農業災害補償法の一部を改正する法律をここに公布する。

農業災害補償法の一部を改正する法律
Law amending a Part of the Compensation against Agricultural Loss Law
農業災害補償法（昭和二十二年法律第百八十五号）の一部を次のように改正する。
A part of the Compensation against Agricultural Loss Law (Law No.185 of 1947) shall be amended as follows:
第十三條の二　製糸業法による製糸業者及び蚕糸業法による蚕種製造業者（以下製糸業者等という。）は、政令の定めるところにより、農業共済組合の組合員の支拂うべき蚕繭共済に係る共済掛金の一部を負担しなければならない。
Article 13-(2).　Licensed silk reelers prescribed in the Silk Reeling Industry Law and those persons who are engaged in the business silkworm egg production in accordance with the Raw Silk Industry Law (hereinafter referred to as silk reelers and others) shall, in accordance with the provisions of the Cabinet Order concerned, defray part of the mutual relief money concerning mutual relief for silkworms and cocoons payable by members of an Agricultural Mutual Relief Association.
製糸業者等は、政令の定めるところにより、前項の負担金を農業共済再保險特別会計に拂い込まなければならない。
Silk reelers and others shall, in accordance with the provisions of the Cabinet Order concerned, pay the money due from them mentioned in the preceding Article into the Agricultural Mutual Relief Reinsurance Special Accounts.
第一項の負担金は、國税徴收法の例によつて、これを徴收することができる。
The money mentioned in Par.1 may be collected after the example of the National Tax Collection Law.
主務大臣は、製糸業者等から、第一項の負担金に関し必要な報告を徴することができる。
The Minister in charge may order silk reelers and others to submit to the same the necessary reports on the money mentioned in Par.1.
政府は、生糸又は普通蚕種の販賣價格の統制額を定める場合には、第一項の負担金を、製糸業者等からその生産に係る生糸又は普通蚕種を讓り受ける者が負担するように、その統制額を定めなければならない。
The Government shall, in case it determines the selling price of raw silk or ordinary silkworm eggs, so determine the selling price as to make the money mentioned in Par.1 be charged to those persons who take over raw silk or ordinary silkworm eggs raised by silk reelers and others from the said reelers and others.
前條の規定は、第一項の負担金にこれを準用する。
The provisions of the preceding Article shall apply with necessary modifications to the money mentioned in Par.1.
第八十四條第一項第一号中、「冷害」の下に「、雪害」を加え、同條同項第二号中「又はひよう害」を「、ひよう害、雪害その他氣象上の原因（地震及び噴火を含む。）に因る災害」に改める。
In Art.84, Par.1, Item 1, "cold" shall be followed by "snow," and in Art.84, Par.1, Item 2, "or hail-storm" shall be amended as "hail-storm, snow and other meteorological pheno-menal (including earth-quakes and voleanic eruptions)."
第百四十一條、第百四十四條及び第百四十五條中「農林保險審査会」を「農業共済再保險審査会」に改める。
In Arts.141,144 and 145, "Agriculture and Forestry Insurance Inquiry Commission" shall be amended as "Agricultural Mutual Relief Reinsurance Inquiry Commission."
附　則
Supplementary Provisions:
１　この法律は、公布の日から、これを施行する。但し、第十三條の二の規定は、昭和二十三年の蚕繭から、これを適用する。
This Law shall come into force as from the day of its promulgation;provided that the provisions of Art.13-(2) shall apply to silkworms and cocoons produced in and after 1948.
２　農業共済再保險特別会計法（昭和十九年法律第十一号）の一部を次のように改正する。
Part of the Agricultural Mutual Relief Reinsurance Special Accounts Law (Law No.11 of 1944) shall be amended as follows:
第三條中「食糧管理特別会計ヨリノ受入金、」の下に「農業災害補償法第十三條の二第一項ノ規定ニ依ル負担金、」を、「農業災害補償法第十三條ノ規定ニ依ル交付金」の下に「（同法第十三條の二第六項ニ於テ準用スル場合ヲ含ム）」を加える。
In Art.3, "the receipts from the Food Control Special Accounts" shall be followed by "the money prescribed in Art.13-(2), Par. I of the Compensation Against Agricultural Loss Law" and "the allotment in money prescribed in Art.13 of the Compensation Against Agricultural Loss Law" shall be followed by "(including the case whereto the same provision shall apply mutatis mutandis as is prescribed in Art.13-(2), Par.6.)."
