Law for Partial Amendments to the Housing Loan Corporation Law
The Housing Loan Corporation Law (Law No.156 of 1950) shall be partially amended as follows:
The following one Article shall be added next to Article 38:
(Application Mutatis Mutandis of Pension Law)
Article 38-(2). In cases where persons who are the public service personnel provided for in Article 19 of the Pension Law (Law No.48 of 1923) or who are regarded as the public service personnel provided for in the same Article at the time of the establishment of the Corporation have become its officers or employees (including the cases where the public service personnel or persons who are regarded as public service personnel have continued to be in office as the public service personnel provided for in the same Article or as persons who are regarded as the public service personnel provided for in the same Article and have continuously become officers or employees of the Corporation), they shall be regarded as being continuously in service as the civil service officials who are provided for in Article 20 of the same Law and who receive their salaries from the National Treasury, and the provisions of the Pension Law shall for the time being apply mutatis mutandis to them.
2 The amount of money which the persons who are civil service officials as provided for in Article 20 paragraph 1 of the Pension Law and who are regarded in accordance with the provisions of the preceding paragraph as being continuously in service as persons who receive their salaries from the National Treasury shall pay into the National Treasury by the application mutatis mutandis of the provisions of Article 59 paragraph 1 of the Pension Law under the preceding paragraph shall be deducted from the salary by the employees who is in charge of paying their salaries at the time of payment and paid to the revenue official by the tenth of the following month, accompanying it with an itemized statement to clarify the computation thereof.
3 In cases where the Pension Law applies mutatis mutandis in accordance with the provisions of paragraph 1, the Housing Loan Corporation shall be regarded as an administrative organ so far as the payment of pension, etc. are concerned.
Articles 39 and 40 shall be amended as follows:
(Mutual Aid Association)
Article 39. The officers and employees of the Corporation shall be regarded as persons who are employed by the State and receive remuneration from the National Treasury in regard of the application of the provision of the National Public Service Mutual Aid Association Law (Law No.69 of 1948) and shall become the members of the mutual aid association established in the Ministry of Construction in accordance with the provisions of Article 2 paragraph 1 of the same Law.
Article 40. The amounts of money enumerated in items of Article 69 paragraph 1 of the National Public Service Mutual Aid Association Law relative to members of the Mutual Aid Association established in the Ministry of Construction in accordance with the provisions of the preceding Article shall, notwithstanding the provisions of the same paragraph, be borne by the Housing Loan Corporation and be paid to the said association every month by its President.
2 In cases where the President makes payment to the said Association in accordance with the provisions of the preceding paragraph, he may make an approximate payment on the basis of the estimated number of the members of the association. The accurate computation shall be made at the end of the fiscal year on the basis of the actual number of the members of the association.
Supplementary Provisions:
1. This Law shall come into force as from the day of its promulgation and apply as from June 5, 1950.
2. With respect to the amount of money to be paid to the National Treasury as prescribed in Article 59 paragraph 1 of the Pension Law which should have been deducted from the salaries received before the enforcement of this Law by the person amenable to the Pension Law in accordance with the provisions of Article 38-(2) paragraph 1 of the Housing Loan Corporation Law (hereinafter referred to as the "Law" ) after amendment, as sum equivalent to such money to be paid shall be collected by employee of the Corporation who is in charge of paying salaries from such person and paid to the revenue official together with the amount to be paid which should have been deducted from the first payment of salary under Article 38-(2) paragraph 2 after the enforcement of this Law.
3. With respect to the amount equivalent to the charge prescribed in Article 68 paragraph 2 of the National Public Service Mutual Aid Association Law which should have been deducted from the salaries received before the enforcement of this Law by the persons amenable to the National Public Service Mutual Aid Association Law in accordance with the provision of Article 39 of the after amendment as members of the mutual aid association established in the Ministry of Construction, a sum equivalent to the amount of such charge shall be collected by the employee of the Corporation in charge of paying salaries from such person and paid together with the amount equivalent to the first payment which should have been deducted from the salary under the same Article after the enforcement of this Law to the said Association.
4. The amounts of money enumerated in each item of Article 69 paragraph 1 of the National Public Service Mutual Aid Association Law which should have been paid by the President of the Housing Loan Corporation before the enforcement of this Law to the mutual aid association established in the Ministry of Construction as provided for in Article 40 of the Law after amendment shall be paid together with the first payment of the money as provided for in each item of the same paragraph after the enforcement of this Law to the said Association.
