(Partial Amendments to the Customs Tariff Law)
第一條　関税定率法（明治四十三年法律第五十四号）の一部を次のように改正する。
Article 1.　The Customs Tariff Law (Law No.54 of 1910) shall be partially amended as follows:
附則に次の二項を加える。
The following two paragraphs shall be added to the Supplementary Provisions:
小学校又ハ盲学校、聾学校若ハ養護学校ノ小学部若ハ保育所ノ児童ノ給食ノ用ニ供スル乾燥脱脂ミルクノ輸入税ハ命令ノ定ムル手続ニ依リ昭和二十八年三月三十一日迄ノ輸入ニ付テハ之ヲ免除ス
Import duty on dried skimmed milk intended for school lunches for children of primary schools, of schools for the blind, for the deaf, or the otherwise, handicapped and of nurseries shall, with respect to importation until March 31, 1953, be exempted in accordance with the provisions prescribed by Order.
前項ノ規定ニ依ル輸入税ノ免除ヲ受ケタル乾燥脱脂ミルクヲ輸入シタル者ガ当該ミルクヲ同項ニ規定スル給食ノ用ニ供セザリシ場合ニハ政府ハ其ノ者ヨリ国税徴収ノ例ニ依リ輸入税ヲ追徴ス但シ変質其ノ他止ムヲ得ザル事由ニ因リ其ノ用ニ供シ得ザリシコトニ付税関長ノ承認ヲ受ケタル場合ハ此ノ限ニ在ラズ
In cases where any person, who has imported the dried skimmed milk duty-exemption under the provision of the preceding paragraph, fails to use such milk for school lunches as provided for in the same paragraph, the Government shall collect from such person the import duties, by following the practices in the collection of national taxes;provided, however, that this provision shall not apply in cases where recognition by the Superintendent of Customs concerned is obtained of the fact that such failure is due to the deterioration of such milk or some other uncontrollable cause.
別表輸入税表第三百十一号品名の欄中「車糖」を「車糖、でん粉を加えた粉糖及びこれらに類するもの」に改め、同号税率の欄中「一割」を「二割」に、「二割」を「三割五分」に改め、同表第三百十二号税率の欄中「二割五分」を「三割五分」に改め、同表第三百十三号税率の欄中「一割」を「二割」に、「二割」を「三割五分」に改め、同表第三百十六号税率の欄中「三割五分」を「四割」に改め、同表第三百十七号税率の欄中「三割」を「四割」に改める。
In the "Description" column of item 311 of the Import Tariff Schedule, Annexed Table, "soft sugar" shall be amended as "soft sugar, powdered sugar mixed with starch, and the like" ;in the "Rated of Duty" column of the same item, "10" and "20" shall be amended as "20" and "35" respectively;in the "Rates of Duty" column of item 312 of the same Table, "25" shall be amended as "35" ;in the "Rates of Duty" column of item 313 of the same Table, "10" and "20" shall be amended as "20" and "35" respectively;in the "Rates of Duty" column of item 316 of the same Table, "35" shall be amended as "40" ;and in the "Rates of Duty" column of item 317 of the same Table, "30" shall be amended as "40" .

第二條　関税定率法の一部を改正する法律（昭和二十六年法律第百十号）の一部を次のように改正する。
Article 2.　The Law for Partial Amendments to the Customs Tariff Law (Law No.110 of 1951) shall be partially amended as follows:
附則第五項中「別表甲号に掲げるものの輸入税は、昭和二十七年三月三十一日」を「別表甲号に掲げるものの輸入税は、昭和二十八年三月三十一日（別表甲号第千百一号に掲げる印刷用紙にあつては、昭和二十七年九月三十日）」に、「別表乙号に掲げるものの輸入税は、昭和二十七年三月三十一日」を「別表乙号に掲げるものの輸入税は、昭和二十八年三月三十一日」に改め、同項別表甲号中「
五一九 炭化水素油（別号に掲げるものを除く。）
　一　原油、重油及び粗油
」を「

In paragraph 5 of the Supplementary Provisions, "1952" shall be amended as "1953" ;and the following shall be added as Notes of the Table A:

Notes:
１　この表において「重油」とは、炭化水素油で摂氏十五度における比重が〇・八七六二をこえ、且つ、引火点が摂氏百十五度をこえないもので、一般に燃料として使用されるもの及び原油を蒸りゆうしてできたかま残油をいう。
1.　The term "heavy oils" as used in this Table shall mean hydrocarbon oils of specific gravity not lower than 0.8762 at 15属C., having flash point not lower than 115属C., and commonly used for fuel, and residue oils obtained in the distillation of raw oil.
２　この表において「船舶」とは、総とん数千五百とんをこえる鉄鋼船をいう。
2.　The term "vessels" as used in this Table shall mean those vessels which are of iron and steel and of not less than 1,500 tons gross.
附則第五項別表乙号炭化水素油の項税率の欄中「二割」を「備考の税率」に改め、同表合成染料の項税率の欄中「二割」を「一割五分」に改め、同表に備考として次のように加える。
In the "Tariff Rate" column of the item for Hydrocarbon Oils (n. o. p. f.) in Table B of paragraph 5 of the Supplementary Provisions, "20%" shall be amended as "the duty rate provided by Note hereto" ;and the following shall be added as Note in the same Table:
この表の炭化水素油の項乙その他に該当するものについての税率は、摂氏十五度における比重が〇・八七六二をこえず、且つ、引火点が摂氏百十五度をこえないもので、一般に燃料として使用されるものについては、一割とし、その他のものについては、二割とする。
As regards hydrocarbon oils classified as Hydrocarbon Oils, B. Others, in this Table, the duty rate on those hydrocarbon oils of specific gravity not lower than 0.8762 at 15属C., having flash point not lower than 115属C. and used commonly for fuel, shall be 10% ad valorem, and that on hydrocarbon oils other than those shall be 20% ad valorem.
附則第六項中「昭和二十七年」を「昭和二十八年」に改める。
In paragraph 6 of the Supplementary Provisions, "1952" shall be amended as "1953" .
附　則
Supplementary Provision:
この法律は、昭和二十七年四月一日から施行する。
This Law shall come into force as from April 1, 1952.
