I hereby promulgate the Law concerning Administration of Properties owned by the State in Consequence of the Operation of the Administrative Agreement under Article III of the Security Treaty between the United States of America and Japan.

Law concerning Administration of Properties owned by the State in Consequence of the Operation of the Administrative Agreement under Article III of the Security Treaty between the United States of America and Japan
(Purpose)
Article 1. This Law shall, for the operation of the Administrative Agreement under Article III of the Security Treaty between the United States of America and Japan (hereinafter to be referred as "Administrative Agreement" ) aim at the establishment of exceptions to maintenance and disposition with respect to properties owned by the State (meaning national properties prescribed in Article 2 of the National Property Law (Law No.73 of 1948) and movable properties and rights owned by the State which do not come under the National Property Law;hereinafter the same) for use of the armed forces of the United States of America (hereinafter referred to as "the United States)" .
(Free Use)
Article 2. The State may, in case it becomes necessary to offer properties owned by the State for use of the United States armed forces in order to carry out the purpose prescribed in Article 1 of the Security Treaty between the United States of America and Japan (hereinafter to be referred as the "Treaty" ), allow the United States to use free the properties concerned while they are in use thereof.
(Waiver of Claims for Restoration)
Article 3. With respect to properties owned by the State allowed to be used free by the United States in accordance with the provision of the preceding Article, the State shall not, when the properties concerned are returned, claim the restoration thereof or compensation to substitute them.
(Allowance of Temporary Use)
Article 4. The State may, as to the properties owned by the State allowed to be used by the United States in accordance with the provision of Article 2, allow Japanese agencies or nationals the use or making profits in accordance with the provision of Article II paragraph 4 (a) of the Administrative Agreement within such extent as will not obstract their use of purpose.
2 In case where properties are allowed to be used or profits in accordance with the provision of the preceding paragraph, the rights to use or to take profits shall be extinct at the time when the United States return the properties concerned.
(Rescission of Loan Contract)
Article 5. The provisions of Article 24 of the National Property Law (including the case where the same applies mutatis mutandis in Article 19 and Article 26 of the same Law) shall apply mutatis mutandis to the case where the United States are allowed to use properties owned by the State in accordance with the provision of Article 2. In this case, "for the National Government or public bodies for public or official use or for the use of National Government enterprise or non-profit undertakings" as mentioned in Article 24 of the National Property Law shall read "for the National Government......... for the use of the United States armed forces"
(Transfer of Jurisdiction, Etc. of the Nationa. Properties Belonging to the Special Account) 1
Article 6. In cases where properties owned by the State belonging to a Special Account is allowed to be used by the United States in accordance with the provision of Article 2, the jurisdiction or administrative control of the properties concerned shall be changed to the General Account or be adjusted as for the use of the General Account.
Supplementary Provision:
This Law shall come into force as from the day of the coming into force of the Treaty.
