I hereby promulgate the Fisheries Agency Establishment Law.

Fisheries Agency Establishment Law
(Establishment)
Article 1. The Government shall establish the Fisheries Agency as independent organization in the Ministry of Agriculture and Forestry in order to promote the fisheries industry, increase the output of marine products, and thereby contribute to the economic prosperity and also to the stabilization of the nation's livelihood.
The head of the Fisheries Agency shall be the Director of the Fisheries Agency.
(Scope of Authority, Responsibility and Function of the Fisheries Agency)
Article 2. The scope of the functions for which the Agency is responsible shall be the handling and managing the following matters, and the power of the Agency shall be exercised within the scope in compliance with the provisions of a law (inclusive of ordinance authorized by law):
1. Matters relative to the production, circulation, consumption and inspection of marine products and articles exclusively used in fishery (exclusive of matters relative to the production of fishing net and rope, and to the production and inspection of fishing boat and engine for fishing boat).
2. Development. improvement and adjustment of fisheries management.
3. Matters relative to the organization inclusive of co-operative association concerning the development, improvement and adjustment of the production, circulation and other business of marine products.
4. Matters relative to fishing boat insurance and fishing boat registration in compliance with the Fishing Boat Registration Regulations (Prime Minister's Office and the Ministry of Agriculture and Forestry Ordinance No.5 of 1947) and the inspection of boats on request.
5. Matters relative to the guidance and supervision of the technique concerning the design of fishing boat, engine used for fishing boat, machine used for fishing boat and wireless facilities for fisheries.
6. Matters relative to the guidance and aid of the construction and repair of fishing port and moorage.
7. Matters relative to the production, circulation and consumption of ice and to the refrigeration and cold-storage.
8. Matters relative to the experiment, research, investigation and spread in the functions for which the Fisheries Agency is responsible and to the Fisheries College.
9. Besides the matters prescribed in the preceding items, other matters relative to the development, improvement and adjustment of business under the administration of Fisheries Agency.
(Department of the Agency)
Article 3. The Fisheries Agency shall have the following departments:
Fisheries Administration Department
(Fisheries Administration Department)
Article 4. The Fisheries Administration Department shall take charge of the following matters:
1. Matters relative to the development, improvement and adjustment of fisheries management.
2. Matters relative to fisheries industry organization inclusive of co-operative association concerning fisheries.
3. Matters relative to the issuance and registration of fisheries rights and to the licence of fisheries.
4. Matters relative to fishing boat insurance and fishing boat reinsurance separated account and to registration of fishing boat and inspection of fishing boat on request.
5. Matters relative to the guidance and supervision of the technique concerning the design of fishing boat, engine used for fishing boat, machine used for fishing boat, and wireless facilities for fisheries.
6. Matters relative to guidance and aid of construction and repair of fishing port and moorage.
7. Matters relative to mediation of financing to business under the jurisdiction of Fisheries Agency.
8. Matters relative to Fisheries College.
9. Matters relative to personnel, accounting, general affairs and other matters not under the jurisdiction of other departments for which the Fisheries Agency is responsible, provided that matters relative to personnel shall be handled in accordance with the National Public Service Law (Law No.120 of 1947).
(Production Department)
Article 5. The Production Department shall take charge of the following matters:
1. Matters relative to guidance and supervision of coastal fisheries, inland-water fisheries and off-shore fisheries.
2. Matters relative to fisheries propagation.
3. Matters relative to guidance and supervision of production of processed marine products.
4. Matters relative to gathering, distribution, consumption and inspections of marine products.
5. Matters relative to production, circulation and consumption of ice and to refrigeration and coldstorage.
6. Matters relative to allocation and distribution of fuel oil, fishing net and rope and other materials used for fisheries.
7. Matters relative to production (exclusive of matters relating to the production of fishing net and rope and to the production and inspection of fishing boat and engine used for fishing boat), circulation, consumptiou and inspection of materials exclusively used for fisheries.
(Research Department)
Article 6. The Research Department shall take charge of the following matters:
1. Matters relative to planning and compilation of research into fisheries resource.
2. Matters relative to planning and compilation of research into fisheries propagation.
3. Besides matters prescribed in the preceding two items, matters relative to research into fisheries.
4. Matters relative to summerizing and compilation of data concerning fisheries.
5. Matters relative to extentlon of science and technique concerning fisheries.
6. Matters relative to fisheries experimental stations.
(Particulars of Organization)
Article 7. The particulars of organization of the Fisheries Agency shall be regulated by the Minister of Agriculture and Forestry.
(Fisheries Station)
Article 8. The Minister of Agriculture and Forestry may establish the Fisheries Station temporarily, in order to make partial participation in matters relative to adjustment of supply and demand of marine products and to enforeement of Fisheries Law (Law No.58 of 1910).
The name, location, jurisdiction and other necessary matters of the Fisheries Station shall be determined by the Minister of Agriculture and Forestry.
(Officials of the Fisheries Agency)
Article 9. Besides matters regulated in this Law, necessary matters concerning officials set in the Fisheries Agency shall be regulated by Cabinet Order.
Supplementary Provisions:
Article 10. This Law shall come into force as from July 1, 1948.
Article 11. Partial amendment shall be made to the Regulations governing the Organization of the Ministry of Agriculture and Forestry (Imperial Ordinance No.821 of 1943) as follows:
In Article 1, "agricultural, live stock or marine products" and "agricultural, live stock or fisheries industry" shall read "agricultural or live stock products" and "agricultural or live stock industry" .
In Article 3, paragraph 1, "8 bureaus" shall read "7 bureaus" and "Fisheries Bureau" shall be cancelled.
Article 12. Regional Office of Fisheries Bureau existing at the date of enforcement of this Law shall be Fisheries Station in compliance with this Law and continue to exist with identity thereof.
