Law for Abolition of the Special Measures on Unjustly Possessed Materials, Etc. Special Account Law, Etc.
The Laws undermentioned shall be abolished:
The Special Measures on Unjustly Possessed Materials, Etc. Special Account Law (Law No.36 of 1948)
The Law concerning the Payment in Registered National Bonds of the Value of Unjustly Possessed Materials, Etc.(Law No.35 of 1948)
Supplementary Provisions:
1 In this Law, the provision of paragraph 2 of the Supplementary Provisions shall come into force as from the day of its promulgation, and other provisions, as from April 1, 1951.
2 The Government may make the General Account responsible for redemption and interest payments for the registered national bonds that have been issued by March 31, 1951 in accordance with the provision of Article 4 paragraph 1 of the former Law concerning the Payment in Registered National Bonds of the Value of Unjustly Possessed Materials, Etc.(hereinafter to be referred to as "the former Law" ), unless an amount corresponding to an amount necessary for such payments have been transferred from the Special Measures on Unjustly Possessed Materials, Etc. Special Account to the National Debt Consolidation Fund Special Account by the preceding date, regardless of the provisions of Article 5 paragraph 1 of the Special Measures. on Unjustly Possessed Materials, Etc. Special Account Law (hereinafter to be referred to as "the formor Special Account Law" ).
3 In the Special Measures on Unjustly Possessed Materials, Etc. Special Account, in case there is any surplus obtained by deducting the total disbursed amounts of annual expenditures (excluding the transfer to the General Account) from the total received amounts of annual revenues in the fiscal year 1950-51, the said surplus shall be transferred to the revenues of the General Account of the fiscal year 1950-51.
4 As regards the settlement of accounts of the Special Measures on Unjustly Possessed Materials, Etc. Special Account of the fiscal year 1949-50, the former procedures shall still be effective;and as regards the receipt and payment of the same Special Account of the fiscal year 1950-51 and the settlement of accounts of the same Special Account of the same fiscal year, the former procedures, excluding those under the provisions of Article 7 of the former Special Account Law, shall still be effective.
5 The assets and liabilities belonging to the Special Measures on Unjustly Possessed Materials, Etc. Special Account at the time of the conclusion of receipt and payment of the fiscal year 1950-51 of the same Special Account, shall belong to the General Account.
6 Of the value of the unjustly possessed materials provided for in Article 1 of the Regulations governing the Utilizations of Surplus Materials, Etc.(Prime Minister's Office Ordinance, Attorney-General's Office Ordinance, Ministries of Foreign Affairs, Finance, Education, Welfare, Agriculture and Forestry, Commerce and Industry, Transportation, Communications, and Labor Ordinance No.2 of 1948;hereinafter to be referred to as "the Regulations" ) based upon the Temporary Demand and Supply Adjustment Law (Law No.32 of 1946), which have been taken over by the Government before the enforcement of this Law in accordance with the provisions of Articles 2 to 4 inclusive of the Regulations, as regards the payment of the value the settlement of which has not been completed by the time of the enforcement of this Law and as regards the registered national bonds to be delivered for the payment therefor, the former Law shall be still effective.
7 The registered national bonds to be issued under the provision of Article 4 paragraph 1 of the formar Law, still effective in accordance with the provision of the preceding paragraph, shall be the responsibility of the General Account.
