Law for Partial Amendments to the Law of Fire Defence Organization
The Law of Fire Defence Organization (Law No.226 of 1947) shall be partially amended as follows:
Article 4 item (9) shall be amended as follows:
(9) Matters concerning model specifications for apparatus for use of fire defence, equipment and material;
Article 9 shall be amended as follows:
Article 9. In order to deal with affairs concerning matters of fire defence, cities, towns and villages shall establish any or all of the following organs:
(1) Fire Defence Headquarters;
(2) Fire Station;
(3) "Shobodan" ;
(4) Organs for training of the fire department personnel and members of "Shobodan."
Article 11 paragraphs 2 and 3 shall be made as paragraphs 3 and 4 respectively, and the following one paragraph shall be added next to paragraph 1 of the same Article:
The standard of the ranks of the fire defence personnel shall be prescribed by model regulations of the National Fire Defence Agency.
In Article 12, in "accordance with by-laws" shall be amended as "in accordance with the provisions of the Local Public Service Law."
In Article 15 paragraph 1, "performance of duties" shall be amended as "oath, performance of duties" , and "shall be fixed by by-laws of cities, towns and villages in line with spirit of the National Public Service Law" shall be amended as "shall be carried out in accordance with the provisions of the Local Public Service Law."
In the same Article paragraph 2, "oath," shall be deleted.
Article 15-(2) paragraph 3 shall be amended as follows:
The matters concerning appointment, dismissal, wage, performance of duties and other matters of members of "Shobodan" shall be fixed in accordance with the provisions of the Local Public Service Law in the case of members of full-time service and they shall be fixed by by-laws of cities, towns and villages in the case of members of part-time service.
The following one paragraph shall be added to the same Article:
The fixed number of members of "Shobodan" shall be provided for by by-laws of cities, towns and villages, and matters concerning the training, formality and uniform thereof shall be prescribed by municipal regulations in line with model regulations established by the National Fire Defence Agency.
The following two (2) Articles shall be added next to the same Article:
Article 15-(3). "Shobodan" of cities, towns and villages shall have a chief of the "Shobodan" and other members with the ranks necessary and appropriate for executing efficient fire defence in accordance with the provisions of this Law.
The chief of "Shobodan" shall be appointed by the heads of cities, towns and villages upon recommendation by "Shobodan" , and dismissed due to a certain cause.
The chief of "Shobodan" shall appoint members of "Shobodan" with the approval of the head of city, town or village and dismiss them due to a certain cause.
The members of "Shobodan" shall take charge of fire defence affairs under the direction and supervision of their supervisors.
Article 15-(4). In case a member of "Shobodan" of part-time service died, sustained injury or contracted diseases due to official duties or died of injury or diseases sustained or contracted due to official duties, or became disabled, cities, towns and villages shall compensate the member concerned, the surviving family or the dependant for the losses arisen from such causes conforming to the example of such cases of the fire department personnel (in the case of cities, towns and villages where no fire defence personnel are stationed, the fire defence personnel in other cities, towns and cities similar thereto in financial and other conditions).
In Article 17 paragraph 2, "in accordance with by-laws of To" shall be amended as "in accordance with the provisions of the Local Public Service Law."
Article 20 shall be amended as follows:
Article 20. The National Fire Defence Agency may, according to the necessity, give advice in matters pertaining to fire defence to To, Do, Fu and prefectures or cities, towns and villages, and, if requested by the governors of To, Do, Fu and prefectures, the heads of cities, towns and villages, or the chiefs of fire departments of cities, towns and villages, may give guidances and suggestions to them concerning the matters pertaining to fire defence, or may assist in procurement of equipments, fire apparatus and materials.
In Article 24 paragraph 2, "the Police of Autonomous Entities" shall be added next to "the National Local Police."
In Chapter 4, the following one Article shall be added next to Article 26:
Article 26-(2). So far as application of the provisions of this Law is concerned, a Partial Affair Union of fire defence of city, town or village of which the city is a member shall be considered as a city, and one of which the city is not a member as a town or village, and All Affairs Union and Office Affairs Union of town or village as a town or village
Supplementary Provisions:
1 This Law shall come into force as from the day of its promulgation. However, concerning the matters of appointment, dismissal, wages, uniform and others, the precedent under the former provisions of the Law shall apply to the city, town and village concerned until each corresponding provision of the Local Public Service Law is applicable regerdless of the revised provisions of Article 12, Article 15, Article 15-(2) paragraph 3 and Article 17 paragraph 2.
2 The Public Offices Election Law (Law No.100 of 1950) shall be partially amended as follows:
In Article 89 paragraph 1, the following one item shall be added, and in paragraph 3 of of the same Article, "item (1) and item (2)" shall be amended as "item (1), item (2) and item (4)" :
4 The chief of "Shobodan" and other members of "Shobodan" (excluding the members of fulltime service).
3 The precedent under the former provisions of the Law shall apply to the election whose date has been announced publicly or notified in accordance with the provisions of the Public Offices Election Law at the time of enforcement of this Law, regardless of the revised provisions of Article 89 of the same Law.
