農業災害補償法の一部を改正する法律
Law for Partial Amendments to the Compensation against Agricultural Loss Law
農業災害補償法（昭和二十二年法律第百八十五号）の一部を次のように改正する。
The Compensation against Agricultural Loss Law (Law No.185 of 1947) shall be partially amended as follows:
第十三條の二を次のように改める。
Article 13-(2) shall be partially amended as follows:
第十三條の二　国庫は、昭和二十四年度及び昭和二十五年度において、農業共済組合の組合員の支拂うべき蚕繭共済に係る共済掛金のうち、共済金額を都道府県別に合計した金額に左の率を合計したものを乘じて得た金額の合計に相当する金額を負担する。
Article 13-(2).　The National Treasury shall bear, out of mutual relief premium for the silk-worms and cocoons mutual relief to be paid by the members of the Agricultural Mutual Relief Associations, in the 1949 and 1950 fiscal years, the amount of money corresponding to the total of the amounts of money obtained by multiplying each total sum of mutual relief benefit calculated by each To, Do, Fu or prefecture by the aggregated rate of the following rates:
一　当該都道府県の蚕繭共済に係る第百七條第四項第一号に規定する通常共済掛金標準率から全都道府県の通常共済掛金標準率のうち最低のものを差し引いて得た率の八分の七
(1)　Seven-eighths of the rate obtained by subtracting the minimum one of the ordinary standard rates of mutual relief premium of all To, Do, Fu and prefectures, from the ordinary standard rate of mutual relief premium provided for in Article 107 paragraph 4 item (1) for the silk-worms and cocoons mutual relief in To, Do, Fu or prefecture concerned;
二　当該都道府県の蚕繭共済に係る第百七條第四項第二号に規定する異常共済掛金標準率の八分の七
(2)　Seven-eighths of the extraordinary standard rate of mutual relief premium provided for in Article 107 paragraph 4 item (2) for the silk-worms and cocoons mutual relief in To, Do, Fu or prefecture concerned;
三　当該都道府県の蚕繭共済に係る第百七條第四項第三号に規定する超異常共済掛金標準率
(3)　The super-extraordinary standard rate of mutual relief premium provided for in Article 107 paragraph 4 item (3) for the silkworms and cocoons mutual relief in To, Do, Fu or prefecture concerned.
第十三條の二の次に次の二條を加える。
The following two Articles shall be added next to Article 13-(2):
第十三條の三　国庫は、昭和二十四年度及び昭和二十五年度において農業共済組合の組合員の支拂うべき牛又は馬の死亡廃用共済に係る共済掛金のうち、第百十四條第一項第一号の定款で定める最低の共済掛金の二分の一に相当する金額を負担する。
Article 13-(3).　The National Treasury shall bear, out of mutual relief premium for the death or disuse of cattle or horse to be paid by the members of the Agricultulal Mutual Relief Associations, in the 1949 and 1950 fiscal years, the amount of money corresponding to one half of the minimum mutual relief premium provided for by the Articles of Association under Article 114 paragraph 1 item (1).
第十三條の四　前二條の負担金には、第十二條第二項及び第十三條の規定を準用する。
Article 13-(4).　The provisions of Article 12 paragraph 2 and of Article 13 shall apply mutatis mutandis to the money charged upon the National Treasury under the preceding two Articles.
附　則
Supplementary Provisions:
１　この法律は、公布の日から施行する。
1.　This Law shall come into force as from the day of its promulgation.
２　農業共済再保險特別会計法（昭和十九年法律第十一号）の一部を次のように改正する。
2.　The Agricultural Mutual Relief Re-Insurance Special Account Law (Law No.11 of 1944) shall be partially amended as follows:
第三條中「食糧管理特別会計ヨリノ受入金、農業災害補償法第十三條の二第一項ノ規定ニ依ル負担金」を「一般会計及食糧管理特別会計ヨリノ受入金」に、「（同法第十三條の二第六項ニ於テ準用スル場合ヲ含ム）」を「（同法第十三條の四ニ於テ準用スル場合ヲ含ム）」に改める。
In Article 3, "the receipts from the Food Control Special Accounts;the money prescribed in Art.13-(2) par.1 of the Compensation against Agricultural Loss Law" shall be amended as "the receipts from the General Account and from the Food Control Special Account" and "(including the case whereto the same provision shall apply mutatis mutandis as is prescribed in Art.13-(2) par.6)" shall be amended as "(including the case where the same provision shall apply mutatis mutandis under Article 13-(4) of the same Law)."
第四條中「家畜共済ニ関スル再保險事業経営上ノ再保險料、」の下に「一般会計ヨリノ受入金、」を、「同事業経営上ノ再保險金、」の下に「農業災害補償法第十三條の四ニ於テ準用スル同法第十三條ノ規定ニ依ル交付金、」を加える。
In Article 4, next to "the re-insurance premium accruing from the operation of re-insurance business as regards mutual relief work concerning live stock;" shall be added "the receipts from the General Account;" and next to "the re-insurance money defrayable due to the operation of the said re-insurance business" ;shall be added "the allotment in money under the provision of Article 13 of the Compensation against Agricultural Loss Law which applies mutatis mutandis under Article 13-(4) of the same Law."
