Law for Partial Amendment to the Seamen's Insurance Law
The Seamen's Insurance Law (Law No.73 of 1939) shall be partially amended as follows:
In Article 23-(4) paragraph 1, ", 49-(7)" shall be added next to "42 through 42-(3)" , and in paragraph 2 of the same Article, "funeral expenses or a lump sum prescribed in Articles 36, 37, 42 through 42-(3) or 50-(6)" shall be amended as "funeral expenses or a lump sum prescribed in the preceding paragraph" and "the preceding paragraph" as "the same paragraph" , and in paragraph 3 of the same Article, "Article 23-(2) paragraph 2," as "the proviso to Article 23-(2) paragraph 1," .
Article 23-(5) shall be amended as follows:
Article 23-(5). If there is no survivor coming within the provisions of parapraph 1 of the preceding Article, a survivor eligible for funeral expenses or a lump sum payment prescribed in the same paragraph of the same Article shall be a person who was supported by an insured person or a person formerly insured at the time of the latter's death;provided, however, that if there are two or more such survivors and one of them has been designated by the will of the insured person or the person formerly insured or by such person's previous notice to the Minister of Welfare, such designated person shall be the survivor eligible for such funeral expenses or lump sum payment.
Next to "due to a non-occupational cause" in Article 36, "before he is granted an old age pension" in Article 37 paragraph 1, "due to a non-occupational cause" in Article 42, and "attributable to such sickness or injury" in Article 42-(3) paragraph 1, "(or if a child who was a fetus at the time of his death is still-born)" shall be added.
Next to "If a person" in Article 42-(2) paragraph 1 and "If an insured person" in Article 49-(2), "(except a person who comes within Article 34 item (2),)" shall be added.
Article 50-(3) shall be amended as follows:
Article 50-(3). If the surviving spouse entitled to the survivor's pension has children within the scope of survivors eligible for the survivor's pension, an amount equal to 10 times the average daily standard remuneration (2,400 yen in case of paragraph 1 item (4) of (5) of the preceding Article) for each of such children shall be granted in addition to the amount prescribed in each paragraph of the preceding Article.
If there are two or more children entitled to the survivor's pension, an amount equal to 10 times the average daily standard remuneration (2,400 yen in case of paragraph 1 item (4) or (5) of the preceding Article) for each of such children except the first child shall be granted in addition to the amount prescribed in each paragraph of the preceding Article.
In Article 51 paragraph 2, "a survivor's pension" shall be amended as "the survivor's, widow's, widower's or surviving child's pension" .
Supplementary Provisions:
1 This Law shall come into force as from April 1, 1951.
2 Regardless of the provisions of Article 27-(3) paragraph 1, the average standard monthly remuneration which is the basis for the calculation of the amount of the old age pension shall be, for the time being, the average standard monthly remuneration of the insured term of coverage on and after April 1, 1946.
3 Regardless of the provisions of Article 27-(3) paragraph 4, the average standard daily remuneration which is the basis for the calculation of the amount of the old age pension shall be, for the time being, 1/30 of the average, standard monthly remuneration prescribed in the preceding paragraph.
4 Regardless of the provisions of Article 35, if the amount of an old age pension calculated on the basis of the average monthly standard remuneration or average daily standard remuneration prescribed in the preceding two paragraphs exceeds 24,000 yen, the amount of such old age pension shall be 24,000 yen.
