Law for Partial Amendments to the Ministry of Transportation Establishment Law, Etc.
Article 1. The Ministry of Transportation Establishment Law (Law No.157 of 1949) shall be partially amended as follows:
In the Contents, "Chapter V Kodan (Article 62)" shall be deleted.
The following one item shall be added next to Article 4 paragraph 1 item (32):
(32-2) To nominate railway security agents and supervise the functions relating to the criminal investigation carried out by railway security agents;
The following three items shall be added next to Article 4 paragraph 1 item (44):
(44-2) To aid the international tourist industry;
(44-3) To make examination on guide business;
(44-4) To register hotels and inns to renovate facilities for accommodation of tourists from abroad.
In Article 4 paragraph 2 item (1), "the Civilian Merchant Marine Committee (Sempaku Un-eikai)" shall be amended as "the Civilian Merchant Marine Committee (Shosen Kanri Iinkai)" and item (2) of the same paragraph of the same Article shall be amended as follows:
(2) To give approval in regard to employment of vessels employed in overseas trade;
Article 4 paragraph 2 item (3) shall be amended as follows:
(3) Deleted.
In Article 6 item (3), "(excluding the time charterage by the Civilian Merchant Marine Committee)" shall be deleted.
The following one Article shall be added next to Article 15:
(Examiner)
Article 15-(2). The Transportation Council shall have examiners to let them preside at the public hearing under the following Article for finding facts and to give assistance for the execution of administrative affairs under the jurisdiction of the Transportation Council.
2 The examiner shall be appointed from among the personnel of the Ministry of Transportation.
The following five Articles shall be added next to Article 16:
(Presiding of Public Hearing)
Article 16-(2). The public hearing shall be presided at by one or more examiners designated by the Transportation Council for a designated case. However, the Transportation Council shall not be precluded to preside at a public hearing by itself or to designate one or more members of the Transportation Council to preside at a public hearing, when the case is of special importance.
(Preparation of Report)
Article 16-(3). The member of the Council designated under the provision of the preceding Article or the examiner shall prepare a report of the facts which were found through examinations at the public hearing and submit it to the Transportation Council.
(Presentation of Report to the Public)
Article 16-(4). The Transportation Council shall present the report under the preceding Article to the interested persons designated thereby. However, this shall not apply to the case where the interested persons have, at the public hearing, consented to the unnecessity of the presentation of the report.
(Filing)
Article 16-(5). In case the interested persons who have received the report under the preceding Article deem that there exist errors in the report, the interested persons may state to that effect within fifteen days from the day when they received the report.
(Review)
Article 16-(6). In case the Transportation Council deems that there exist errors in the report and they would exert influences upon the decision of the Transportation Council, after examining the statement made under the preceding Article, the Transportation Council shall hold a public hearing again.
In Article 18 paragraph 1, "The decision of the Transportation Council" shall be amended as "The decision of the Transportation Council and the report under Article 16-(3)" .
In Article 23 paragraph 2 item (2), "the Civilian Merchant Marine Committee (Sempaku Un-eikai)" shall be amended as "the Civilian Merchant Marine Committee (Shosen Kanri Iinkai)" .
Article 24 paragraph 2 item (2) shall be amended as follows:
(2) Deleted.
The following one item shall be added next to Article 27 paragraph 1 item (2):
(2-2) Performance of duty, status, remuneration and promotion of Welfare of the officials and employees of the Japanese National Railways;
Article 27 paragraph 1 item (5) shall be amended as follows:
(5) Designation of railway security agents, and supervision over their functions, and railway judicial police;
In Article 34 paragraph 2, "at Honjo-mura, Muko-gun, Hyogo Prefecture" shall be amended as "in Kobe-shi" .
In the Table of Article 38 paragraph 1, the item of Time-charterage Rates Committee shall be deleted.
In Article 40 paragraph 2 item (1), "the Civilian Merchant Marine Committee (Sempaku Un-eikai)" shall be amended as "the Civilian Merchant Marine Committee (Shosen Kanri Iinkai)" .
Chapter V shall be deleted.
Article 2. The National Government Organization Law (Law No.120 of 1948) shall be partially amended as follows:
In the column of "Kodan" in the Annexed Table No.1, "Sempaku (Vessels) Kodan" shall be deleted.
Supplementary Provisions:
1 This Law shall come into force as from the day of its promulgation.
2 Regardless of the provision of Article 16-(2) of the Ministry of Transportation Establishment Law which was amended by this Law, public hearings held by the Transportation Council may be presided at by one or more members of the Transportation Council designated by the Transportation Council until March 31, 1952.
