Law for Partial Amendments to the Court Organization Law
The Court Organization Law (Law No.59 of 1947) shall be partially amended as follows:
Next to Article 19, there shall be added the following one paragraph:
In case there exists a special circumstance making it impossible to meet urgent necessity of the High Court concerned in accordance with the preceding paragraph, the Supreme Court may cause a Judge of another High Court or a Judge of a District Court or a Family Court within the area over which the same High Court has jurisdiction to serve as a Judge of the High Court concerned.
Next to Article 28, there shall be added the following one paragraph:
In case there exists a special circumstance making it impossible to meet urgent necessity of the District Court concerned in accordance with the preceding paragraph, the Supreme Court may cause a Judge of a District Court or a Family Court within the area over which a High Court other than that having jurisdiction over the place of the District Court concerned has jurisdiction or a Judge of the same High Court to serve as a Judge of the District Court concerned.
In Article 33 paragraph 1 item (1), "five thousand yen" shall be amended as "thirty thousand yen" , and, in item (2) of the same paragraph of the same Article, "or offenses or criminal attempts mentioned in Article 235 of the Penal Code" as "offenses mentioned in Article 186 of the Penal Code, offenses mentioned in Article 235 of the same Code or attempts thereof or offenses mentioned in Article 252 or 256 of the same Code" , and, in paragraph 2 of the same Article, "offenses or criminal attempts mentioned in Article 235 of the Penal Code" as "offenses mentioned in Article 130 of the Penal Code or attempts thereof, offenses mentioned in Article 186 of the same Code, offenses mentioned in Article 235 of the same Code or attempts thereof, offenses mentioned in Article 252,254 or 256 of the same Code, offenses mentioned in Articles 27 to 29 inclusive of the Second-Hand Business Law (Law No.108 of 1949), or offenses mentioned in Articles 30 to 32 inclusive of the Pawnbroker Business Law (Law No.158 of 1950)."
The following one paragraph shall be added to Article 36:
In case there exists a special circumstance making it impossible to meet urgent necessity of the Summary Court concerned in accordance with the preceding paragraph, a High Court having jurisdiction over the place of the said Summary Court may cause a Judge of a Summary Court or a District Court within the area over which the said High Court has jurisdiction, other than the judges prescribed in the same paragraph to serve as a Judge of the Summary Court concerned.
Supplementary Provisions:
1. In this Law, the amended provisions of Article 33 shall come into force as from the day when the period of thirty (30) days has elapsed counting from the day of its promulgation, and the remainder as from the day of its promulgation.
2. Those cases against which a suit or public action has been instituted with a District Court before the enforcement of the amended provisions of Article 33 shall be governed by the provisions hitherto in force, despite the amended provisions of the same Article.
