I hereby promulgate the Law for Partial Amendment to the Law concerning Temporary Measures for the Budget and Settlement of Account of Public Corporations, etc.

Law for Partial Amendment to the Law concerning Temporary Measures for the Budget and Settlement of Account of Public Corporations, etc.
The Law concerning Temporary Measures for the Budget and Settlement of Account of Public Corporations, etc.(Law No.27 of 1949) shall be partially amended as follows:
Article 4-(2) shall be made Article 4-(3) and next to Article 4, the following one Article shall be added:
(Reserve Fund)
Article 4-(2). The public corporations, etc. may include a proper amount as the reserve found in the budget of the public corporations, etc. for the purpose of covering the unforeseen shortage of budget.
In Article 5 paragraph 1, "it shall divide items into objects and details in accordance with the approval of the Diet" shall be amended as "it shall divide items (excluding the item of the reserve fund) into objects and details in accordance with that notification."
The title of Article 9 shall be amended as "(Prohibition of Use outside the Purposes of Budget)" .
To Article 10, "(Transfer and Diversion)" shall be added as the title.
To Article 10-(2), "(Plan of Obligation and Plan of Payment)" shall be added as the title;in the same Article, "Article 4-(2)" shall be amended as "Article 4-(3)" ;the same Article shall be Article 11 and next to the same Article, the following three Articles shall be added:
(Use of Reserve Fund)
Article 12. In case the chief of a public corporation intends to use the reserve fund, he shall prepare the statements of reserve fund disbursement showing the reason therefor, amount and basis of the computation, and forward them through the competent Minister to the Minister of Finance, and get the approval of the Minister of Finance.
2 In case the approval of the preceding paragraph has been given, the expenses stated on the approved statement of reserve fund disbursement shall be deemed to have been notified as the budget under the provisions of Article 4-(3) paragraph 1.
(Carrying-Forward of Budget)
Article 13. The appropriation of public corporations, etc. for respective fiscal year shall not be used in the following fiscal year;provided that the apropriations of which obligation is incurred and is not disbursed within the fiscal year concerned due to unavoidable circumstances, may be carried forward to and used in the following fiscal year.
Article 14. In case the chief of public corporation intends to make the carrying-forward under the provisions of the proviso to the preceding Article, he shall prepare the statement of carrying-forward showing the reason therefor and amount thereof for each item, and send it to the Minister of Finance through the competent Minister and get and approval of the Minister of Finance.
2 In case the approval of the preceding paragraph has been given, the expenses stated on the approved statement of carrying-forward shall be deemed to have been notified as the budget under the provisions of Article 4-(3) paragraph 1.
To Article 10-(3), "(Enforcement Provisions for Execution of Budget)" shall be added as the title;in Article ", 10-(3)," preceding three Articles "shall be amended as" preceding six Articles", and the same Article shall be made Article 15 and Article 11 shall be made Article 16.
Supplementary Provisions:
1 This Law shall come into force as from the day of its promulgation.
2 The provisions of Article 4-(2), Article 5 and Article 12 of the Law concerning Temporary Measures for the Budget and Settlement of Account of Public Corporations, etc. newly amended shall apply as from the budget for the fiscal year 1950-51 of the public corporations, etc.
