農林省設置法の一部を改正する法律
Law for Partial Amendments to the Ministry of Agriculture and Forestry Establishment Law
農林省設置法（昭和二十四年法律第百五十三号）の一部を次のように改正する。
The Ministry of Agriculture and Forestry Establishment Law (Law No.153 of 1949) shall be partially amended as follows:
目次中「（第三十六條―第四十條）」を「（第三十六條―第四十一條）」に改め、「第二款　資材調整事務所（第四十一條）」を削り、「第三款　作物報告事務所」を「第二款　統計調査事務所」に改める。
In Contents, "(Articles 36-40)" shall be amended as "(Articles 36-41)" ; "Part 2 Material Adjustment Offices (Article 41)" shall be deleted;and "Part 3 Crop Reporting Offices" shall be amended as "Part 2 Statistical Survey Offices" .
第四條第三十二号中「開拓用機械器具」を「開拓及び土地改良事業（農地及び農業用施設の災害復旧事業を含む。以下同じ。）に用いる機械器具」に、第三十三号中「土地改良事業」を「開墾建設工事若しくは土地改良事業」に、第三十四号中「土地改良事業」を「開拓又は土地改良事業」に改める。
In Article 4 item (32), "machinery, implements and materials for land reclamation works" shall be amended as "machinery, implements and materials used for land reclamation and land improvement works (including disaster rehabilitation works on agricultural lands and facilities, hereinafter the same)" ;in item (33), "land improvement works" shall be amended as "land reclamation and construction works or land improvement works" ;and in item (34), "land improvement works" shall be amended as "land reclamation or land improvement works" .
第四條第五十二号中「及び森林害虫の駆除又は予防」を削る。
In Article 4 item (52), ", and for control or prevention against the forest noxious insects" shall be deleted.
第四條第六十二号を次のように改める。

第九條第一項各号を次のように改める。
Each item of Article 9 paragraph 1 shall be amended as follows:
一　農地及び農業水利の制度に関する企画を行うこと。
(1)　Planning for agricultural lands and agricultural water utilization system;
二　自作農の創設及び維持に関すること。
(2)　Establishment and maintenance of ownerfarmer;
三　農地の移動廃用を統制し、その他農地関係の調整を図ること。
(3)　Control over transfer and disuse of agricultural lands and adjustment of other matters relative to agricultural lands;
四　土地及び水等開発資源の調査及び開発に関する企画を行うこと。

九　土地改良区及び土地改良区連合の組織及び管理についての指導監督を行うこと。
(9)　Guidance and supervision over organization and administration of land improvement districts and the league thereof;
十　農地等の交換分合の指導助成を行うこと。
(10)　Guidance and furtherance of exchange and consolidation of agricultural lands, etc.;
十一　国営の開墾建設工事及び土地改良事業の実施に関すること。
(11)　Execution of State-operated and reclamation and construction works and land improvement works;
十二　開墾建設工事及び土地改良事業の技術上の指導監督及び助成を行うこと。
(12)　Technical guidance, supervision and furtherance of land reclamation and construction works, and of land improvement works;
十三　開拓及び土地改良事業に用いる機械器具及び資材の管理及びあつ旋に関すること。
(13)　Administration and help of procuring of machinery, implements and materials used for land reclamation and land improvement works.
第九條第二項中「、第五号から第七号まで及び第九号」を「及び第六号から第十号まで」に改め、同條第三項中「第一項第四号」の下に「及び第五号」を加え、「及び第八号に掲げる事務のうち国営の土地改良事業を実施するための調査及び計画に関するもの」を削り、同條第四項中「第一項第八号に掲げる事務のうち国営の土地改良事業を実施するための設計及び工事に関するもの」を「第一項第十一号から第十三号までに掲げる事務」に改める。
In Article 9 paragraph 2, ", (5) to (7) inclusive and (9)" shall be amended as "and (6) to (10) inclusive" ;in paragraph 3 of the same Article, "concerning survey and plan for implementing state-operated land improvement projects out of such affairs" shall be deleted and "and (8)" shall be amended as "and (5)" ;in paragraph 4 of the same Article, "the affairs concerning design and construction work required for implementing the state-operated land improvement projects out of the affairs provided for in paragraph 1 item (8)" shall be amended as "the affairs as referred to in paragraph 1 items (11) to (13) inclusive" .
第十一條第一項第十三号を削る。

In Article 13, "Agricultural Experiment Station Tea Experiment Station Horticultural Experiment Station Livestock Experiment Station National Research Institute of Agriculture Land Development Research Institute" shall be amended as "Agricultural Technique Research Institute Agricultural Experiment Station National Research Institute of Agriculture" and "Agricultural Machinery and Implements Administration Office" shall be amended as "Agricultural Machinery and Implements Training Office" .

第十五條　農業試験場は、その所在する地方及びこれと農業事情を等しくする地方における農業に関し、技術上の調査研究、分析、鑑定及び講習を行う機関とする。
Article 15.　The Agricultural Experiment Station shall be an organ taking charge of technical research and study, analysis, judgement and training course concerning the agriculture in the region where it is located and in the regions the agricultural conditions of which are similar thereto.
２　農業試験場の名称及び位置は、左の通りとする。

Kind Purpose
Agricultural and Forest Commodities Standards Council To make research and deliberation on any matters relating to the standards and gradings of agricultural, forest, livestock and marine products.
Committee for Losses Incurred by Agriculture and Forestry Credit Improvement Special Loan To fix losses and amount of losses sustained by a city, town or village, or by the Central Cooperative Bank for Agriculture and Forestry, the Hypothetic Bank of Japan, the Agricultural and Industrial Bank or the Hokkaido Colonial Bank, due to the special loans made under such laws as the Special Loanings by the Central Cooperative Bank for Agriculture and Forestry and Loss Compensation Law (Law No.32 of of 1932), the Agricultural Debts Disposition Association Law (Law No.21 of 1933), the Special Loanings for Agricultural Dobts Disposition Funds and Loss Compensation Law (Law No.77 of 1937) or the Temporary Agricultural Debts Disposition Law (Law No.69 of 1937).
Agricultural Mutual Relief Reinsurance Committee To inquire into matters related to the reinsurance operated by the Government in pursuance of the Compensation Against Agricultural Loss Law (Law No.185 of 1947), and to make research and deliberation on matters relating to the Agricultural loss prevention or to the agricultural damage compensation.
Central Agricultural Adjustment Council To make deliberation on important matters relating to the agriculture planning for staple food products or to the enforcement of the Food Maintenance Temporary Measures Law.
Agricultural Materials Examination Committee To exercise the powers provided for by the Agricultural Seeds and Seedlings Law (Law No.115 of 1947) and the Agricultural Chemical Control Law (Law No.82 of 1948) and to make inspection of agricultural machinery and implements as well as to make research and deliberation on important matters related to agricultural seeds and seedlings, agricultural chemicals and agricultural machinery and implements.
Central Agricultural Land Conference The dispose of the affairs placed under the powers thereof by the Agricultural Land Adjustment Law (Law No.67 of 1938) and by other laws and orders, and to make research and deliberation on important matters related to agricultural lands.
Central Crop Estimation Council To make research and deliberation on important matters with respect to estimation on crop growth and yield of staple food.
Veterinarian Licence Committee To administer veterinarian examination and to make research and deliberation of important matters related to veterinarians.
Horseshoers Examination Committee To take charge of the matters related to horseshoers examination under the Horseshoers Law (Law No.89 of 1940).
第三十五條中「 資材調整事務所 作物報告事務所 」を「統計調査事務所」に改める。
In Article 35, "Material Adjustment Offices Crop Reporting Offices" shall be amended as "Statistical Survey Offices."
第三十六條を次のように改める。

第三十六條　農地事務局は、本省の所掌事務のうち、左に掲げる事務を分掌する。
Article 36.　The Regional Agricultural Land Offices shall take charge of a part of the responsibilities of the Ministry proper as enumerated below:
一　自作農の創設及び維持に関すること。
(1)　Establishment and maintenance of ownerfarmers;
二　農地の移動廃用を統制し、その他農地関係の調整を図ること。
(2)　Control of transfer and disuse of agricultural lands and other adjustment relating to agricultural lands;
三　土地及び水等開発資源の調査及び開発に関する企画を行うこと。

第三十九條中「及び事業所」を「並びに事業所及びその支所」に改める。
In Article 39, "and business places" shall be amended as ", and business places and their branches" .
第四十條の次の「第二款　資材調整事務所」を削り、第四十一條を次のように改める。

第四十一條の次の「第三款　作物報告事務所」を「第二款　統計調査事務所」に、第四十二條及び第四十三條第一項中「作物報告事務所」を「統計調査事務所」に改める。

第四十七條中「 食糧部 食品部 」を「 業務第一部 業務第二部 」に改める。
In Article 47, "Food Division Groceries Division" shall be amended as "First Operation Division Second Operation Division ".
第四十八條第三号を削り、第四号を第三号とし、以下第八号までを順次一号ずつ繰り上げ、第九号中「食料品配給公団及び油糧配給公団」を「及び油糧砂糖配給公団」に改め、同号を第八号とし、第十号を第九号とする。
Article 48 item (3) shall be deleted, item (4) shall be made item (3), the numbering of items (5) to (8) inclusive shall be moved up by one, in item (9) ", Groceries Distribution Kodan and Oilstuffs Distribution Kodan" shall be amended as "and Oilstuffs and Sugar Distribution Kodan" and the same item shall be made item (8), and item (10) shall be made item (9).
第四十九條（見出しを含む。）中「食糧部」を「業務第一部」に改め、同條第二号を削り、第三号を第二号とする。
In Article 49 (inclusive of heading), "Food Division" shall be amended as "First Operation Division" , item (2) of the same Article shall be deleted and item (3) shall be made item (2).
第五十條（見出しを含む。）中「食品部」を「業務第二部」に改め、同條第二号を第四号とし、第一号を第三号とし、同條に第一号及び第二号として次の二号を加える。
In Article 50 (inclusive of heading), "Groceries Division" shall be amended as "Second Operation Division" , item (2) of the same Article shall be made item (4), item (1) shall be made item (3) and the following two items shall be added to the same Article as items (1) and (2):
一　主要食糧、飮食料品及び油脂の輸出入の調整を行うこと。
(1)　Adjustment of export and import of staple foods, foods and beverages as well as oils and fats;
二　主要食糧の輸出入の許可等に関すること。
(2)　Granting of license, etc. for export and import of staple foods;
第五十一條中「第五十四條に規定するものの外、」を削り、第五十四條を次のように改める。

第五十六條中第四項を第五項とし、第三項中「林野庁長官の指揮監督」の下に「、前項の事務については官房長の指揮監督」を加え、同項を第四項とし、第二項の次に次の一項を加える。
In Article 56, paragraph 4 shall be made paragraph 5;in paragraph 3, "and with respect to the affairs prescribed in the preceding paragraph, to the direction and supervision of the Chief of Minister's Secretariat" shall be added next to "of the Director of the Forestry Agency" and the same paragraph shall be made paragraph 4;and the following one paragraph shall be added next to paragraph 2:
３　農林大臣は、前二項の事務の外、当分の間、その地域別に指定する十以内の食糧事務所に、本省の所掌事務のうち農林畜水産物及び農林畜水産業用物資の割当又は配分に関する調整並びにこれらの物資の輸送の連絡に関する事務を分掌させることができる。
3　The Minister of Agriculture and Forestry may, in addition to the affairs under the preceding two paragraphs, charge, for the time being, the Food Offices not exceeding ten in number, designated by him by area, with a part of the responsibilities of the Ministry proper, concerning the adjustment of allocation or distribution of agricultural, forest, livestock and marine products and materials used for agriculture, forestry, livestock industry and fisheries, as well as the liaison for transportation of these materials.
第六十二條第七号の次に次の一号を加える。
The following one item shall be added next to Article 62 item (7):
八　森林害虫の駆除予防に関すること。
(8)　Extermination of and prevention against the forest noxious insects.
第六十三條第六号中「及び薪炭需給調節特別会計」を削る。
In Article 63 item (6), "and the Firewood and Charcoal Demand and Supply Adjustment Special Account" shall be deleted.
第六十五條第一項の表中林産物規格審査会の部を削り、同條第二項中「林産物規格審査会、」及び「指定農林物資検査法、」を削る。
In the Table of Article 65 paragraph 1, the part concerning Forest Products Standards Council shall be deleted, and in paragraph 2 of the same Article, "the Forest Products Standards Council" , and "the Law for the Designated Agricultural and Forestry Commodities Inspection" shall be deleted.
第六十六條中「木炭事務所」を削る。
In Article 66, "Charcoal Offices" shall be deleted.
第六十九條第二項中「組織の細目」の下に「及び職員の服制」を加える。
In Article 69 paragraph 2, "and the uniform of the personnel" shall be added next to "the detailed organizations" .
第七十條第二項中「内部組織」の下に「並びに職員の服制」を加える。
In Article 70 paragraph 2, "and the uniform of the personnel" shall be added next to "internal organizations" .
第七十一條及び第七十二條を次のように改める。

In Article 76 paragraph 1, "Feedstuff Distribution Kodan" and "Grocery Distribution Kodan" shall be deleted, and "Oil and Fat Distribution Kodan" shall be amended as "Oilstuff and Sugar Distribution Kodan" , and in paragraph 2 of the same Article, "the Feedstuff Distribution Kodan," , ", the Grocery Distribution Kodan" , "The Feedstuff Distribution Kodan Law (Law No.202 of 1947)" , and ", the Grocery Distribution Kodan Law (Law No.201 of 1947)" shall be deleted and "the Oil and Fat Distribution Kodan Law (Law No.203 of 1947)" shall be amended as "the Oilstuff and Sugar Distribution Kodan Law (Law No.203 of 1947)" .
附　則
Supplementary Provisions:
１　この法律は、公布の日から施行する。但し、第四條第六十二号、第六十六條、第七十一條及び第七十二條の改正規定は、昭和二十六年一月一日から施行する。
1.　This Law shall come into force as from the day of its promulgation;provided that the amended provisions of Article 4 item (62), and Articles 66, 71 and 72 shall come into force as from January 1, 1951.
２　靜岡種畜牧場については、昭和二十五年六月三十日までは、第三十三條第二項の改正規定にかかわらず、資材調整事務所及び食糧事務所については、昭和二十五年四月三十日までは、第四十一條及び第五十六條の改正規定にかかわらず、それぞれ、なお従前の例による。
2.　As for Shizuoka Livestock Station, the precedents under the former provisions shall apply until June 30, 1950, regardless of the amended provision of Article 33 paragraph 2;and, as for Material Adjustment Office and Food Office, the precedents under the former provisions shall apply until April 30, 1950, regardless of the amended provisions of Articles 41 and 56.
３　この法律施行の際現に資材調整事務所に勤務する官吏である者が引き続き都道府県の職員となつたときは、恩給法の一部を改正する法律（昭和二十二年法律第七十七号）附則第十條の規定の適用がある場合を除き、同條の規定を準用する。
3.　In cases where any Government official actually on duty at the Material Adjustment Office at the time of enforcement of this Law continuously becomes one of personnel of To, Do, Fu or prefecture, the provisions of Article 10 of the Supplementary Provisions of the Law for Partial Amendments to the Pension Law (Law No.77 of 1947) shall apply mutatis mutandis except for the case whereto the same Article applies.
４　昭和二十五年四月三十日において現に農林省資材調整事務所の用に供している国の所有に属する物品であつて農林大臣の指定するものは、当該資材調整事務所の所在する都道府県に讓與するものとする。
4.　Such article owned by the State as for use in Material Adjustment Office and designated by the Minister of Agriculture and Forestry as of April 30, 1950 shall be transferred to To, Do, Fu or prefecture where the Material Adjustment Office concerned is located.
５　農産種苗法（昭和二十二年法律第百十五号）の一部を次のように改正する。
5.　The Agricultural Seeds and Seedlings Law (Law No.115 of 1947) shall be partially amended as follows:
第七條第六項、第九條及び第十一條中「種苗審査会」を「農業資材審議会」に改める。
In Article 7 paragraph 6, Article 9 and Article 11, "Seeds and Seedlings Examination Committee" shall be amended as "Agricultural Materials Investigation Committee" .
第十二條を次のように改める。

６　農薬取締法（昭和二十三年法律第八十二号）の一部を次のように改正する。
6.　The Agricultural Chemical Control Law (Law No.82 of 1948) shall be partially amended as follows:
第二條第三項、第三條第三項、、第四條第二項、第十二條第一項及び第三項並びに第十四條第一項中「農薬審査会」を「農業資材審議会」に改める。
In Article 2 paragraph 3, Article 3 paragraph 3, Article 4 paragraph 2, Article 12 paragraphs 1 and 3, and Article 14 paragraph 1, "Agricultural Chemicals Examination Council" shall be amended as "Agricultural Materials Examination Committee" .
第十六條を次のように改める。
