Law for Partial Amendments to the Imperial House Economy Law
The Imperial House Economy Law (Law No.4 of 1947) shall be partially amended as follows:
Article 2 shall be amended as follows:
Article 2. In any of the cases specified below, a property may be alienated to, or received by, the Imperial House, or a gift can be made therefrom without authorization by the Diet each time:
1. Sale or purchase for reasonable price and other ordinary private economic transactions.
2. Giving or receiving of properties by the Imperial House within the limit of a certain amount in value as fixed by law separately during the period from April 1 of each year to March 31 of the following year, excepting the cases of the preceding item.
Article 6 shall be amended as follows:
Article 6. The Imperial Family Appropriations shall apply to the sums which are provided as annuities to the members of the Imperial Family as well as those which are provided as one time payments to be made to the members of the Imperial Family on the occasion when they newly establish their independent households for the maintenance of their dignity, and those which are provided as one time payments to be made to the persons who leave the status of the Imperial Family member in accordance with the provisions of the Imperial House Law, at the time of their leaving the status, for the maintenance of dignity as persons who have been members of the Imperial Family. The sums of such annuities or one time payments shall be calculated on the basis of a fixed sum as determined by law separately.
In the case of the preceding paragraph, the Imperial Family members'new establishment of their independent households shall previously be authorized by the Imperial House Economy Council.
The annuities shall be calculated according to the provisions stipulated in the following items and in paragraphs 4 and 5;and they shall be paid annually to the members of the Imperial Family other than those specified in Article 4 paragraph 1:
1. Shinno who have their independent households shall receive the whole of the fixed sum.
2. The consorts of the Shinno mentioned in the preceding item shall receive one half of the fixed sum.
3. Naishinno who have their independent households shall receive one half of the fixed sum.
4. Shinno, their consorts, and Naishinno who have not their independent households shall receive sums corresponding to 10 per cent of the fixed sum.
5. O, their consorts, and Jo-o shall receive sums corresponding to 70 per cent of the amount of the annuities calculated respectively on the basis of Shinno, their consorts, and Naishinno mentioned in each of the preceding items.
The member of the Imperial Family who is the Regent shall receive 3 times the fixed sum during the term of his office.
A person, possessing more than one status, shall be paid according to the status commanding he highest annuity.
A member of the Imperial Family who newly establishes his or her independent household shall receive a sum in one time payment corresponding to twice the amount of the annuity calculated on the basis of a member of the Imperial Family who has his or her independent household.
A person who leaves the status of the member of the Imperial Family shall receive a sum in one time payment, as determined by the Imperial House Economy Council, and within the limit of the amount mentioned in the following items:
1. A person who leaves the status of the member of the Imperial Family according to the provisions of Article 11, Article 12 and Article 14 of the Imperial House Law shall receive a sum corresponding to 10 times the amount of the annuity calculated on the basis of a mumber of the Imperial Family who has his or her independent household.
2. A person who leaves the status of the member of the Imperial Family according to the provisions of Article 13 of the Imperial House Law shall receive a sum corresponding to 10 times the amount of the annuity calculated in accordance with the provisions of paragraphs 3 and 5. In this case, a member of the Imperial Family who has reached full age shall be considered as a member of the Imperial Family who has his or her independent household.
The provisions of Article 4 paragraph 2 shall apply mutatis mutandis to the Imperial Family Appropriations.
The provisions of Article 4 paragraphs 3 and 4 shall apply mutatis mutandis to the fixed sums stipulated in paragraph 1.
In Article 11 paragraph 2, "the Vice Minister of Finance" shall be amended as "the Administrative Vice-Minister of Finance" .
Supplementary Provisions:
1 This Law shall come into force as from April 1, 1952.
2 As regards the application of Article 6 paragraph 3 of the Imperial House Economy Law, as amended, a married Shinno at the time of the enforcement of this Law shall be considered as a Shinno who has his independent household.
3 As regards the application of Article 6 paragraph 3 of the Imperial House Economy Law, as amended, an unmarried Shinno or Naishinno at the time of the enforcement of this Law shall be considered as a Shinno or Naishinno who has not his or her independent household.
