Law for Partial Amendments to the Fishing Boat Insurance Law
The Fishing Boat Insurance Law (Law No.23 of 1937) shall be partially amended as follows:
In Article 1 paragraph 2, Article 31 and Article 35 paragraph 3, "Imperial Ordinance" shall be amended as "Cabinet Order" .
The following one Article shall be added next to Article 17:
Article 17-(2). The Association shall make good any loss of an insured fishing boat resulting from war, disturbance or other similar incidents as determined by Cabinet Order only in case a special contract has been made between the Association and the owner of the fishing boat.
Even if the special contract mentioned in the preceding paragraph has been made, the Association shall not be responsible for making good any loss resulting from navigation or fisheries operation made by the fishing boat in violation of laws or orders.
The following one Article shall be added next to Article 18:
Article 18-(2). In the following cases, any member of the Fishing Boat Insurance Association may apply for payment of the whole amount of the insurance money to the said Association by abandoning his insured fishing boat to the said Association:
(1) In case the fishing boat has sunk;
(2) In case the fishing boat is missing;
(3) In case the fishing boat has be come unrepairable;
(4) In case the fishing boat is not released for thirty days from seizure, capture or internment.
The following one paragraph shall be added to Article 22-(4):
In cases where any order for alteration of the Articles of Association as prescribed in Article 26 is given, with respect to the rate of insurance premium for the insurance under any special contract mentioned in Article 17-(2), the alteration of the Articles of Association shall take effect, regardless of the provisions of the preceding three paragraphs, as determined by such order.
In Article 28 paragraph 2, "Articles 631 to 640" shall be amended as "Articles 631 to 639" and "Article 833 items (1) to (3)" shall be deleted and "and in the provision of Article 836 paragraph 2, Article 833 items (1), (3) and (4) shall read Article 18-(2) items (1) and (3) of the Fishing Boat Insurance Law" shall be added to the proviso to Article 28 paragraph 2.
Supplementary Provision:
This Law shall come into force as from the day of its promulgation.
