審議経過

朕は、農地調整法施行令及び自作農創設特別措置法施行令の一部を改正する勅令を裁可し、ここにこれを公布せしめる。
I hereby give My sanction to the Imperial Ordinance concerning the partial amendment to the Imperial Ordinance for the Agricultural Land Adjustment Law and the Owner Farmers Establishment Special Measures Law and cause the same to be promulgated.

Imperial Ordinance No. 25
第一條　農地調整法施行令の一部を次のように改正する。
Article 1.　The following amendments shall partially be made to the Enforcement Ordinance of the Agricultural Land Adjustment Law:
第四十三條但書中「第二十五條ノ六第十三項」を「第二十五條ノ六第十二項及第二十五條ノ十七第三項中吏員トアルハ官吏又ハ吏員、第二十五條ノ六第十三項」に改める。
In proviso of Art. 43, "Art. 25-(6), par. 13" shall read "in Art. 25-(6), par. 12 and Art. 25-(17), par. 3, the term 'officials' means 'government officials or employees', and in Art. 25-(6), par. 13".
第四十六條に左の一項を加える。
Next to Art. 46, the following paragraph shall be added:
市町村ノ廃置分合ニ因リ地区農地委員会ノ地区ヲ区域トスル市、町若ハ村ガ置カレタル場合又ハ市町村ノ廃置分合ニ因リ廃セラレタル市、町若ハ村ノ区域ニ当該区域ヲ地区トスル地区農地委員会ヲ置ク場合ニ於テハ当該市町村農地委員会又ハ地区農地委員会ノ委員ノ選挙ハ第十八條ノ規定ニ拘ラズ之ヲ行フコトヲ要セズ
In case where a city, town or village, the area of which is the same with the sphere of a sphere agricultural land commission, is established in consequence of the abolition, establishment, division or amalgamation of cities, towns or villages, or in case where a sphere agricultural land commission, the sphere of which is the same with the area of city, town or village which was abolished in consequence of the abolition, establishment, division or amalgamation of cities, towns or villages, is establishment, the election of members of the agricultural land commission in city, town or village, or the sphere agricultural land commission needed not be held, in spite of the provisions of Art. 18.
第二條　自作農創設特別措置法施行令の一部を次のように改正する。
Article 2.　The following amendments shall partially be made to the Enforcement Ordinance of the Owner-farmer Establishment Special Measures Law:
第六條中「產業組合、養蚕実行組合その他耕作者の組織する團体で地方長官の指定するもの」を「耕作者の組織する團体で中央農地委員会、都道府縣農地委員会又は市町村農地委員会の指定するもの」に改める。
In Art. 6, "industrial union, sericultural executive union and organizations composed of cultivators designated by a prefectural governor" shall read "organizations composed of cultivators designated by Central Agricultural Land Commission, Agriculture Land Committees of Metropolis, Hokkaido, Special Prefecture or Agricultural Land Commission of City, Town or Village".
第十九條中「農事実行組合、養蚕実行組合その他耕作者の組織する團体で地方長官の指定するもの」を「耕作者の組織する團体で中央農地委員会、都道府縣農地委員会又は市町村農地委員会の指定するもの」に改める。
In Art. 19, "industrial union, sericultural executive union and organizations composed of cultivators designated by a prefectural governor" shall read "organizations composed of cultivators designated by Central Agricultural Land Committee, Agricultural Land Commission of Metropolis, Hokkaido, Special Prefecture or Prefecture or Agricultural Land Commission of City, Town or Village".
第二十六條中「都道府縣農地委員会」の下に「又ハ市町村農地委員会」を加える。
In Art. 26, next to "agricultural land commission of Metropolis, Hokkaido, Special Prefecture or Prefecture" shall be added "agricultural land commission of city, town or village".
第三十一條第二項後段を次のように改める。
The latter part of Art. 31, par. 2 shall be amended as follows:
この場合において、第十二條第二項及び第三項中「都道府縣農地委員会」とあるのは、「地方長官」と、「承認」とあるのは、「認可」と読み替えるものとする。
In this case, in Art. 12, pars. 2 and 3, "agricultural land commission of Metropolis, Hokkaido, Special Prefecture or Prefecture" shall read "prefectural governor" and "approval" shall read "permission".
第四十五條第一項中「又は永小作権を有する者が異なる農地」を「若しくは永小作権を有する者が異なる農地又は所有者の住所が異なる農地」に改める。
In Art. 45, par. 1, "and the agricultural land the owner of which lives in another place" shall be added next to "in regard to the agricultural land of which the ownership, right of lease, right of loan for use, or emphyteusis is divided among several persons".
附　則
Supplementery Provision:
この勅令は、公布の日から、これを施行する。
The present Ordinance shall come into force as from the day of its promulgation.
