薬事法の一部を改正する法律
Law for Partial Amendments to the Pharmaceutical Affairs Law
薬事法（昭和二十三年法律第百九十七号）の一部を次のように改正する。
The Pharmaceutical Affairs Law (Law No.197 of 1948) shall be partially amended as follows:
第三十二條に次の二項を加える。
Next to Article 32, the following two paragraphs shall be added:
３　厚生大臣は、保健衞生上の危害を防止するために必要があるときは、薬事審議会の建議に基き、用具又は化粧品に関して、品質の最低基準を定めることができる。
3　The Minister of Welfare may, when it is necessary for the prevention of hazards to the public health and sanitation, fix the minimum standards of quality relating to devices or cosmetics on the basis of the recommendation of the National Committee of Pharmacy.
４　前項の規定により品質の最低基準が定められた用具又は化粧品は、その基準に適合するものでなければ、これを販売し、授與し、又は販売若しくは授與の目的で製造し、輸入し、貯蔵し、若しくは陳列してはならない。
4　The devices or cosmetics, for which the minimum standards of quality have been fixed in accordance with the provision of the preceding paragraph, shall not be sold or otherwise distributed, or manufactured, imported, stored or exhibited for the purpose of sale or other distribution, unless they meet these standards.
第三十三條中「厚生大臣の指定した医薬品」を「厚生大臣の指定した医薬品及び前條第三項の規定により品質の最低基準が定められた用具又は化粧品であつて厚生大臣の指定したもの」に改める。
In Article 33, "The drugs designated by the Minister of Welfare" , shall be amended as "The drugs designated by the Minister of Welfare, and the devices or cosmetics for which the minimum standards of quality have been fixed in accordance with the provision of paragraph 3 of the preceding Article and which have been designated by the Minister of Welfare" .
第四十九條中「医薬品、用具若しくは化粧品の製造業者若しくは輸入販売業者又は医薬品の販売業者」を「医薬品、用具又は化粧品の製造業者、輸入販売業者又は販売業者」に改め、「無償で」を削る。
In Article 49, "a manufacturer, or an importer of drugs, devices, or cosmetics, or a seller of drugs" shall be amended as "a manufacturer, an importer or a seller of drugs, devices or cosmetics" , and "free of charge" shall be deleted.
附　則
Supplementary Provision:
この法律は、公布の日から施行する。
This Law shall come into force as from the day of its promulgation.
