I hereby promulgate the Law for Abolition of the Imperial Ordinance concerning the Exclusion, Retirement, Etc. in respect to Public Offices, Etc.

Law for Abolition of the Imperial Ordinance concerning the Exclusion, Retirement, Etc. in respect to Public Offices, Etc.
The following Law and Ordinances shall be abolished:
(1) Imperial Ordinance concerning the Exclusion, Retirement, Etc. in respect to Public Offices (Imperial Ordinance No.1 of 1947);
(2) Ordinance concerning the Certification of Qualification for Candidacy of Member of the House of the Representatives, under Imperial Ordinance No.542 of 1945 concerning the Orders to be Issued in Consequence of the Acceptance of the Potsdam Declaration (Ministry of Home Affairs Ordinance No.2 of 1946);
(3) Imperial Ordinance concerning the Exceptions to Imperial Ordinance No.1 of 1947 (Imperial Ordinance No.61 of 1947);
(4) Order concerning the Special Instances of Article 8 of Imperial Ordinance No.1 of 1947, under Imperial Ordinance No.542 of 1945 concerning the Orders to be Issued in Consequence of the Acceptance of the Potsdam Declaration (Cabinet and Ministry of Home Affairs Ordinance No.5 of 1947);
(5) Ordinance concerning the Removal and Exclusion of Those Falling under the Memorandum provided for in Imperial Ordinance No.1 of 1947 from Office in a District Agricultural Adjustment Committee, a City, Town or Village Agricultural Adjustment Committee and a Local Agricultural Adjustment Committee (Prime Minister's Office and Ministry of Agriculture and Forestry Ordinance No.12 of 1948);
(6) Ordinance concerning Exception to Candidacy of Persons without Certificate of Eligibility (Prime Minister's Office Ordinance No.76 of 1948);
(7) Ordinance concerning Restrictions on Those Persons Falling under the Memorandum issued on the basis of Imperial Ordinance No.1 of 1947 in respect to their Acceptance of the Post of Officers, etc. of Agricultural Cooperative Associations, Federations of Agricultural Cooperative Associations and Fishery Cooperative Associations (Prime Minister's Office and Ministry of Agriculture and Forestry Ordinance No.2 of 1949);
(8) Ordinance concerning the Exclusion of the Persons Falling under the Memorandum, as prescribed in the Provisions of Imperial Ordinance No.1 of 1947, from the Office of Officer of Land Improvement District and League of Land Improvement Districts (Prime Minister's Office and Ministry of Agriculture and Forestry Ordinance No.1 of 1949);
(9) Law concerning Release from the Designation of a Person Falling under the Memorandum under the Provisions of the Imperial Ordinance relating to the Exclusion, Retirement, Etc. in respect to Public Offices (Law No.268 of 1951).
Supplementary Provisions:
1 This Law shall come into force as from the day of the first coming into force of the Treasty of Peace with Japan.
2 Those who are subjected to the application of the provision of Article 5 paragraph 1 of the Imperial Ordinance concerning the Exclusion, Retirement, Etc. in respect to Public Offices (Imperial Ordinance No.1 of 1947) at the time of enforcement of this Law, shall, except the cases provided for by other laws and orders separately, acquire the right or qualification to receive public or private pension, annuity, other allowance or benefit on the day of enforcement of this Law. Matters necessary in this case shall be provided for by Cabinet Order.
3 With regard to the application of penal provisions to the acts committed prior to the enforcement of this Law, the old provisions shall still prevail.
4 The Prime Minister's Office Establishment Law (Law No.127 of 1949) shall be partially amended as follows:
Article 6 paragraph 1 item (15) shall be amended as follows:
In the table of Article 15 paragraph 1, the paragraph of the Council for Examination of Appeals on Qualification for Public Office shall be deleted.
5 The Attorney-General's Office Establishment Law (Law No.193 of 1947) shall be partially amended as follows:
In Article 1 paragraph 3, "matters concerning the custody, etc. of the properties vested in the National Treasure in accordance with the provisions of the Cabinet Order concerning the Custody and Disposition, Etc. of the Properties of Dissolved Organizations (Cabinet Order No.238 of 1948), and matters concerning the investigation of activity, etc. of persons who have been designated as falling under the provisions of the Memorandum in accordance with the provisions of the Imperial Ordinance relating to the Exclusion, Retirement, Etc. in respect to Public Offices (Imperial Ordinance No.1 of 1947)" shall be amended as "and matters concerning the custody, etc. of the properties vested in the National Treasury in accordance with the provisions of the Cabinet Order concerning the Custody and Disposition, Etc. of the Properties of Dissolved Organizations (Cabinet Order No.238 of 1948)" .
Article 7 paragraph 3 item 3 shall be amended as follows:
6 The Public Offices Election Law (Law No.100 of 1950) shall be partially amended as follows:
Article 199 item (3) shall be deleted.
Article 248 paragraph 2 shall be deleted.
In Article 250, "Article 248 paragraph 1" shall be amended as "Article 248" .
