I hereby promulgate the Law for Partial Amendments to the Bonded Warehouse Law and the Bonded Manufacturing Warehouse Law.

Law for Partial Amendments to the Bonded Warehouse Law and the Bonded Manufacturing Warehouse Law
(Partial Amendments to the Bonded Warehouse Law)
Article 1. The Bonded Warehouse Law (Law No.15 of 1897) shall be partially amended as follows:
The following one paragraph shall be added to Article 18:
Any person who has obtained the permission under the preceding paragraph shall, in accordance with what may be prescribed by Cabinet Order, make payment of the permission fee at the rate as prescribed by Cabinet Order on the basis of the permitted period and the number of customs officials who are to be despatched in accordance with the provisions of Article 101-(8) of the Customs Law.
Article 20 shall be amended as follows:
Article 20. The proprietor of a private bonded warehouse shall have every responsibility for the payment of import duties on the foreign goods stored therein except in cases where such goods have been destroyed or lost by disaster while storing therein or destroyed on the approval of the custom house.
In Article 21, "or national bonds" shall be amended as "national bonds, or such debentures as are deemed secure by the superintendent of customs" .
In Article 31, "a fine not exceeding three hundred yen" shall be amended as "a fine not exceeding thirty thousand yen" .
In Article 32, "a fine not exceeding one hundred yen" shall be amended as "a fine not exceeding ten thousand yen" .
Article 33 shall be amended as follows:
Article 33. When a representative of a juridical person, or an agent or employee or other workers of a juridical person or an individual has perpetrated the offences under the preceding two Articles in connection with the business or property of such juridical person or individual, not only the perpetrator shall be punished, but also the juridical person or individual shall be punished with a fine under respective Articles.
Article 34 shall be deleted, and in Article 34-(2) "proviso to paragraph 3 of Article 38, paragraph 2 of Article 39, Article 40, Article 41," shall be deleted;and the same Article shall be made Article 34, and Article 34-(3) shall be made Article 34-(2).
(Partial Amendments to the Bonded Manufacturing Warehouse Law)
Article 2. The Bonded Manufacturing Warehouse Law (Law No.4 of 1927) shall be partially amended as follows:
The following two paragraphs shall be added to Article 8:
Any person who has obtained the permission under the preceding paragraph shall, in accordance with what may be prescribed by Cabinet Order, make payment of the permission fee at the rate as prescribed by Cabinet Order on the basis of the permitted period and the number of the customs officials who are to be despatched in accordance with the provisions of Article 101-(8) of the Customs Law.
The superintendent of customs may, when he deems it especially necessary for the development of the processing deal trade, reduce or remit the permission fee under the preceding paragraph in accordance with what may be prescribed by Cabinet Order.
In Article 12, "a fine not exceeding three hundred yen" shall be amended as "a fine not exceeding thirty thousand yen" .
In Article 13, "a fine not exceeding one hundred yen" shall be amended as "a fine not exceeding ten thousand yen" .
Article 14 shall be amended as follows:
Article 14. When a representative of a juridical person, or an agent or employee or other workers of a juridical person or an individual has perpetrated the offences under the preceding two Articles in connection with the business or property of such juridical person or individual, not only the perpetrator shall be punished, but also the juridical person or individual shall be punished with a fine under the respective Articles.
Article 15 shall be deleted;and in Article 16, "proviso to paragraph 3 of Article 38, paragraph 2 of Article 39, Article 40, Article 41" shall be deleted;and Article 16 shall be made Article 15;and Article 17 shall be made Article 16.
Supplementary Provisions:
1 This Law shall come into force as from April 1, 1951.
2 In the application of penal provisions to the offences committed prior to the enforcement of this Law, the old provisions shall still prevail.
