Law for Partial Amendments to the Ministry of Transportation Establishment Law and the Japanese National Railways Law
Article 1. The Ministry of Transportation Establishment Law (Law No.157 of 1949) shall be partially amended as follows:
Article 9 paragraph 3 shall be made paragraph 5 of the same Article and paragraph 2 of the same Article shall be made paragraph 4 of the same Article, and the following two paragraphs shall be added next to paragraph 1 of the same Article:
2 The Prime Minister may, in case he cannot obtain the consent of the both Houses of the Diet, in consequence of the closing of session the Diet or the dissolution of the House of Representatives, when the term of office of any member has expired or a vacancy has occurred, appoint the member without the consent of the both Houses of the Diet regardless of the provision of the preceding paragraph.
3 The Prime Minister shall, in the case where he has appointed any member in accordance with the provision of the preceding paragraph, obtain the approval of the both Houses of the Diet concerning the appointment of the member in question in the first session of the Diet to be convoked after the appointment. The Prime Minister shall, in case the said approval has not been obtained, remove, without delay, the member in question regardless of the provision of Article 11.
Article 2. The Japanese National Railways Law (Law No.256 of 1948) shall be partially amended as follows:
Article 12 paragraph 2 shall be made paragraph 4 of the same Article, and the following two paragraphs shall be added next to paragraph 1 of the same Article:
2 The Cabinet may, in case it cannot obtain the consent of the both Houses of the Diet, in consequence of the closing of session of the Diet or the dissolution of the House of Representatives, when the term of office of any member has expired or a vacancy has occurred, appoint the member without the consent of the both Houses of the Diet regardless of the provision of the preceding paragraph.
3 The Cabinet shall, in case it has appointed any member in accordance with the provision of the preceding paragraph, obtain the approval of the both Houses of the Diet concerning the appointment of the member in question in the first session of the Diet to be convoked after the appointment. The Cabinet shall, in case the said approval has not been obtained, remove without delay, the member in question regardless of the provision of Article 14.
Supplementary Provision:
This Law shall come into force as from the day of its promulgation.
