Mariner Insurance Special Account Law
Article 1. For the purpose of conducting the mariner insurance business under the Mariner Insurance Law, a special Account shall be established and its revenues shall be devoted to its appropriations.
Article 2. This account shall be administered by the Minister of Welfare in accordance with the laws and ordinances.
Article 3. This account shall be divided into the general insurance sub-account and the unemployment insurance sub-account.
Article 4. In the general insurance sub-account, the revenues shall be the insurance-premiums due to the operation of the insurance business other than the unemployment insurance business in the mariner insurance business, receipts from the general account, receipts from the reserves, borrowing and adjunctive sundry receipts, and the appropriation shall be the expenses for insurance payment due to the operation of the said business, refunds and insterest of borrowings, operation expenses, expenses for sanatoriums, welfare facilities, constructions and repairs of official buildings and other miscellaneous expenses.
Article 5. In the unemployment insurance sub-account, the revenues shall be the insurance-premium due to the operation of the unemployment insurance business in the mariner insurance business, receipts from the general account, receipts from the reserves, borrowings and adjunctive sundry receipts, and the appropriations shall be the insurances due to the operation of the said business, refunds and interest of borrowings, operation expenses, expenses for constructions and repairs of official buildings and other miscellaneous expenses.
Article 6. The general insurance sub-account or the unemployment insurance sub-account shall be authorized to make borrowings on their own account, in case such borrowings are necessary to defray expenses for insurance payment or insurances.
Article 7. Every fiscal year the Minister of Welfare shall draw up the statement of accounting of the estimated revenues and appropriations of this account and send it to the Ministry of Finance.
Article 8. The budget of revenues and appropriations of this account shall be divided into the general insurance and unemployment insurance sub-accounts, and each sub-account shall be classified by titles and items in accordance with the character of the revenues and the object of the appropriations.
Article 9. Every fiscal year the Cabinet shall draw up the budget of this account and submit it to the Diet together with that of the general account.
The budget under the preceding paragraph shall be accompanied with the following documents:
1. The statement of accounting of the estimated revenues and appropriations;
2. The profit and loss account and the balance-sheet for the fiscal year before the preceding one and the detailed table of the reserves at the end of the fiscal year before the preceding one;
3. The estimated profit and loss account and the estimated balance sheet for both the preceding and the proper fiscal year;
Article 10. In each sub-account, any surplus of cash arising in payment can be put in the Deposits Bureau, Ministry of Finance.
Article 11. In the unemployment insurance sub-account, in case cash runs short for payment, temporary borrowings can be made on its own account.
Temporary borrowing under the preceding paragraph shall be redempted within the fiscal year concerned.
Article 12. Ministry of Finance shall manage the business concerning the borrowing and redemption of borrowings under Article 6 and temporary borrowings under the preceding Article.
Article 13. Every fiscal year the Minister of Welfare shall draw up the statement of settlement of the revenues and expenditures of this account by the same classification as the accounting of the estimated revenues and appropriations and send it to the Minister of Finance.
Article 14. Every fiscal year the Cabinet shall draw up the settlement of revenues and expenditures of this account and submit it to the Diet together with the settlement of the revenues and expenditures of the general account.
The settlement of the revenues and expenditures under the preceding paragraph shall be accompanied with the statement of settlement of the revenues and expenditures, the profit and loss account and the balance-sheet for the fiscal year concerned and the statement of accounting of the liabilities.
Article 15. In the general insurance or the unemployment insurance sub-account, any surplus arising in settlement shall be transferred to the reserves of the sub-account concerned.
In the general insurance or the unemployment insurance sub-account, any deficit arising in settlement shall be supplemented from the reserves of the sub-account concerned.
Article 16. The reserves of the general insurance or the unemployment insurance sub-account can be held in the national debts or employed by putting in the Deposit Bureau, Ministry of Finance.
Article 17. In this account those of the estimates of appropriations, disbursement of which is obligated and is not done until the conclusion of accounting for the fiscal year concerned, can be carried forward to and used in the next fiscal year.
The carrying forward under the preceding paragraph shall not require the approval of the Minister of Finance under the provisions of Article 43 of the Finance Law.
The Minister of Welfare, in case he performed carrying forward under Paragraph 1, shall inform it to the Minister of Finance and the Board of Audit.
Article 18. Necessary matters for the enforcement of this Law shall be prescribed by Cabinet Order.
Supplementary Provisions:
Article 19. This Law shall apply from November 1, 1947;provided that the part concerning the ordinary insurance account and the provisions of Articles 24 and 25 of this Law shall come into force as from the day of its promulgation.
Article 20. Mariner insurance business under the provision of Mariner Insurance Law in Article 1, mariner insurance business or unemployment insurance business in Article 5, shall include business to give unemployment dole and insurance to the mariner unemployed during November 1, 1947 to April, 30, 1948.
Insurance in Articles 5 and 6 shall include unemployment dole and insurance in the preceding paragraph.
Article 21. At the time of the enforcement of the provisions of Article 24, reserves and other rights and duties which belong to the mariner sub-account of the Welfare Insurance Special Account, shall be transferred to this account and belong to the general insurance sub-account.
Article 22. The reserves and appropriations of the mariner sub-account of the Special Account for Welfare Insurance for the fiscal year 1947 shall be settled after transferring to the general insurance sub-account of this account.
As regards the drawing up of the settlement under the provisions of the preceding paragraph, the budget of revenues and appropriations, the revenues received and the expenditures disbursed of the said sub-account can be included in the budget of revenues and appropriations, the revenues received and the expenditures disbursed of this account.
Article 23. At the time of the enforcement of the provisions of Article 24 rights and duties concerning the mariner insurance business belonging to the management sub-account of the Special Account for Welfare Insurance, shall be transferred to this account and belong to the general insurance sub-account.
Those of the surplus in settlement of the management sub-account of the Special Account for Welfare Insurance for the fiscal year 1947, which is to be transferred to the reserves of the mariner sub-account, shall be transferred to this account and belong to the general insurance sub-account at the end of settlement for the said fiscal year.
Article 24. A part of the Special Account Law for Welfare Insurance shall be amended as follows:
In Article 1, "the welfare annuity and insurance business and the mariner insurance business" shall read "and the welfare annuity and insurance business."
In Article 2, "the mariner sub-account" shall be deleted.
Article 5 shall be deleted.
In Article 6, "receipts from the mariner sub-account for the purpose of devoting to expenses for business operation, sanatoriums, welfare facilities or constructions and repairs of official buildings of the mariner insurance business" shall be deleted, and "the welfare annuity and insurance business and the mariner insurance business" shall read "and the welfare annuity and insurance business," and "the expenses for welfare facilities and constructions and repairs of official buildings of the welfare annuity and insurance business, and the expenses for sanatoriums, welfare facilities and constructions and repairs of official buildings of the mariner insurance business" shall read "and the expenses for welfare facilities and constructions and repairs of official buildings of the welfare annuity and insurance."
In Article 8, "or the mariner sub-account" shall be deleted.
In Article 9, "the annuity sub-account and the mariner sub-account" shall read "and the annuity sub-account."
Article 11 shall be deleted.
In Article 13, "the annuity sub-account and the mariner sub-account" shall read "and the annuity sub-account."
Article 14. Every fiscal year the Cabinet shall draw up the budget of this account and submit it to the Diet together with that of general account.
Article 25. The provisions of the Former Special Account for Welfare Insurance shall be still effective concerning the surplus in settlement of the management sub-account of the Special Account for Welfare Insurance for the fiscal year 1947, even after the amendment under the preceding Article.
