昨年施行された教育職員免許法及び同法施行法について、新免許制度及び切り替え措置が教育職員の身分に密接に関連していることから、各方面から検討や改正の要望があった。政府は実施後間もないため更なる研究を予定していたが、教育職員の利益保護と地位安定のため、不明瞭な点の明確化と不均衡の是正が急務と判断し改正案を提出した。主な改正点は、旧令による免許状所有者等への新免許状切り替え措置における不均衡の是正、施行法第7条の有効期間の明確化（昭和28年3月31日まで）、及び免許法第6条第2項別表第4の特例設定による上級免許状取得に関する不均衡の軽減である。
