Law for Partial Amendments to the Special Procurement Agency Establishment Law
The Special Procurement Agency Establishment Law (Law No.129 of 1949) shall be partially amended as follows:
Article 5 shall be amended as follows:
(Internal Subdivisions)
Article 5. The Special Procurement Agency shall have the Director's Secretariat and the following four Divisions:
Financial Division
Operation Division
Property Division
Labor Division
Article 6 shall be amended as follows:
(Special Positions)
Article 6. The Special Procurement Agency shall have a Deputy Director, who shall assist the Director and regulate the affairs of the Agency.
2 The Special Procurement Agency shall have an Advisor who shall participate in the administration of important affairs of the Agency.
3 The Director's Secretariat shall be headed by Chief of Secretariat, who shall, under orders, administer the affairs of the Secretariat.
4 The Director's Secretariat shall have an Inspector, who shall, under orders, administer the general affairs pertaining to the inspection of the affairs of the Agency.
5 Each Division shall have a Deputy Chief, who shall assist the Chief of Division and regulate the affairs of the Division.
Article 7 item (13) shall be amended as follows:
(13) Inspection of the affairs of the Agency.
Article 9 shall be amended as follows:
(Operation Division)
Article 9. The Operation Division shall take charge of the following affairs:
(1) Planning on procurement (excluding the procurement of real properties and movable properties appended thereto;hereinafter the same in this Article) under the termination of war expenses other than the overhead expenses, and estimating expenses required;
(2) Execution of contracts for procurement under the termination of war expenses other than the overhead expenses;
(3) Expenditing, inspecting and examining the performance of construction work supply of services and delivery of supplies;
(4) Assistance in furnishing materials required for construction work, services and applies.
Artiele 10 shall be amended as follows:
(Property Division)
Article 10. The Property Division shall take charge of the following affairs:
(1) Procurement of real properties (including movable properties appended thereto;hereinafter the same in this Article) under the termination of war business expenses, and appraisal of such properties;
(2) Custody, restitution and appraisal of real properties released from the demand of the Allied Forces;
(3) Compensating incidental to the procurement of real properties, and compensating and claiming compensations incidental to the restitution of such properties;
(4) Registration of real properties;
(5) Custody, receipt and delivery, transportation and sale of supplies, and execution of contracts therefor;
(6) Disposition of the matters incidental to the procurement of construction work, services, supplies and real properties.
Article 12 shall be amended as follows:
(Labor Division)
Article 12. The Labor Division shall take charge of the affairs regarding the laborers required by the Occupation Forces.
In Article 12-(2), "Entertainments Procurement Council" shall be deleted.
Article 12-(3) shall be amended as follows:
(Service Procurement Council)
Article 12-(3). The Service Procurement Council (hereinafter referred to as "the Service Council" ) shall be an organ to make research and deliberation, in response to the inquiries of the Director of the Special Procurement Agency, on the management of procured hotels, etc., and the services procurement for entertainments.
2 The Service Council shall consist of the Director of the Special Procurement Agency and fortyeight or less than forty-eight councillors.
3 The Director of the Special Procurement Agency shall preside over the business of the Council as its chairman.
4 The councillors shall be appointed by the Director of the Special Procurement Agency from among personnel of government organs concerned as well as other civil persons with special knowledge and experience on management of hotels, etc., and on entertainments.
Article 12-(5) shall be deleted;in Article 12-(G), "the preceding three. Articles" shall be amended as "the preceding two Articles" , and the same Article shall be made Article 12-(5).
Supplementary Provision:
This Law shall come into force as from June 1, 1951.
