Law for Partial Amendments to the Law concerning Provisional Measures for Subsidy by Treasury for Disasters Rehabilitation Works Expenses for Facilities of Agriculture, Forestry and Fishery
The Law concerning Provisional Measures for Subsidy by Treasury for Disasters Rehabilitation Works Expenses for Facilities of Agriculture, Forestry and Fishery (Law No.169 of 1950) shall be partially amended as follows:
Article 2 paragraph 2 item (1) shall be amended as follows, and next to "to their original state" in paragraph 5 of the same Article, shall be added "(including to make necessary facilities for the restoring of the former use of the said agricultural land, etc. in case it is impossible to restore into the original status)" :
(1) Preventive facilities for devastation of forest land (excluding the facilities which are managed and maintained by the local public bodies or organs thereof under laws and orders;hereinafter the same);
Article 3 shall be amended as follows:
(Works to be Subsidized and the Rate of Subsidy)
Article 3. The State may, within the limit of budgetary appropriations, give a subsidy to those who carry out the disasters rehabilitation works on the agricultural land, etc.(with respect to the fishing port facilities, limited to those under the maintenance and custody of fisheries cooperative associations) for a part of its works expenses.
2 The rate of subsidy granted by the State in accordance with the provision of the preceding paragraph shall be classified as follows:
(1)
Concerning agricultural land:50% of works expenses of the said disasters rehabilitation works;
(2)
Concerning agricultural facilities:65% of works expenses of the saidd isasters rehabilitation works;
(3)
Concerning forestry facilities:
a. Preventive facilities for devastation of forest land:65% of works expenses of the said disasters rehabilitation works;
b. Forest road:
i. Inaccessible trunk forest road:
65% of works expenses of the said disasters rehabilitation works;
ii. Other forest roads
:50% of works expenses of the said disasters rehabilitation works;
(4)
Concerning fishing port facilities:65% of works expenses of the said disasters rehabilitation works.
3 With respect to the amount exceeding that to be required in case of restoring the facilities which have suffered from disasters to the original status thereof (hereinafter referred to as "excessive works expenses" ) out of the expenses for works prescribed in paragraph 6 of the preceding Article, the rate of subsidy to be granted by the State in accordance with the provision of paragraph 1 shall be, regardless of the provision of the preceding paragraph, classified as follows:
(1)Concerning agricultural land
:In Hokkaido, 45% of excessive works expense;
In To, Fu or prefecture, 40% of excessive works expenses;
(2)Concerning agricultural facilities:
50% of excessive works expenses;
(3)Concerning forestry facilities:
a. Preventive facilities for devastation of forest land
:50% of excessive works expenses;
b. Forest road
:In Hokkaido, 40% of excessive works expenses;
In To, Fu or prefecture, 60% of excessive works expenses concerning inaccessible trunk forest road;30% of excessive works expenses concerning other forest roads;
(4)Concerning fishing port facilities
In Hokkaido, 60% of excessive works expenses;
In To, Fu or prefecture, 40% of excessive works expenses.
Article 5 item (9) shall be deleted.
Supplementary Provision:
This Law shall come into force as from April 1, 1951.
