Law for Partial Amendments to the Agricultural Seeds and Seedlings Law
The Agricultural Seeds and Seedlings Law (Law No.115 of 1947) shall be partially amended as follows:
In Article 1 paragraph 1, "is defined to mean anyone designated by the Minister of Agriculture and Forestry" shall be amended as "shall mean anyone designated by the Minister of Agriculture and Forestry, and the term," guaranteed seeds and seedlings "shall mean such seeds and seedlings as are specifically designated by the Minister of Agriculture and Forestry in order to have guarantee card attached."
In Article 1 paragraph 2, Articles 2 to 6 inclusive and Article 13, "seeds and seedlings" shall be amended as "guaranteed seeds and seedlings."
The following one Article shall be added next to Article 1:
Article 1-(2). In this Law, the provisions concerning the successor shall, in case there exist two successors or more, apply to one successor selected from among the said successors after due conference among themselves. However, the provisions shall apply to the designated person, when the person to be succeeded designates one of the successors.
In Article 3 paragraph 2, "the name of a city, town or village" shall be amended as "the name of To, Do, Fu or prefecture."
Article 7 paragraph 5 shall be amended as follows:
Any person who applies for the registration of a name of seed or seedling in accordance with the provision of paragraph 1 shall pay as an application fee 200 yen per application.
The following one paragraph shall be added as paragraph 6 to the same Article:
Any person who has received the registration in accordance with the provision of paragraph 1 shall pay, within the limit not exceeding 2,000 yen, as a registration fee an amount corresponding to that fixed by the Seeds and Seedlings Examination Committee.
In Article 10 paragraph 1 item (1), "a seed and seedling trademan" shall be amended as "any person who engages in the business of dealing in seeds and seedlings."
The following one paragraph shall be added next to Article 11:
The Minister of Agriculture and Forestry shall, in case he intends to effect the cancellation of the registration in accordance with the provisions in item (1) or item (4) to item (6) inclusive of the preceding paragraph, notify in advance the person who has received registration or his successor of the supposed reason in writing and give the person who has received registration or his successor or the representative the opportunity of making plea and submitting evidences favourable for himself in the Seeds and Seedlings Examination Committee.
In Article 13 item (6), "paragraph 1" shall be added after "Article 11."
Supplementary Provision:
This Law shall come into force as from the day of its promulgation.
