第百五十七号）の一部を次のように改正する。
6　The Ministry of Transportation Establishment Law (Law No.157 of 1949) shall be partially amended as follows:
第四條第一項第四十一号から第四十一号の三までを次のように改める。
Article 4 paragraph 1 items (41) to (41)-(3) inclusive shall be amended as follows:
四十一　自動車の整備を命ずること。
(41)　To order the maintenance and repair of motor vehicles;
四十一の二　自動車の検査及び登録をすること。
(41)-(2)　To carry out inspection and registration of motor vehicles;
四十一の三　自動車登録番号標交付代行者の指定をすること。
(41)-(3)　To designate the delivery agents of motor vehicle registration number plates.
第二十八條第一項第十号の次に次の一号を加える。
Next to Article 28 paragraph 1 item (10), the following one item shall be added:
十の二　自動車抵当に関すること。
(10)-(2)　Mortgage of motor vehicles.
第二十八條第一項第十二号の四を次のように改める。
Article 28 paragraph 1 item (12)-(4) shall be amended as follows:
十二の四　自動車、原動機付自転車及び軽車両の整備並びに自動車の検査に関すること。
(12)-(4)　Maintenance and repair of motor vehicles, motor bikes and light vehicles, as well as the inspection of motor vehicles.
第五十一條第一項第十一号の次に次の一号を加える。
Next to Article 51 paragraph 1 item (11), the following one item shall be added:

第五十一條第一項第十三号の四を次のように改める。

７　自動車抵当法（昭和二十六年法律第百八十七号）の一部を次のように改正する。
7　The Motor Vehicle Mortgage Law (Law No.187 of 1951) shall be partially amended as follows:
第二條中「登録を受けた自動車で軽自動車及び二輪の小型自動車以外のもの」を「登録を受けた自動車」に改める。
In Article 2, "a motor vehicle which has been registered under the Vehicles for Road Transportation Law (Law No.187 of 1951) exclusive of light motor vehicles and two-wheel smallsize motor vehicles" shall be amended as "a motor vehicle which has been registered under the Vehicles for Road Transportation Law (Law No.187 of 1951)" .
