Law for Partial Amendments to the Customs Law
The Customs Law (Law No.61 of 1899) shall be partially amended as follows:
Articles 59 and 60 shall be amended as follows:
Article 59. The customs officials may carry weapons in conducting the investigation into the goods for export and import, vessels, aircraft, or passengers (including the investigation into law-breaking cases).
Article 60. The customs officials may, in conducting the investigation under the preceding Article, employ weapons in cases where there is sufficient reason to believe it inevitably necessary for protecting their or other people's life or person or for overcoming the resistance to the performance of their official duty, to such an extent as is reasonably judged necessary to cope with the situation.
Article 101-(7) shall be made Article 101-(8);and the following one Article shall be added next to Article 101-(6):
Article 101-(7). The Superintendent of Customs may dispatch and station customs officials at private bonded zones and other places where the special procedure is to be taken in the application of the Customs Law.
Supplementary Provisions:
1. This Law shall come into force as from the day of its promulgation.
2. The Law for the Fixed Number of Personnel in the Administrative Organs (Law No.126 of 1949) shall be partially amended as follows:
In Article 2 paragraph 2 of the same Article, "the preceding paragraph" shall be amended as "paragraph 1," the said paragraph shall be made paragraph 3 of the same Article, and the numbering of the subsequent paragraphs shall be moved down by one;and the following one paragraph shall be added next to paragraph 1 of the same Article:
2 Notwithstanding the provision of the preceding paragraph, the fixed number of personnel established for the Ministry of Finance may be increased to within 200, in accordance with the provisions of Cabinet Order, in case it is necessary for dispatching and stationing the personnel at private bonded zones and other places where the special procedure is to be taken in the application of the Customs Law.
3. The Law for Partial Amendments to the Law for the Fixed Number of Personnel in the Administrative Organs (Law No.140 of 1950) shall be partially amended as follows:
In paragraph 4 of the Supplementary Provisions, "Article 2 paragraph 2" shall be amended as "Article 2 paragraph 3."
