I hereby promulgate the Law for Partial Amendments to the Law concerning Share by the Local Government of the Pay of Municipal School Personnel.

市町村立学校職員給與負担法の一部を改正する法律
Law for Partial Amendments to the Law concerning Share by the Local Government of the Pay of Municipal School Personnel
市町村立学校職員給與負担法（昭和二十三年法律第百三十五号）の一部を次のように改正する。
The Law concerning Share by the Local Government of the Pay of Municipal School Personnel (Law No.135 of 1948) shall be partially amended as follows:
第一條中「地方事務官たる職員の俸給、特別加俸、死亡賜金、旅費、扶養手当、勤務地手当、退官又は退職に関する手当、日直及び宿直に関する手当（以下俸給その他の給與という。）」を「事務職員の給料、扶養手当、勤務地手当、特殊勤務手当、日直及び宿直に関する手当、年末手当、寒冷地手当、石炭手当、退職手当、退職年金及び退職一時金、死亡一時金、旅費並びに公務災害補償（以下給料その他の給與という。）」に改める。
In Article 1, "The salary, additional pay, grant for death, travelling expenses, family allowance, area allowance, retirement allowance, day-and-night-duty allowance (hereinafter referred to as" salary and other pay ") of the personnel who are local secretaries," shall be amended as "the salary, family allowance, area allowance, special area allowance, day-and-night-duty allowance, year-end allowance, cold district allowance, coal allowance, separation allowance, separation annuity and death lump-sum grant, travelling expenses, and compensation for accidents in time of duty (hereinafter referred to as" salary and other allowances ") of administrative personnel."
第二條中「特別の時期及び時間」を「夜間その他特別の時間又は時期」に改め、「又は夜間の課程」を削り、「俸給その他の給與」を「給料その他の給與」に改める。
In Article 2, "at a particular time and period" shall be amended as "at night or at specific time or period" ; "or evening course" shall be deleted, and "the salary and other pay" shall be amended as "salary and other allowances."
第二條の次に次の二條を加える。
The following two Articles shall be added next to Article 2:
第三條　前二條に規定する職員の定数は、都道府県の條例で定める範囲内で、教育委員会の置かれている市町村にあつては当該市町村の教育委員会が都道府県の教育委員会に協議してこれを定め、教育委員会の置かれていない市町村にあつては都道府県の教育委員会がこれを定める。
Article 3.　The fixed number of personnel prescribed in the preceding two Articles shall be determined by the boards of education of cities, towns and villages, in cases where the boards of education have been established in those cities, towns and villages within the limit as provided for by the by-law of To, Do, Fu and prefectures, after consultation with the boards of education of To, Do, Fu and prefectures;and it shall be determined by the boards of education of To, Do, Fu and prefectures in cases where the boards of education have not been established in those cities, towns and villages.
第四條　第一條及び第二條に規定する職員の給料その他の給與については、教育公務員特例法（昭和二十四年法律第一号）第二十五條の四第一項の規定の適用を受けるものを除く外、都道府県の條例でこれを定める。
Article 4.　As regards the salary and other allowances of the personnel prescribed in Articles 1 and 2, they shall be fixed by the by-law of To, Do, Fu and prefectures, excepting those to which the provision of Article 25-(4) paragraph 1 of the Law for the Special Regulations concerning Educational Public Service (Law No.1 of 1949) is applicable.
２　前項の都道府県の條例に関する議案の作成及び提出については、教育委員会法（昭和二十三年法律第百七十号）第六十一條に規定する事件の例による。
2　As for the preparation and presentation of proposal concerning by-law of To, Do, Fu and prefectures under the preceding paragraph, instances of the cases provided for in Article 61 of the Board of Education Law (Law No.170 of 1948) shall be followed.
附　則
Supplementary Provisions:
１　この法律は、公布の日から施行し、昭和二十六年度から適用する。
1　This Law shall come into force as from the day of its promulgation, and shall apply as from the fiscal year 1951.
２　義務教育費国庫負担法（昭和十五年法律第二十二号）は、廃止する。
2　The Law concerning the Treasury's Share of Compulsory Education Expenses (Law No.22 of 1940) shall be abolished.
