Law for Partial Amendments to the Law concerning Travel Expenses for National Public Service Personnel and Others
The Law concerning Travel Expenses for National Public Service Personnel and Others (Law No.114 of 1950) shall be partially amended as follows:
In Article 2 paragraph 1 item (1), next to "the Minister of each Ministry," shall be added "the President of the Economic Stabilization Board," .
In Article 3 paragraph 6, ", 4" shall be deleted;in paragraph 7 of the same Article, "and paragraph 4 to the preceding paragraph inclusive" shall be amended as ", paragraphs 4 and 5" ;and in paragraph 3 of the same Article, "and paragraph 4 to 6 inclusive" shall be amended as "4 and 5" ;paragraph 4 of the same Article shall be deleted;paragraph 5 of the same Article shall be made paragraph 4 of the same Article;and the numbering of the following paragraphs shall be moved up by one accordingly.
In Article 4 paragraph 1 item (2), "or 5" shall be deleted;and paragraphs 4 and 5 of the same Article shall be amended as follows:
4 If the travel authorizing officer intends to issue, or amend travel order, etc., he shall do it by stating matters relating to travel in a book of travel order or book of travel request (hereinafter referred to as "book of travel order, etc." ) and show it to the traveller concerned;provided that if he has not time enough to state matters relating to travel in the book of travel order, etc. and show it to the traveller, he may issue or amend travel order, etc. verbally.
5 In case the travel authorizing officer has issued or amended travel order, etc. verbally, he shall state matters relating to travel in the book of travel order, etc. and show it to the traveller concerned as soon as possible.
In paragraph 6 of the same Article, "written travel order, etc." shall be amended as "book of travel order, etc." .
Article 6 paragraph 14 shall be amended as follows:
14 For such travels among domestic travels as are prescribed in Article 26 paragraph 1, travel expenses on daily amount basis shall be supplied instead of the travel expenses provided for in paragraph 1.
Article 14 shall be amended as follows:
Article 14. Deleted.
In Article 15, "paragraph 5 or 6" shall be amended as "paragraph 4 or 5" .
In Article 25 paragraph 1 item (1) c), next to "at the time or his transfer" shall be added";provided that in case two or more dependents under six years accompany, they shall be regarded as one dependent and an amount equivalent to one half of such railway fare as is payable to the employee at the same time shall be added for such one dependent.
Article 26 shall be amended as follows:
(Travel Expenses on Daily Amount Basis)
Article 26. Travels for which the travel expenses on daily amount basis instead of the travel expenses as enumerated in Article 6 paragraph 1 are supplied shall be designated by the Minister of Finance, from among travels mentioned in the following items for which it is deemed appropriate to pay the travel expenses on daily amount basis because of their nature:
(1) Travels for measurement, survey, public works and repair and maintenance works, patrol and other similar purposes;
(2) Travels for training and other similar purposes;
(3) Temporary duty travels, except travels mentioned in the preceding two items, by employees whose duties are of such a nature as will require them to make temporary duty travel constantly.
2 The amounts of travel expenses on daily amount basis and conditions and procedures of their payment shall be determined by the Chief of each Agency upon consultation with the Minister of Finance;provided that the amounts shall not, in consideration of the nature of the travel expenses on daily amount basis concerned, exceed the standards established by this Law with respect to the amounts of travel expenses enumerated in Article 6 paragraph 1.
In Article 28 paragraph 1 item (2), "passage fare" shall be amended as "railway fare, passage fare" .
Article 46 paragraph 1 shall be amended as follows:
In case the Chief of each Agency deems that because of the use by travellers of transportation, lodging, etc. furnished at the expense of the Government or other specific circumstances of the travel or because of the nature of the travel, travel expenses supplied to them in accordance with this Law or other laws which pertain to travel expenses are unreasonably in excess of the actual travel expenses or amount to such travel expenses as are not required in ordinary cases, he need not pay such part of travel expenses as is in excess of the actual expenses or is not required.
In paragraph 2 of the same Article, "when he intends not to supply travel expenses entirely or partly" shall be amended as "when he intends to withhold, in accordance with the provision of the said paragraph, the payment of travel expenses," .
Article 47 paragraph 2 shall be deleted.
In paragraph 4 of the Supplementary Provisions, next to "expense for disposal and transportation of the dead" shall be added "(including the fixed amounts of these travel expenses which serve as the basis of computing the amounts of afterarrival expense and dependents'transfer expense)" .
Paragraph 8 of the Supplementary Provisions shall be amended as follows:
8 In the case of a foreign travel, the term of which, including the preparatory period of 10 days preceding the start of the travel, extends over two fiscal years, travel expenses to be supplied therefor may, for the time being, be disbursed in roughly estimated payment from the expenditure budget of the preceding fiscal year.
Supplementary Provisions:
1 This Law shall come into force as from the day of its promulgation.
2 The provisions of the Law concerning Travel Expenses for National Public Service Personnel and Others as amended by this Law shall apply to travels on and after April 1, 1951, and with respect to travels which started before this date the precedents under the former provisions shall still apply;provided that the provision of paragraph 8 of the Supplementary Provisions of the said Law as amended shall apply to travels on and after the day of the enforcement of this Law.
