Law for Partial Amendments to the Law concerning Travel Expenses for National Public Service Personnel and Others
The Law concerning Travel Expenses for National Public Service Personnel and Others (Law No.114 of 1950) shall be partially amended as follows:
In the Contents,"Articles 31-45"shall be amended"Articles 31-45-(2)".
In Article 1 paragraph 2,"the Kodan established by laws and orders", and"the Japanese Government Corporation for Housing of Allied Personnel"shall be deleted.
In Article 2 paragraph 1 item (1),"the Presidents or Chairmen of the Kodan established by laws and orders,"and"the Chairman of the Japanese Government Corporation for Housing of Allied Personnel"shall be deleted;item (2) of the same paragraph shall be made item (3) of the same paragraph;and the numbering of the subsequent items shall be moved down by one;and the following one item shall be added next to item (1) of the same paragraph:
(2) The term"Prime Minister, etc. "means the Prime Minister, the Chief Justice of the Supreme Court, employees whose appointment or dismissal requires the attestation of the Emperor, and employees enumerated in Article 1 items (4) to (15) inclusive of the Law concerning Compensation for National Public Service Personnel in the Special Government Service (Law No.252 of 1949) and such persons in positions corresponding thereto as may be designated by the Chief of each Agency upon consultation with the Minister of Finance;
In Article 2 paragraph 3,"(or the whole area of special wards (ku) in case of To)"shall be amended as"(or the whole area of special wards in case of the special wards of To)";and the following proviso shall be added to the same paragraph:
Provided, however, that the words"official duty place"as used herein shall mean the area within 8 kilometers from the office.
In Article 3 paragraph 2 item (6),"in case the employee dies"shall be amended as"in case the employee serving in a foreign country dies";and the following one item shall be added to the same paragraph:
(8) The employee, in case he who is authorized to travel home upon leave of absence as provided for in the Foreign Public Service Law (Law No.41 of 1952), travels between his official duty place and this country.
In Article 6 paragraph 1,"outfit allowance and"shall be amended as"outfit allowance, sundry travel expense and";in paragraph 9 of the same Article,"household goods"shall be amended as"domicile or residence", in paragraph 10 of the same Article,"travel to newly assigned office"shall be amended as"removal of residence in connection with a travel to newly assigned office", in paragraph 12 of the same Article,"temporary duty travel to or travel to newly assigned office in a foreign country"shall be amended as"temporary duty travel or travel to newly assigned office in a foreign country from this country or between foreign countries";in paragraph 15 of the same Article,"For foreign travel"shall be amended as"For such foreign travel as provided for in Article 41 paragraph 1", and"may be paid"shall be amended as"shall be paid";paragraph 13 of the same Article shall be made paragraph 14 of the same Article;and the unmbering of the subsequent paragraphs shall be moved down by one;and the following one paragraph shall be added next to paragraph 12 of the same Article:
13 Sundry travel expense shall be supplied in the amount actually required for sundry expenses in connection with temporary duty travel to or travel to newly assigned office in a foreign country.
In Article 11,"per diem allowance or lodging expense"shall be amended as"per diem allowance or lodging expense (including such part of dependents'transfer expense as corresponding to these travel expenses;hereinafter the same in this Article)".
Article 16 paragraph 1 item (1) a) shall be amended as follows:
a) As for the Prime Minister, etc. and employees in positions of the grade 11 or higher, the fare of the first class.
The following one paragraph shall be added to Article 16:
3 In cases where it is found difficult to travel by using the railway fare and express charge provided for in the preceding two paragraphs due to the particular circumstances in the said travel, such railway fare and express charge as decided by the Chief of each Agency upon consultation with the Minister of Finance may be paid.
In Article 17 paragraph 1 item (1) a),"the grade 8"shall be amended as"the grade 11";and in the same item b),"the grade 7"shall be amended as"the grade 10".
Article 24 shall be amended as follows:
(After-arrival Expenses)
Article 24. The amount of after-arrival expense shall be the amounts equivalent to the amount for five days of the fixed amount of per diem allowance in Annexed Table No. I and to the amount for five nights of the fixed amount of lodging expense in the same Table according to the classification of the area covering the place to which a domicile or residence is removed in connection with travel to newly assigned office.
In Article 25 paragraph 1 item (1) c),"they shall be regarded as one dependent and an amount equivalent to one half of such railway fare as is payable to the employee at the same time shall be added for such a dependent"shall be amended as"an amount equivalent to one half of such railway fare and passage fare payable to the employee at the very time shall be added for every one of dependents";and the following one item shall be added next to the same paragraph:
(3) In the cases of computing the amount of per diem allowance, lodging expense, boarding expense and after-arrival expense in accordance with the provisions of item (1) a) to item c), if fractions less than one yen are produced in the amount, they shall be cut off.
In the portions other than those enumerated in each of the items of Article 27,"travel expenses as provided for in the item concerned and"shall be amended as"travel expenses as provided for in the item concerned or";in item (2) of the same Article,"the amount of actual expenses required which shall not exceed"shall be amended as"the amount equivalent to one half of", and in item (3) of the same Article,"one of the items of Article 28 paragraph 1"shall be amended as"Article 28 paragraph 1 item (2) or (3)".
Article 28 paragraph 1 item (3) shall be amended as follows:
(3) In case an employee who was ordered to travel to his newly assigned office is directed to reside in the Government housing quarters for the employees or to vacate it and removes his domicile or residence, transfer expense in the amount equivalent to one-third of the fixed amount of transfer expense in Annexed Table No. I which is supplied in the case of travel by railway for less than fifty kilometers (the amount equivalent to one half of the said amount, if he accompanies no dependent);provided, however, that if fractions less than one yen are produced in computing the said amount of transfer expense, they shall be cut off.
In Article 32 item (1),"more than two classes"shall be amended as"two classes", the same item shall be made item (2) of the same Article;and the numbering of the subsequent items shall be moved down by one;and the following one item shall be added as item (1) next to the same Article:
(1) In the case of travel on a railway line of which fare is graded by more than three classes, the fare shall be in accordance with the following classification:
a) As for the Prime Minister, etc. and employees in positions of the grade 7 or higher, the fare of the highest class;
b) As for employees in positions of the grade 6 or lower, the fare of the first lower class next to the highest class;
Article 33 item (1) shall be amended as follows:
(1) In the case of travel by ship of which fare is graded by more than two classes, the fare of the highest class shall be allowed, and in the case of travel by ship of which the fare of the highest class is further divided by two or more, the fare shall be allowed in accordance with the following classification:
a) In the case of travel by ship of which the fare of the highest class is divided by four or more, the fare of the highest class in that class as for the Prime Minister, etc., the fare of the first lower class next to the highest class as for employees is positions of the grades 11 to 15 inclusive, the fare of the first lower class next to the class of such fare as is allowable to employees in positions of the grades 11 to 15 inclusive, as for employees in positions of the grades 7 to 10 inclusive, and the fare of the lowest class as for employees in positions of the grade 6 or lower;
b) In the case of travel by ship of which the fare of the highest class is divided by three, the fare of an upper class in that class as for the Prime Minister, etc., the fare of a middle class as for employees in the grades 11 to 15 inclusive, and the fare of a lower class as for employees in the grade 10 or lower;
c) In the case of travel by ship of which the fare of the highest class is divided by two, the fare of an upper class in that class as for the Prime Minister, etc. and the fare of a lower class as for other persons.
Article 35 paragraph 2 shall be made paragraph 3 of the same Article;paragraph 3 of the same Article shall be made paragraph 4 of the same Article;and the following one paragraph shall be added next to paragraph 1 of the same Article:
2 The amount of lodging expense supplied in case of paying charge for sleeping berth accommodations in accordance with the provision of Article 32 item (5) shall be the amount equivalent to 70% of the fixed amount in Annexed Table No. II according to the classification of the travel destination, regardless of the provision of the preceding paragraph.
In Article 39 paragraph 2"a travel to his newly assigned office in or a temporary duty travel to a foreign country"shall be amended as"a temporary duty travel to or a travel to his newly assigned office in a foreign country from this country", and the following one paragraph shall be added to the same Article:
3 The amount of outfit allowance supplied in cases where an employee serving in a foreign country is ordered to travel to a newly assigned office in or to travel on a temporary duty to other foreign country shall be a sum not exceeding the amount obtained by deducting an aggregate amount of outfit allowances previously received, from the fixed amount of such allowance prescribed for the area covering the place of temporary duty travel or the new official duty place, regardless of the provision of paragraph 1.
The following one Article shall be added next to Article 39.
(Sundry Travel Expense)
Article 39-(2). Sundry travel expense shall be supplied in the amount actually paid by travellers for preventive injection, fee for delivery and visa of a passpost and commission for exchange of foreign currencies and head tax.
Article 41 shall be amended as follows:
(Travel Allowance)
Article 41. Travels for which the travel allowance is paid instead of the travel expenses mentioned in Article 6 paragraph 1 shall be travels for the surveillance of whaling or fishing and such other travels as may be designated by the Minister of Finance upon his decision that it is inappropriate to supply for them travel expenses by the fixed amounts in Annexed Table No. II due to particular circumstances in the travel destination.
2 The amount of travel allowance, and conditions and procedures of its payment shall be determined on each occasion by the Chief of each Agency upon consultation with the Minister of Finance;provided that the said amount shall not exceed the standard rate prescribed by this Law with respect to the amounts of the travel expenses stipulated in Article 6 paragraph 1, according to the nature of the travel.
In Chapter III, the following one Article shall be added next to Article 45:
(Travel Expenses for Return Home upon Leave of Absence)
Article 45-(2). Travel expense supplied in accordance with the provision of Article 3 paragraph 2 item (8) shall be such travel expenses as are computed, following the instance of temporary duty travel, for travel on both ways between an employee's official duty place and the place of his agency in this country.
2 In the case under the preceding paragraph, if the employee accompanies his dependent at the time of the said travel for return home upon leave of absence, travel expense computed in line with the provision of Article 38 paragraph 2 (excluding such portion corresponding to after-arrival expense and outfit allowance) shall be added to the travel expenses under the preceding paragraph.
Paragraphs 4 to 7 inclusive of the Supplementary Provisions shall be deleted, paragraph 8 of the Supplementary Provisions shall be made paragraph 4 of the Supplementary Provisions;and the numbering of the subsequent paragraphs up to paragraph 10 of the Supplementary Provisions shall be moved up by four;and paragraph 11 of the Supplementary Provisions shall be deleted.
Annexed Tables No. I to No. III inclusive shall be amended as follows:

Note: In the columns of Lodging expenses the A area means the areas for which the highest rate of the area allowance is paid under the provision of Article 12 of the Law concerning Compensation of Employees in the Regular Government Service and the B area includes the other areas. Lodging other than one in fixed lodging accommodations shall be regarded as lodging in the B area.

Notes:
1. The classification of area shall be the same one prescribed for per diem allowance and lodging expense.
2. As to the expense for disposal and transportation of the dead, the death on travel by ship shall be regarded as the death in the B area, and the death on travel by air shall be regarded as the death in the area covering the place of its destination.
Supplementary Provisions:
1 This Law shall come into force as from the day of its promulgation and shall apply to travels on and after April 1, 1952.
2 As for the amounts of transfer expense and outfit allowance (including such portion of dependents'transfer expense as corresponding to these travel expenses) for the travel starting on or before March 31, 1952, the old provisions shall still prevail.
