Law for Partial Amendments to the Seamen's Insurance Law, etc.
Article 1. The Seamen's Insurance Law (Law No.73 of 1939) shall be partially amended as follows:
The proviso to Article 17 shall be amended as follows:
provided, that this shall not apply to a person who is employed by the State or a local public body and who comes under the Pension Law.
In Article 20 paragraph 3, "If the provisions of Article 21 paragraph 1 item (2) apply to the contributions which should be paid by a person who made an application in accordance with the provisions of paragraph 1," shall be amended as "If any insured person who has made the application under paragraph 1 lets his first contribution fall in arrears and fails to pay such contribution within the time limit designated in accordance with the provision of Article 12 paragraph 1," .
In Article 21 paragraph 1, "when he comes within any of the following items:" shall be amended as "as from the day following the day when he comes within any of the following items (if he comes under the provision of item (3), he shall become disqualified as from that day):" and the items of the same paragraph shall be amended as follows and paragraph 2 of the same Article shall be deleted:
(1) In the event of the death of the insured;
(2) When his insured term of coverage under the provision of Article 17 plus the term of coverage as prescribed in the preceding Article totals 15 years;
(3) When he becomes the insured in accordance with the provision of Article 17;
(4) When he makes an application to be disqualified as the insured;
(5) When he fails to pay contributions (except the first contribution to be paid) in arrears within the time limit designated in accordance with the provision of Article 12 paragraph 1.
Next to Article 23-(6), the following two Articles shall be added:
Article 23-(7). If there are two or more survivors of the same priority entitled to insurance benefits in accordance with the provisions of Article 23-(2), Article 23-(4) through the preceding Article, or Article 27-(2), such benefits shall be granted in equal parts according to the number of such survivors.
Article 23-(8). If one of the survivors of the same priority entitled to a survivor's or surviving child's pension loses his right to such pension and there are still two or more persons of the same priority, such survivor's or surviving child's pension shall be granted in equal parts according to the number of such survivors.
Article 27-(3) paragraph 2 shall be amended as follows:
In this Chapter, the term "the last monthly standard remuneration" signifies the standard monthly remuneration of the month in which the sickness or injury that caused the disability or death originally occurred, in cases where an insured person or a person formerly insured became disabled or died due to an occupational cause, or in which a vessel was lost or foundered or in which a vessel was presumed to be lost or foundered in accordance with the provision of Article 11 paragraph 2, in cases where he is presumed to have died in accordance with the provision of paragraph 1 of the same Article, or in which an insured person or a person formerly insured became missing, in cases where he is presumed to have died in accordance with the provision of paragraph 1 of the same Article which applies mutatis mutandis under paragraph 3 of the same Article.
Article 2. The Law amending a Part of the Seamen's Insurance Law (Law No.128 of 1948) shall be partially amended as follows:
In Article 3 of the Supplementary Provisions, "5 times" shall be amended as "10 times" .
Articles 4 through 6 of the Supplementary Provisions shall be amended as follows:
Articles 4 through 6. Deleted.
Supplementary Provisions:
1. This Law shall come into force as from January 1, 1951;provided that that part of Article 2 which amends Article 3 of the Supplementary Provisions of the Law amending a Part of the Seamen's Insurance Law and the provision of paragraph 5 of the Supplementary Provisions of this Law shall come into force as from February 1, 1951.
2. With respect to the application of the provisions of Article 4 of the Law, a monthly remuneration of less than 3,250 yen shall be regarded, for the time being, as a monthly remuneration of 3,250 yen or more but less than 3,750 yen.
3. The contribution rates, for the time being and regardless of the provision of Article 59 paragraph 4, shall be as follows:
(1) 16.0 per cent for the insured person described in Article 17 and who, not coming under any of the items of Article 33-(3) paragraph 2, is not excluded from unemployment insurance benefits;
(2) 14.0 per cent for the insured person described in Article 17 and who, coming under one of the\items of Article 33-(3) paragraph 2, is excluded from unemployment insurance benefits.
4. The contribution charges calculated from the contribution rates prescribed in the preceding paragraph, for the time being and regardless of the provision of Article 60 paragraph 1, shall be shared in the following proportions:
(1) With respect to the insured person described in Article 17 and who, not coming under any of the items of Article 33-(3) paragraph 2, is not excluded from unemployment insurance benefits, 4.8/16.0 by the insured and 11.2/16.0 by the shipowner;
(2) With respect to the insured person described in Article 17 and who, coming under one of the items of Article 33-(3) paragraph 2, is excluded from unemployment insurance benefits, 3.8/14.0 by the insured and 10.2/14.0 by the shipowner.
5. The amount of an invalidity pension for a disability due to a non-occupational cause, calculated on the basis of the standard remuneration prior to the date (December 1, 1947) of the enforcement of the Law concerning Partial Amendments to the Seamen's Insurance Law (Law No.103 of 1947), regardless of the provision of Article 41 paragraph 1 item (2), or Article 2 of the Supplementary Provisions of the same Law, shall be an amount equal to 10 times the former amount.
