Law for Partial Amendments to the
Special Procurement Agency Establishment Law
The Special Procurement Agency Establishment Law (Law No.129 of 1949) shall be partially amended as follows:
In the Contents, "Chapter III Local Branches (Articles 13-16)" shall be amended as follows:"Chapter III Auxiliary Organs (Articles 12-(2)-12-(6))
Chapter IV Local Branches(Articles 13-17)
."
Article 5 shall be amended as follows:
Article 5. The Special Procurement Agency shall have the Director's Secretariat and the following four Divisions:
Financial Division
Purchasing and Contracting Division
Engineering and Inspecting Division
Labor and Property Division
Article 6 paragraph 7 shall be amended as follows:
7 Each Division shall have a Deputy Chief.
Article 7 item (9) shall be amended as follows:
(9) Coordination and adjustment such as examination of draft bills and orders.
Articles 8 to 12 inclusive shall be amended as follows:
(Financial Division)
Article 8. The Financial Division shall take charge of the affairs regarding the termination of war expenses excluding the over-head expenditures and the released item disposition expenses as well as special revenues incidental thereto.
(Purchasing and Contracting Division)
Article 9. The Purchasing and Contracting Division shall take charge of the affairs pertaining to the contracts under the termination of war work expenses, miscellaneous business expenses and the released item disposition expenses excepting those pertaining to the contracts for the procurement of real properties and their appendices, and for the restitution of real properties.
(Engineering and Inspecting Division)
Article 10. The Engineering and Inspecting Division shall take charge of the following affairs:
(1) Planning on construction work, service and supplies (meaning all goods other than real properties and movable properties appended thereto;hereinafter the same) and estimating expenses required;
(2) Furnishing of materials required for construction work, service and supplies;
(3) Expediting, inspecting and examining the performance of construction work, supply of services and delivery of supplies.
Article 11. Deleted.
(Labor and Property Division)
Article 12. The Labor and Property Division shall take charge of the following affairs:
(1) Laborers required by the Occupation Forces;
(2) Custody, receipt and delivery and transportation of supplies;
(3) Appraisal and procurement of real properties and movable properties appended thereto under the termination of war work expenses;
(4) Custody and restitution of real properties and supplies released from the requisition of the Occupation Forces;
(5) Registration of real properties.
"Chapter III Local Branch Offices" shall be amended as "Chapter IV Local Branch Offices," and the following one Chapter shall be added next to Article 12:
CHAPTER III Auxiliary Organs
(Auxiliary Organs)
Article 12-(2). The Special Procurement Agency shall have the following auxiliary organs:
Service Procurement Council
Central Real Property Procurement Council
Entertainment Procurement Council
(Service Procurement Council)
Article 12-(3). The Service Procurement Council (hereinafter referred to as "Service Council" ) shall be an auxiliary organ to make research and deliberation, in response to the inquiries of the Director of the Special Procurement Agency, on the service procurement of planning, surveying and other technical matters, of compilation and production of Japanese or foreign language editions of educational films, etc. of the United Nations, and o management of procured hotels, etc.
2 The Service Council shall consist of the Director of the Special Procurement Agency and fifty or less than fifty councillors.
3 The Director of the Special Procurement Agency shall preside over the business of the Council, as its chairman.
4 In case specially required, the Service Council may have temporary councillors as its components.
5 The councillors and temporary councillors shall be appointed by the Director of the Special Procurement Agency from among personnel of government organs concerned as well as other civil persons with special knowledges and experiences on planning, surveying and other technical matters, on compilation and production of Japanese or foreign language editions of educational films, etc. and on management of hotels, etc.
(Central Real Property Procurement Council)
Article 12-(4). The Central Real Property Procurement Council (hereinafter referred to as "Central Real Property Council" ) shall be an auxiliary organ to make research and deliberation, in response to the inquiries of the Director of the Special Procurement Agency, on the standards and other general matters pertaining to the appraisal of the procured real properties and movable properties appended thereto.
2 The Central Real Property Council shall consist of twenty or less than twenty councillors.
3 The councillors shall be appointed by the Director of the Special Procurement Agency from among personnel of government organs concerned as well as other civil persons with special knowledges and experiences on the appraisal of real properties and movable properties appended thereto.
4 The Central Real Property Council shall have a chairman elected by its councillors who have been appointed from among civil persons with special knowledges and experiences, from among such councillors.
5 The chairman of the council shall preside over its businesses.
(Entertainment Procurement Council)
Article 12-(5). The Entertainment Procurement Council (hereinafter referred to as "Entertainment Council" ) shall be an auxiliary organ to make research and deliberation, in response to the inquiries of the Director of the Special Procurement Agency, on the service procurement regarding entertainments.
2 The Entertainment Council shall consist of the Deputy Director of the Special Procurement Agency and thirty-four more councillors.
3 The Deputy Director of the Special Procurement Agency shall preside over the businesses of the Entertainment Council, as its chairman.
4 The councillors shall be appointed by the Director of the Special Procurement Agency from among personnel of government organs concerned as well as other civil persons with special knowledges and experiences on entertainments.
Article 12-(6). Organizations and responsibilities of such councils as provided in Article 12-(2), tenures of the councillors and other necessary matters regarding those councils shall be provided for by Cabinet Order, excepting those prescribed in the preceding three Articles.

In Article 16 paragraph 1, "shall have the following four Divisions" shall be amended as "shall have the Chief's Secretariat and the following five Divisions," and "Production and Inspecting Division" shall be amended as

In the main provisions, the following one Article shall be added next to Article 16:
(Auxiliary Organs)
Article 17. The Special Procurement Bureaus shall have the Local Real Property Procurement Councils (hereinafter referred to as "Local Real Property Councils" ) as their auxiliary organs.
2 The Local Real Property Council shall be an auxiliary organ to make research and deliberation, in response to the inquiries of the Chief of the appropriate Special Procurement Bureau, on the appraisal of the procured real properties and movable properties appended thereto existing within the area of responsibility of such Bureau.
3 The Local Real Property Council shall consist of thirty or less than thirty councillors.
4 The councillors shall be appointed by the Chief of the appropriate Special Procurement Bureau from among personnel of government organs concerned as well as other civil persons with special knowledges and experiences on real properties and movable properties appended thereto.
5 The Local Real Property Council shall have a chairman elected by such councillors as appointed from among civil persons with special knowledges and experiences, from among those councillors.
6 The chairman of the Council shall preside over its businesses.
7 Organization and responsibilities of the Local Real Property Council, tenures of the councillors and other necessary matters regarding such council shall be provided for by Cabinet Order excepting those provided for in the preceding six paragraphs.
Paragraph 6 of the Supplementary Provisions shall be amended as follows:
8. In the case where the Pension Law (Law No.48 of 1923) applies to the public service personnel who were executive officers, Sanji or Shuji (hereinafter referred to generally as "former personnel" ) of the Special Procurement Board under the old Law and have become at the time of the enforcement of this Law the public service personnel as provided for in Article 19 paragraph 1 of the Pension Law in accordance with the provision of the proviso to paragraph 2 of the Supplementary Provisions of this Law, the tenure of office of these personnel as public service personnel shall be computed by adding the tenure corresponding to tenure of office as former personnel during the period from the month to which the day when they were appointed the former personnel belonged to May 1949, to tenure of office in the Special Procurement Agency under the new Law; provided that, the same shall not apply to any personnel who manifests their volition against it in writing to the Director of the Special Procurement Agency by April 30, 1950.
9. In respect to the application of the Welfare Pension Insurance Law (Law No.60 of 1941) the tenure of office of those personnel as former personnel, subject to the provisions of the clause proper of the preceding paragraph shall not be included in the term in which he has been insured under the same Law.
In paragraph 7 of the Supplementary Provisions, "the Special Procurement Agency or the Special Procurement Bureaus" shall be amended as "the Special Procurement Bureaus," and the same paragraph shall be made paragraph 8 of the Supplementary Provisions.
Supplementary Provision:
This Law shall come into force as from April 1, 1950.
