Law for Partial Amendments to the Mail Law
The Mail Law (Law No.165 of 1947) shall be partially amended as follows:
Article 5 paragraph 2 shall be amended as follows:
No person or legal entity shall operate a private service of the conveyance and delivery of letters of others. Any person who is employed by two or more persons or legal entities and consecutively conveys and delivers letters of such persons or legal entities shall be regarded as a person who operates a private service of the conveyance and delivery of letters of others.
The following one paragraph shall be added next to Article 5 paragraph 3:
No person or legal entity shall entrust the conveyance and delivery of letters to any persons or legal entities who, contrary to the provisions of paragraph 2, operate a private service of the conveyance and delivery of letters, or entrust the conveyance and delivery of letters (except those mentioned in the proviso to the same paragraph) to persons or legal entities referred to in the preceding paragraph.
In Article 13 paragraph 2, "The Prime Minister and the Minister of Postal Services are authorized to prescribe by Ministerial Ordinance" shall be amended as "The Minister of Postal Services and the President of Economic Stabilization Board are authorized to prescribe by Ordinance."
In Article 17 paragraph 1 item 1, "4 kilograms" shall be amended as "6 kilograms," and item 2 of the same paragraph shall be amended as follows:
2. Parcel post
Size: Not more than 110 centimeters in length, and 2 meters in length, breadth and depth combined
Weight: 6 kilograms
Article 19 shall be amended as follows:
Article 19.(Mailing of Cash and Valuable Articles) Cash, or valuable metals, precious stones or other valuable articles designated by the Minister of Postal Services, when presented for mailing, shall be acceptable only as registered matter.
In Article 20 paragraph 1, "Revenue Stamps" shall be amended as "'Inshi'(Revenue Stamps, and Unemployment Insurance Stamps)."
In Article 22 paragraph 1, "two classes shall be deleted and" and reply-paid "shall be amended as" , reply-paid, and parcel post cards (which are attached to the outside of parcels for the simultaneous conveyance and delivery), "in paragraph 2 of the same Article," and 4 yen for replypaid post cards "shall be amended as" , 4 yen for reply-paid post cards and 3 yen for parcel post cards,"and the proviso to paragraph 3 of the, same Article shall be amended as follows:
However, single and reply-paid post cards may be, in accordance with the provisions of Ministerial Ordinance, manufactured privately in conformity to the size, quality and form for single or reply-paid post cards prescribed by the Minister of Postal Services.
The following two paragraphs shall be added next to Article 22 paragraph 5:
Parcel post cards may not be mailable unless they are attached to parcels bearing the names and addresses or residence of the sender and addressee same as those of such post cards.
As regards parcel post cards, the special services provided for in Chapter V shall not be applicable.
Article 23 paragraph 5 shall be amended as follows:
For application for the sanction referred to in paragraph 2, the applicant must pay 1,200 yen.
The following two paragraphs shall be added to Article 23:
When the application for the sanction referred to in the preceding paragraph has been made, the Minister of Postal Services must notify within the following periods from the date of the application as to whether he shall give the sanction:
1.Daily publications
One month
2.Others
Two months
The sanction on third-class matter shall be effective for publications issued on and after the day on which the sanction was given.
In Article 28 paragraph 3, "the preceding two paragraphs" shall be amended as "the preceding paragraph."
The following shall be inserted as the latter part to Article 30 paragraph 2:
In this case, "other article" in paragraph 1 of the same Article shall read "articles other than parcel post cards."
Article 31 shall be amended as follows:
Article 31.(Rates of Postage) The rates of postage on parcel post shall be fixed as follows, varying with the zones shown in the attached table:
1. Parcels destined for the first zone
a. Those sent or received only within one and the same delivery district, within the ward limits in the Metropolis, or within one and the same city, town or village 25 yen up to 2 kilograms in weight and 15 yen for each additional 2 kilograms or fraction thereof
b. Others
35 yen up to 2 kilograms in weight and 15 yen for each additional 2 kilograms or fraction thereof
2. Parcels destined for the second zone
45 yen up to 2 kilograms in weight and 15 yen for each additional 2 kilograms of fraction thereof
3. Parcels destined for the third zone
55 yen up to 2 kilograms in weight and 15 yen for each additional 2 kilograms or fraction thereof
In Article 32 paragraph 3, "currency" shall be amended as "cash," "currency, the amount of which corresponds to more than three times" shall be amended as "cash, or negotiable instruments (only those designated by the Minister of Postal Services), the amounts of which correspond to not less than two times" , and the following one paragraph shall be added next to the same paragraph:
The security referred to in the preceding paragraph shall not be required for government and public offices and for public corporations (Kodan, Eidan and Kosha), and public treasuries (Kinko and Koko), established by special laws as well as for The Japanese National Railways and The Bank of Japan.
The following one Article shall be added next to Article 32:
Article 32-(2).(Payment of Postage by Addressee) For letters and post cards, for which any person who shall take their delivery has obtained an approval from the Ministry of Postal Services and on which face are described the number of the approval given by the Ministry of Postal Services and the words to the effect that they shall be paid the postage by such person, in accordance with the provisions of Ministerial Ordinance, the sender shall not be required to pay the postage, only when such letters or post cards are deposited for mailing addressed to such person if not intended for any special service.
As regards the letters and post cards deposited for mailing in accordance with the provisions of the preceding paragraph, any person who shall take their delivery must pay the postage together with a fee of 1 yen per article at the time of delivery.
In Article 38 item 3, "(excluding registration and insurance fees)" shall be amended as "(excluding registration fee)," in item 4, "a post office box" shall be amended as "a post office box used continuously for one year or more" and the following one item shall be added next to the same item:
5. Half the charge paid at the time when an application for sanction was made in case an information was received to the effect that the sanction for third-class mail matter is not given.
In Article 39, "as well as from the date when the information was received from the Minister of Postal Services to the effect that the sanction is not given, as regards the charges mentioned in item 5 of the same Article" shall be added next to "item 4 of the same Article."
In Article 43 paragraph 2 item 2,

In Article 44 paragraph 2, ", insurance" shall be deleted.
Article 50 paragraph 2 shall be amended as follows:
The period of use of and the rent for a post office box shall be fixed as shown in the following table:

In Article 53 paragraph 1, "For registered or insured letter mail or a parcel" shall be amended as "For parcels or registered letter mails," and "or insurance" shall be deleted.
In Article 57, "insurance," shall be deleted.
Articles 58 and 59 shall be amended as follows:
Article 58.(Registration) As regards registration, the Ministry of Postal Services shall record matters from acceptance to delivery, and in case loss of or damage to the mail matter occurs in transmission, shall pay wholly or in part the claimable amount of indemnity which was informed to the Ministry of Postal Services by the sender at the time of mailing.
In case the articles which are the contents of the mail matter are cash, the claimable amount of indemnity referred to in the preceding paragraph shall be equivalent to the amount of the cash and not exceed 50,000 yen.
In case the articles which are the contents of the mail matter are other than cash, the claimable amount of indemnity referred to in paragraph 1 shall exceed neither the current value of the articles nor 500,000 yen.
If, in the case of the preceding paragraph, the sender did not inform the claimable amount of indemnity referred to in paragraph 1 because it was difficult for him to value the articles, the amount shall be regarded as informed by him to be 1,000 yen.
The registration fees shall be fixed as follows:
1. In case the articles which are the contents of the mail matter are cash
When the amount of cash does not exceed 1,000 yen: 70 yen
When the amount of cash exceeds 1,000 yen: Amount of 70 yen plus the amount computed at the rate of 10 yen for each 1,000 yen or fraction thereof over 1,000 yen
2. In case the articles which are the contents of the mail matter are other than cash
When the claimable amount of indemnity does not exceed 1,000 yen: 30 yen
When the claimable amount of indemnity exceeds 1,000 yen: Amount of 30 yen plus the amount computed at the rate of 1 yen for each 2,000 yen or fraction thereof over 1,000 yen
Article 59. Deleted.
In Article 60 paragraph 2, "letter mail" shall be amended as "mail matter" and in paragraph 3 of the same Article, "20 yen" shall be amended as "20 yen for letter mail or 30 yen for parcel post."
In Article 61 paragraph 2 and Article 62 paragraph 2, "or insurance" shall be deleted.
In Article 64 paragraph 2, "or insurance" shall be deleted and in paragraph 3 of the same Article, "50,000 yen" shall be amended as "500,000 yen."
In Article 68 paragraph 1 item 1, "or insured" shall be deleted, and paragraph 2 of the same Article shall be amended as follows:
The amounts of indemnity in the cases of the preceding paragraph shall be fixed as follows:
1. For the whole loss of any registered matter
Amount informed (amount of actual loss not exceeding 1,000 yen, in the case of Article 58 paragraph 4)
2. For the whole or partial damage to or partial loss of any registered matter
Amount of actual loss not exceeding the amount informed
3. In case any C. O. D. mail was handed over to the addressee without collecting C. O. D. charges

In Article 76 paragraph 1, "ten thousand yen" shall be amended as "one hundred thousand yen."
In Articles 77 and 78, "five thousand yen" shall be amended as "fifty thousand yen."
In Article 79, "two thousand yen" shall be amended as "twenty thousand yen."
In Article 80 paragraph 1, "two thousand yen" shall be amended as "twenty thousand yen," and in paragraph 2 of the same Article, "five thousand yen" shall be amended as "fifty thousand yen."
In Article 81, "five thousand yen" shall be amended as "fifty thousand yen."
The following one Article shall be added next to Article 81:
Article 81-(2).(Offense of Unlawful Utilization of Mail Service) Whoever, with intent to defraud, threat or extort, shall deposit or cause others to deposit for mailing mail matter bearing the address, location, residence, name, proper name and title, or correspondence, which is contrary to the truth, shall be subject to a fine not more than fifty thousand yen, or a minor fine.
In Article 82, "three thousand yen" shall be amended as "thirty thousand yen."
In Article 83 paragraph 1, "two thousand yen" shall be amended as "twenty thousand yen," and in paragraph 2 of the same Article, "five thousand yen" shall be amended as "fifty thousand yen."
In Article 85 paragraph 2, "one thousand yen" shall be amended as "ten thousand yen."
Supplementary Provisions:
1 This Law shall come into force as from June 1, 1951.
2 Mail matter deposited for mailing, applications made for the sanction for third-class mail matter and the punishment of any act done prior to the enforcement of this Law, shall be governed by the previous Law.
