ポツダム宣言の受諾に伴い発する命令に関する件に基く通商産業省関係諸命令の措置に関する法律をここに公布する。
I hereby promulgate the Law for Disposition of Orders under the Ministry of International Trade and Industry Based on the Imperial Ordinance concerning the Orders to be Issued in Consequence of the Acceptance of the Potsdam Declaration.

Law for Disposition of Orders under the Ministry of International Trade and Industry Based on the Imperial Ordinance concerning the Orders to be Issued in Consequence of the Acceptance of the Potsdam Declaration
（連合国人工業所有権戦後措置令の一部改正）
(Partial Amendments to the Order for Post-War Dispositions of Industrial Property Rights Owned by Allied Nationals)
第一條　連合国人工業所有権戦後措置令（昭和二十四年政令第三百九号）の一部を次のように改正する。
Article 1.　The Order for Post-War Dispositions of Industrial Property Rights Owned by Allied Nationals (Cabinet Order No.309 of 1949) shall be partially amended as follows:
第三條第一項、第十六條の二、第十八條の二第一項、第十八條の三及び第十八條の四中「連合国最高司令官の指示に従い」を削る。
In Article 3 paragraph 1, Article 16-(2), Article 18-(2) paragraph 1, Article 18-(3) and Article 18-(4), "in accordance with instructions of the Supreme Commander for the Allied Powers" shall be deleted.

(Partial Amendments to the Cabinet Order concerning Special Dispositions of Industrial Property Rights Owned by German Nationals)
第二條　ドイツ人工業所有権特別措置令（昭和二十五年政令第四号）の一部を次のように改正する。
Article 2.　The Cabinet Order concerning Special Dispositions of Industrial Property Rights Owned by German Nationals (Cabinet Order No.4 of 1950) shall be partially amended as follows:
第一條第一項第四号並びに第四條第一項及び第二項中「連合国最高司令官の指示に基き」を削る。
In Article 1 paragraph 1 item (4) and Article 4 paragraph 1 and paragraph 2, "in accordance with the instructions of the Supreme Commander for the Allied Powers" shall be deleted.

(Partial Amendments to the Order for Post-War Measures relating to Trade Marks Owned by Allied Nationals)
第三條　連合国人商標戦後措置令（昭和二十五年政令第九号）の一部を次のように改正する。
Article 3.　The Order for Post-War Measures relating to Trade Marks Owned by Allied Nationals (Cabinet Order No.9 of 1950) shall be partially amended as follows:
第十八條の二、第二十一條第一項及び第二十二條中「連合国最高司令官の指示に従い」を削る。
In Article 18-(2), Article 21 paragraph 1 and Article 22, "in accordance with instructions of the Supreme Commander for the Allied Powers" shall be deleted.

(Orders to Continue in Force in the Future)
第四條　前三條に規定する命令及び左に掲げる命令の規定は、日本国との平和條約の最初の効力発生の日以後も、法律としての効力を有するものとする。
Article 4.　The provisions of the Orders provided for in the preceding three Articles and the Orders enumerated hereunder shall continue in force as laws after the day of the first coming into force of the Treaty of Peace with Japan:
一　兵役法廃止等に関する件（昭和二十年勅令第六百三十四号）附則第三項
(1)　Papagraph 3 of the Supplementary Provisions of the Imperial Ordinance concerning the Abolition, Etc. of the Military Service Law (Imperial Ordinance No.634 of 1945);
二　重要産業団体令を廃止する等の勅令（昭和二十一年勅令第四百四十六号）附則第三項及び第四項
(2)　Paragraphs 3 and 4 of the Supplementary Provisions of the Imperial Ordinance concerning the Abolition, Etc. of the Important Industrial Organization Ordinance (Imperial Ordinance No.446 of 1946);
三　輸出振興のための外貨資金の優先使用に関する政令を廃止する政令（昭和二十六年政令第二百四十一号）附則第二項
(3)　Paragraph 2 of the Supplementary Provisions of the Cabinet Order for Abolition of the Cabinet Order concerning the Use of Authorized Foreign Exchange Credit for Promotion of Export (Cabinet Order No.241 of 1951);

(Abolition of Orders)
第五條　左に掲げる命令は、廃止する。
Article 5.　The following Orders shall be abolished:
一　連合国人の特許発明等の実施状況調査に関する勅令（昭和二十二年勅令第三十六号）
(1)　The Imperial Ordinance concerning the Investigation of Use of Patented Inventions and others Owned by the United Nations Nationals (Imperial Ordinance No.36 of 1947);
二　重要物資在庫緊急調査令（昭和二十三年政令第六十五号）
(2)　The Order for the Urgent Investigation of Inventories of Critical Materials (Cabinet Order No.65 of 1948);
三　特定標章の使用の禁止等に関する政令（昭和二十四年政令第三百二十九号）
(3)　The Cabinet Order concerning the Prohibition of Use of Specially Designated Marks, etc.(Cabinet Order No.329 of 1949);
四　財閥標章の使用の禁止等に関する政令（昭和二十五年政令第八号）
(4)　The Cabinet Order concerning the Prohibition, Etc. of Use of Zaibatsu Marks (Cabinet Order No.8 of 1950);
五　工鉱業関係会社の事業報告書に関する件（昭和二十年農林省令、商工省令第一号）
(5)　The Ordinance concerning Business Report of Industrial and Mining Companies (Ministries of Agriculture and Forestry and Commerce and Industry Ordinance No.1 of 1945);

(6)　The Ordinance concerning Report on Survey of Crude Rubber, Nickel Bullion, Tin Bullion or Antimony Bullion, under the Imperial Ordinance No.542 of 1945 concerning Orders to Be Issued of Consequence of the Acceptance of the Potsdam Declaration (Ministry of Commerce and Industry Ordinance No.10 of 1946);
七　昭和二十年勅令第五百四十二号「ポツダム」宣言ノ受諾に伴ヒ発スル命令ニ関スル件に基く絹織物及び絹メリヤス生地の検査及び蒐荷に関する件（昭和二十一年商工省令第十七号）
(7)　The Ordinance concerning the Inspection and Collection of Silk Fabrics and Knitted Silk Fabrics under the Imperial Ordinance No.542 of 1945 concerning the Orders to Be Issued in Consequence of the Acceptance of the Potsdam Declaration (Ministry of Commerce and Industry Ordinance No.17 of 1946);
八　鉛の調査報告に関する件（昭和二十一年商工省令第二十四号）
(8)　The Ordinance concerning the Investigation Report of Lead (Ministry of Commerce and Industry Ordinance No.24 of 1946);
九　化学肥料の緊急増産に関する件（昭和二十一年商工省令第二十六号）
(9)　The Ordinance concerning the Emergency Increasing Production of Chemical Fertillizer (Ministry of Commerce and Industry Ordinance No.26 of 1946);
十　パイプ類臨時措置規則（昭和二十一年商工省令第四十九号）
(10)　The Regulation for Temporary Measures on Pipes and the like (Ministry of Commerce and Industry Ordinance No.49 of 1946).
（廃止した命令に関する経過規定）
(Transitional Provisions of the Abolished Orders)
第六條　この法律の施行前旧特定標章の使用の禁止等に関する政令第二條の規定に違反してした登録については、この法律の施行後も、なお従前の同令第三條の例による。
Article 6.　With respect to the registrations made in violation of the provisions of Article 2 of the old Cabinet Order concerning the Prohibition of the Use of Specially Designated Marks prior to the enforcement of this Law, the old provisions of Article 3 of the same Cabinet Order shall still prevail even after the enforcement of this Law.
第七條　この法律の施行前旧財閥標章の使用の禁止等に関する政令第五條の規定に違反してした登録については、この法律の施行後も、なお従前の同令第六條の例による。
Article 7.　With respect to the registrations as made in violation of provisions of Article 5 of the old Cabinet Order concerning the Prohibition of the Use of the Zaibatsu Marks prior to the enforcement of this Law, the old provisions of Article 6 of the same Cabinet Order shall still prevail even after the enforcement of this Law.
第八條　この法律の施行前にした行為に対する罰則の適用については、この法律の施行後も、なお従前の例による。
Article 8.　With respect to the application of penal provisions to acts committed prior to the enforcement of this Law, the old provisions shall still prevail even after the enforcement of this Law.
第九條　前三條に定めるものを除く外、この法律の施行に伴い必要な経過的措置は、政令で定める。
Article 9.　Other than those provided for in the preceding three Articles, transitional measures necessary in consequence of the enforcement of this Law shall be provided for by Cabinet Order.
附　則
Supplementary Provision:
この法律は、日本国との平和條約の最初の効力発生の日から施行する。
This Law shall come into force as from the day of the first coming into force of the Treaty of Peace with Japan.
