予防接種法等による国庫負担の特例等に関する法律
Law concerning Special Cases, etc. of the Shares of National Treasury as provided for in the Preventive Vaccination Law, etc.
第一條　左に掲げる法律の規定は、その規定による国庫及び都道府県の負担が、地方財政平衡交付金法（昭和二十五年法律第二百十一号）に基く平衡交付金に繰り入れられるため、昭和二十五年度に限り、適用しない。
Article 1.　In view of the transfer to the nationa equalization grant, based on the Local Finance Equalization Grant Law (Law No.211 of 1950), of the shares of National Treasury and To, Do, Fu or prefecture regulated by the provisions of the laws mentioned in the following, these provisions shall not apply (during the fiscal year 1950-51:
一　予防接種法（昭和二十三年法律第六十八号）第二十一條、第二十二條及び第二十四條第一項（同法第五條の規定による定期予防接種を行うために要する経費に関する都道府県及び国庫の負担に関する部分に限る。）
(1)　Art.21, Art.22 and Art.24 par.1 (only the part concerning the shares of To, Do, Fu or prefecture and National Treasury as regard to the expenses enforcing periodical preventive vaccination in accordance with the provision of Art.5) of the Preventive Vaccination Law (Law No.68 of 1948);
二　「トラホーム」予防法（大正八年法律第二十七号）第六條及び第七條
(2)　Art.6 and Art.7 of the Trachoma Prevention Law (Law No.27 of 1919);
三　食品衛生法（昭和二十二年法律第二百三十三号）第二十六條
(3)　Art.26 of the Food Sanitation Law (Law No.233 of 1947);
四　民生委員法（昭和二十三年法律第百九十八号）第二十八條及び第二十九條
(4)　Art.28 and Art.29 of the Welfare Commissioner Law (Law No.198 of 1948);
五　身体障害者福祉法（昭和二十四年法律第二百八十三号）第三十六條（同法第三十五條第二号及び第三号の費用並びに都道府県が設置する身体障害者更生援護施設及び養成施設の運営に要する費用に関する部分に限る。）
(5)　Art.36 (only the parts concerning the expenses under Art.35 item (2) and item (3) and expenses necessary for the management of the rehabilitation relief institutions and training institutions for disabled persons established by To, Do, Fu or prefecture) of the Law for Welfare of Disabled Persons (Law No.283 of 1949);
六　兒童福祉法（昭和二十二年法律第百六十四号）第五十二條（同法第五十條第二号の費用に関する部分に限る。）及び第五十三條（同法第五十條第三号、第六号及び第七号並びに第五十一條第一号の費用に関する部分に限る。）
(6)　Art.52 (only the part concerning the expenses under Art.50 item (2)) and Art.53 (only the part concerning the expenses under Art.50 item (3), item (6) and item (7) and Art 51 item (1)) of the Child Welfare Law (Law No.164 of 1947);
七　伝染病予防法（明治三十年法律第三十六号）第二十四條及び第二十五條第一項（同法第十六條ノ二第一項の規定による措置に要する費用に関する部分に限る。）
(7)　Art.24 and Art.25 item (1)(only the part concerning the expenses necessary for the dispositions under the provision of Art.16-(2) paragraph 1) of the Infections Disease Prevention Law (Law No.36 of 1897).
第二條　伝染病予防法の一部を次のように改正する。
Article 2.　The Infectious Disease Prevention Law shall be partially amended as follows:
第十六條ノ二を次のように改める。
Art.16-(2) shall be amended as follows:
第十六條ノ二　都道府県又ハ市町村ハ政令ノ定ムルトコロニ依リ鼠族、昆虫等ノ駆除ヲ行ヒ之ニ必要ナル人員ヲ置キ及器具、薬品其ノ他ノ物件ヲ設備スベシ
Art.16-(2).　To, Do, Fu or prefecture or city, town or village shall perform the extermination of rodent and insects, etc., in accordance with the provisions of Cabinet Order, and have persons necessary for it and arrange instruments, drugs and other materials.
伝染病流行シ若ハ流行ノ虞アルトキハ都道府県知事ハ政令ノ定ムルトコロニ依リ地域ヲ定メ市町村ヲシテ鼠族、昆虫等ノ駆除及之ニ関スル施設ヲ為サシムルコトヲ得
In case infectious diseases prevail or are liable to prevail, the governor of To, Do, Fu or prefecture may make city, town or village exterminate rodent and insects, etc., and arrange the facilities for extermination, by deciding areas in accordance with the provisions of Cabinet Order.
附　則
Supplementary Provision:
この法律は、公布の日から施行し、昭和二十五年四月一日から適用する。
This Law shall come into force as from the day of its promulgation, and shall apply as from April 1, 1950.
