食糧管理法の一部を改正する法律
Law for Partial Amendment to the Food Management Law
食糧管理法（昭和十七年法律第四十号）の一部を次のように改正する。
The Food Management Law (Law No.40 of 1942) shall be partially amended as follows:
第二條中「（其ノ加工品タル食糧ニシテ農林大臣ノ指定スルモノヲ含ム以下同ジ）」を削る。
In Article 2, "(including processed foods thereof designated by the Minister of Agriculture and Forestry;the same hereinafter)" shall be deleted.
第三條第一項中「、甘藷、馬鈴薯」を削る。
In Article 3 paragraph 1, ", Sweet potato, White potato" shall be deleted.
第三條の次に次の一條を加える。
Next to Article 3, the following one Article shall be added:
第三條ノ二　政府ハ命令ノ定ムル所ニ依リ予算ノ範囲内ニ於テ甘藷又ハ馬鈴薯ノ生産者ニ対シ其ノ生産シタル甘藷又ハ馬鈴薯ニシテ売渡ノ申込ニ依リ政府ノ買入ルルモノヲ予メ指示スルモノトス
Article 3-(2).　The Government shall indicate, in advance, in accordance with the provisions of Order and within the limit of its budgetary appropriations, to the producers of sweet potatoes and white potatoes, those sweet potatoes or white potatoes produced by them which shall be purchased by the Government on application for sale.
政府ハ甘藷又ハ馬鈴薯ノ生産者ガ其ノ生産シタル甘藷又ハ馬鈴薯ニシテ前項ノ規定ニ依ル指示ニ従ヒ命令ノ定ムル所ニ依リ政府ニ売渡ヲ申込ミタルモノヲ買入ルルコトヲ要ス
The Government must purchase those sweet potatoes or white potatoes for which application for sale is made, in accordance with the indication under the preceding paragraph and with the provisions of Order, by the producers of the sweet potatoes or white potatoes.
前項ノ場合ニ於ケル政府ノ買入ノ価格ハ政令ノ定ムル所ニ依リ前條第二項ノ規定ニ依ル米麦等ノ政府ノ買入ノ価格及需給事情ヲ参酌シテ之ヲ定ム
The purchasing price by the Government in the case of the preceding paragraph shall be fixed in accordance with the provisions of Cabinet Order, by taking into consideration the purchasing price by Government of rice, wheat, etc. under the provision of paragraph 2 of the preceding Article as well as supply and demand conditions.
第四條第一項中「米麦等」を「米麦等、甘藷又ハ馬鈴薯」に改める。
In Article 4 paragraph 1, "rice, wheat, etc." shall be amended as "rice, wheat, etc. and sweet potato or white potato."
第五條第一項中「米麦等」を「米麦等、甘藷及馬鈴薯」に改める。
In Article 5 paragraph 1, "rice, wheat, etc." shall be amended as "rice, wheat, etc., sweet potato and white potato."
第八條ノ二第二項中「食糧配給公団及市町村長」を「食糧配給公団、命令ノ定ムル所ニ依リ都道府県知事ノ登録ヲ受ケ主要食糧ノ売渡ノ業務ヲ営ム者（以下販売業者ト称ス）及市町村長」に改める。
In Article 8-(2) paragraph 2, "Food Distribution Kodan and to Mayors of cities, towns and villages" shall be amended as "Food Distribution Kodan, persons engaged in business of selling staple food, having been registered by Governor of To, Do, Fu or prefecture in accordance with the provisions of Order (hereinafter referred to as dealers) and the mayors or headmen of cities, towns and villages."
第八條ノ三第一項中「自己ノ生活上又ハ業務上消費スル者（以下消費者ト称ス）」を「自己ノ生活上若ハ業務上消費スル者（以下消費者ト称ス）又ハ販売業者」に、同條第三項中「消費者」を「消費者又ハ販売業者」に改める。
In Article 8-(3) paragraph 1, "a person who consumes the rationed staple food for self-living or for business purpose (hereinafter referred to as" the consumer ") shall be amended as" a person who consumes the rationed staple food for self-living or for business purpose (hereinafter referred to as the consumer) or dealer ";and in paragraph 3 of the same Article," consumers "shall be amended as" consumers or dealers."
第八條ノ四第一項及び第二項中「食糧配給公団」を「食糧配給公団又ハ販売業者」に、「消費者」を「販売業者又ハ消費者」に改める。
In Article 8-(4) paragraph 1 and paragraph 2, "Food Distribution Kodan" shall be amended as "Food Distribution Kodan or dealers" and "consumers" shall be amended as "dealers or consumers."
第十六條第一項中「一億八千万円」を「二億七千万円」に改める。
In Article 16 paragraph 1, "180,000,000 yen" shall be amended as "270,000,000 yen."
第二十條第一項中「昭和二十五年四月一日」を「昭和二十六年四月一日」に改める。
In Article 20 paragraph 1, "April 1, 1950" shall be amended as "April 1, 1951."
第二十六條中「保管」を「販売、保管」に改める。
In Article 26, "storage" shall be amended as "sale, storage."
第二十七條第二項中「農林次官」を「農林事務次官」に改める。
In Article 27 paragraph 2, "Vice-Minister of Agriculture and Forestry" shall be amended as "Administrative Vice-Minister of Agriculture and Forestry."
附　則
Supplementary Provisions:
１　この法律は、公布の日から施行する。但し、第十六條第一項の改正規定は、昭和二十五年四月一日から施行する。
1.　This Law shall come into force as from the day of its promulgation;provided that the amended provision of Article 16 paragraph 1 shall apply as from April 1, 1950.
２　食糧確保臨時措置法（昭和二十三年法律第百八十二号）の一部を次のように改正する。
2.　The Food Maintenance Temporary Measures Law (Law No.182 of 1948) shall be partially amended as follows:
第二條第一項及び第三條第一項中「、甘しよ、馬鈴しよ」を削る。
In Article 2 paragraph 1 and Article 3 paragraph 1, ", sweet-potato, white-potato" shall be deleted.
