Law for Navigation Order for Mass Repatriation Transportation of Japanese Nationals from Abroad
(Navigation Order)
Article 1. The Minister of Transportation may, in case he deems it necessary to make a navigation for mass repatriation transportation of Japanese nationals from abroad and it is difficult to secure a person engaged in the navigation concerned under contract, order a person operating ship-operation business to be engaged in the navigation concerned, designating routes and vessels.
2 The Minister of Transportation may order the person engaged in a navigation by the order as prescribed in the preceding paragraph to equip the vessels concerned with facilities necessary for the navigation concerned.
3 The person engaged in a navigation by the order under paragraph 1 shall obey the instructions of the Minister of Transportation concerning the said navigation.
(Compensation for Damage)
Article 2. The National Government shall compensate the person engaged in a navigation by the order under the preceding Article for any damage normally to accrue from the performance of the order under paragraph 1 or 2 of the same Article (including a damage, to accrue from the fact that such a profit as might have normally been obtained if such order had not been accepted, was not obtained).
2 Necessary matters for the compensation for the damage as referred to in the preceding paragraph shall be provided for by Cabinet Order.
(Penal Provisions)
Article 3. Any person who has not obeyed an order under the provisions of Article 1 shall be punished with penal servitude for a period not exceeding six (6) months or a fine not more than one hundred thousand (100,000) yen.
Article 4. In case any representative of a juridical person or a proxy, an employee or any other worker of a juridical or natural person commits a voilating act of the provision of the preceding Article for the business of the said juridical or natural person, not only the offender but the juridical or natural person concerned shall be liable to a fine under the same Article;provided that this shall not apply to the said juridical or natural person, in case it is proved that due care and supervision have been exercised in connection with the business of the said juridical or natural person in order to prevent such violation by the proxy, employee or other worker thereof.
Supplementary Provisions:
(Date of Enforcement)
1 This Law shall come into force as from April 1, 1952.
2 The Ministry of Transportation Establishment Law (Law No.157 of 1949) shall be partially amended as follows:
Article 23 paragraph 2 item (4) shall be amended as follows:
(4) Mass repatriation transportation by vessel of Japanese nationals from abroad;
