Law for Partial Amendments to the Law concerning the Government Housing for the National Public Service Personnel
The Law concerning the Government Housing for the National Public Service Personnel (Law No.117 of 1949) shall be partially amended as follows:
The heading of Article 8 shall be amended as "(Overall Adjustment concerning the Establishment of Housing, Etc.)" ;paragraph 2 of the same Article shall be deleted;and next to the same Article shall be added the following two Articles:
(Establishment of Housing)
Article 8-(2). The Minister of Finance shall establish housing for the national public service personnel based on the plan of establishment to be prescribed by Cabinet Order issued in accordance with the provision of Article 7;provided, that the housing enumerated in the following items shall be established by the person mentioned in the respective items:
(1) The housing to be established at the expense of those special accounts provided for by Cabinet Order which operate postal services, telecommunication services and other services on an enterprise basis: The head of each Ministry or Agency who administers the special account concerned (meaning the head of each Ministry or Agency prescribed in Article 4 paragraph 2 of the National Property Law (Law No.73 of 1948);hereinafter the same);
(2) The housing established in those cases to be designated by the Minister of Finance where it is necessary to build at one time a large number of housing units for the national public service personnel employed in particular Government offices, or where there are circumstances making the establishment of housing by other persons than the Minister of Finance preferable: The head of each Ministry or Agency to which national public service personnel who rent the housing belong.
(Maintenance and Control of Housing)
Article 8-(3). The head of each Ministry or Agency shall maintain and control the housing in accordance with the provisions of the Cabient Order issued under the provision of Article 7.
In Article 10, next to "with no rental charges" shall be added "within the limit of budget:" ;and to the same Article, the following one item shall be added:
(12) Director-General of the Headquarters of the National Police Reserve.
In Article 12 paragraph 1, next to "to the rentfree housing" shall be added"within the limit of budget.
To Article 14, the following one paragraph shall be added:
4 In case the occupant of the rented housing falls under the provision of Article 19 item (1) or (2), the occupant shall pay the rental charge to the National Treasury, monthly by the end of each month, for the period from the day he comes to fall under such provisions to the day he vacates the housing.
The heading of Article 18 shall be amended as "(Bearing of Expenses and Revenue of Rent)" ;in paragraph 1 of the same Article, "the respective account which pays the remuneration of those who are provided with the housing." shall be amended as "the account to which the management of the housing belongs." ;and in paragraph 2 of the same Article, next to "which operate their business on an enterprise basis" shall be added "as prescribed by Cabinet Order," .
Supplementary Provisions:
1 This Law shall come into force as from April 1, 1951.
2 When change of jurisdiction or change of administrative control of the Government housing is to be effected between accounts belonging to different jurisdictions (excluding those special accounts provided for by Cabinet Order which operate postal services, telecommunication services and other services on an enterprise basis;hereinafter the same) or when the housing is to be used by an account belonging to a different jurisdiction, an adjustment may be made between the accounts without compensation in spite of the provision of Article 15 of the National Property Law (Law No.73 of 1948) for the time being.
