Law for Partial Amendments to the Ministry of Welfare Establishment Law and Others Ensuing from the Adjustment of Councils and Others
Article 1. The Ministry of Welfare Establishment Law (Law No.151 of 1949) shall be partially amended as follows:

Name
Purpose
The Health and Welfare Statistics Council
To make research and deliberation, in response to the request of Minister of Welfare, on important matters concerning health and welfare statistics.
The National Parks Council
To make research and deliberation, in response to the request of the Minister of Welfare, on important matters concerning National Parks.
The Central Eugenic Protection Committee
To mainly re-examine the adequacy of the eugenic operation and to manage other matters necessary for the eugenic protection.
The Nutritionists Examination Appeals Committee
To take charge of the affairs concerning the nutritionists examination, in response to the request of the Minister of Welfare.
The Central Food Sanitation Research Council
To make research and deliberation on food sanitation and administration concerning food sanitation, in response to the request of the Minister of Welfare.
The Medical Ethics Council
To make research and deliberation, in response to the request of the Minister of Welfare, on cancellation of licence, re-licencing or disposal of suspension of medical practices for medical practitioners and dentists or on important matters concerning improvement of medical ethics.
The Medical Practitioners Examination Council
To make research and deliberation, in response to the request of the Minister of Welfare, on important matters on the national examination for medical practitioners and to take charge of the affairs concerning the national examination and the preliminary examination of the national examination for medical practitioners.
The Dentists Examination Council
To make research and deliberation, in response to the request of the Minister of Welfare, on important matters on the national examination for dentists and to take charge of the affairs concerning the national examination and the preliminary examination of the national examination for dentists.
The Council on Internship for Medical Practitioners and Dentists
To make research and deliberation, in response to the request of the Minister of Welfare, on important matters concerning internship under the provisions of Article 11 of the Medical Practitioners Law (Law No.201 of 1948) or Article 11 of the Dentists Law (Law No.202 of 1948).
The Council on Authorization of Schools, Training Schools and Examinations for Public Health Nurses, Midwives and Nurses
To make research and deliberation, in response to the request of the Minister of Welfare, on important matters on the national examinations for public health nurses, midwives and A-class nurses, and on the examination for B-class nurse, and to take charge of the affairs concerning the enforcement of the national examinations for public health nurses, midwives, and A-class nurses, and to make research and deliberation, in response to the request of the Minister of Education or Welfare, on important matters concerning the designation of schools or training institutions under the provisions of each item (1) or (2) of Articles 19 to 22 inclusive of the Public Health Nurse, Midwife and Nurse Law (Law No.203 of 1948).
The Medical Service Council
To make research and deliberation, in response to the request of the Minister of Welfare, on important matters concerning adjustment of the medical care facilities and medical treatment fees.
The Central Council on Practices of Massage, Acupuncture, Moxa-Cautery and Judo-Orthopaedics
To make research and deliberation, in response to the request of the Minister of Welfare, on important matters concerning the approval and examination of schools or training facilities as provided for in Article 2 paragraph 1 of the Law for Business of Massage, Acupuncture, Moxa-Cautery, Judo-Orthopaedics, etc.(Law No.217 of 1947), on the instructions as provided for in Article 8 paragraph 1 of the same Law, or on the disposal as provided for in Article 11 paragraph 2 of the same Law.
The Committee for Examination and Qualification of Dissection of Dead Body
To make research and deliberation, in response to the request of the Minister of Welfare, on the affairs concerning the finding and the cancellation of finding under Article 2 paragraph 1 item (1) of the Law for the Dissection and Preservation of the Dead Body (Law No.204 of 1948).
The Council on Liquidation of Japan Medical Treatment Corporation
To make research and deliberation, in response to the request of the Minister of Welfare, on important matters concerning liquidation of the Japan Medical Treatment Corporation
The National Committee of Pharmacy
To submit its original draft to the Minister of Welfare concerning revision of official compendiums or their supplements, to conduct national examination for pharmacists, to make recommendation to the Minister of Welfare concerning new medical drugs and other pharmaceutical affairs, and to conduct re-examination for cancellation of licence or registration, or for suspension of professional practices.
The Central Social Work Council
To make research and deliberation on the affairs belonging to its powers under the provisions of Article 7 and Article 13 of the Social Work Law (Law No.59 of 1938), and also on important matters concerning social work in response to the request of the Minister of Welfare.
The Central Council on Welfare for Disabled Persons
To deliberate on the affairs concerning the welfare for the disabled persons, in response to the request of the Minister of Welfare.
The Central Child Welfare Council
To make research and deliberation, in response to the request of the Minister of Welfare, on the affairs concerning welfare of children, pregnant women and women in childbed.
The Social Insurance Council
To deliberate on matters relative to the administration and operation of Government-managed Health Insurance, Mariners'Insurance and Welfare Pension Insurance.
The Central Social Insurance Medical Treatment Council
To deliberate on matters concerning the guidance and supervision of insurance doctors and pharmacists under Health Insurance and Mariners'Insurance, and purveyors of medical care benefits under National Health Insurance on the proper insurance medical care;and to deliberate on appropriate medical care fees for Health Insurance and Mariners'Insurance and on standards for appropriate medical care fees for National Health Insurance.
The Social Insurance Appeals Committee
To examine appeals of dissatisfaction on decision concerning payment of insurance benefits and on action taken relative to contributions or other assessments on Health Insurance, Mariners'Insurance or Welfare Pension Insurance.
Article 2. The National Park Law (Law No.36 of 1931) shall be partially amended as follows:
In Article 12 paragraph 4, "other than the affairs as provided for in the preceding three paragraphs" shall be deleted;and paragraph 2 and paragraph 3 of the same Article shall be deleted.
Article 3. The Hot Spring Law (Law No.125 of 1948) shall be partially amended as follows:
The following one paragraph shall be added to Article 10:
2 The Minister of Welfare, in case he intends to give the authorization of the preceding paragraph, shall, beforehand, hear the opinions of the interested persons in To, Fu or prefecture concerned.
In Article 14, "facilities" shall be amended as "hot spring utilization facilities."
Article 19 shall be amended as follows:
Article 19. The Hot Spring Council shall be established in To, Do, Fu or prefecture to make research and deliberation, in response to the request of the governor of To, Do, Fu or prefecture, on hot springs and administration thereon.
2 The organization, responsibilities and commissioners and other personnel of the Hot Spring Council shall be determined by by-law of To, Do, Fu or prefecture.
Article 20 paragraph 1 shall be deleted, and in paragraph 2 of the same Article, "Prefectural Hot Spring Council" shall be amended as "Hot Spring Council," and the same paragraph shall be made paragraph 1.
Article 4. The Riyoshi Law (Law No.234 of 1947) shall be partially amended as follows:

Article 5. The Medical Practitioners Law shall be partially amended as follows:
"Chapter V. Inquiry Committees, etc." shall be amended as "Chapter V. Councils."
Article 26 to Article 29 inclusive shall be amended as follows:
Article 26. The Medical Practitioners Examination Council under the supervision of the Minister of Welfare shall be established to make research and deliberation, in response to the request of the Minister of Welfare, on important matters on the national examination for medical practitioners and to take charge of the affairs concerning the national examination and the preliminary examination of the national examination for medical practitioners.
Article 27. The Council on Internship for Medical Practitioners and Dentists under the supervision of the Minister of Welfare shall be established to make research and deliberation, in response to the request of the Minister of Welfare, on important matters concerning internship under the provisions of Article 11 or Article 11 of the Dentists Law.
Article 28 and Article 29. Deleted.
In Article 30, "Members of the National Medical Practitioners'Examination Committee, those of the Committee of the Preliminary Examination of the National Medical Practitioners'Examination" shall be amended as "Commissioners of the Medical Practitioners Examination Council."
Article 6. The Dentists Law shall be partially amended as follows:
"Chapter V. Inquiry Committees, etc." shall be amended as "Chapter V. Councils."
Article 24 to Article 27 inclusive shall be amended as follows:
Article 24. The Dentists Examination Council (hereinafter referred to as the Council) under the supervision of the Minister of Welfare shall be established to make research and deliberation, in response to the request of the Minister of Welfare, on important matters on the national examination for dentists and to take charge of the affairs concerning the national examination and the preliminary examination of the national examination for dentists.
Article 25 to Article 27 inclusive. Deleted.
In Article 28, "Members of the National Dentists'Examination Committee, those of the Committee of the Preliminary Examination of the National Dentists'Examination" shall be amended as "Commissioners of the Council."
Article 7. The Public Health Nurse, Midwife and Nurse Law shall be partially amended as follows:
Article 23 and Article 24 shall be amended as follows:
Article 23. The Council on Authorization of Schools, Training Schools and Examinations for Public Health Nurses, Midwives and Nurses (hereinafter referred to as the Council) under the supervision of the Minister of Welfare shall be established to make research and deliberation, in response to the request of the Minister of Welfare, on important matters on the national examination of public health nurses, midwives and A-class nurses, and on the examination of B-class nurses, and to take charge of the affairs concerning the enforcement of the national examination for public health nurses, midwives and A-class nurses.
2 The Council shall make research and deliberation, in response to the request of the Minister of Education or Welfare, on important matters concerning the designation of schools or training institutions under the provisions of each item (1) or (2) of Article 19 to the preceding Article inclusive, other than the matters as provided for in the preceding paragraph.
3 The Minister of Education or Welfare may cause the Council to research into the necessary matters concerning the schools or training institutions under the preceding paragraph.
Article 24. Deleted.
In Article 25, "(hereinafter referred to as the examination committee)" shall be added next to "The class-B nurse examination committee," and the following one paragraph shall be added to the same Article:
2 The organization of the examination committee, term of office of commissioners and other necessary matters concerning examination committee shall be determined by bylaw of To, Do, Fu or prefecture.
In Article 26 paragraph 1 and Article 27, "the Examination Committee" shall be amended as "the Commissioners of the Council" and "the class-B nurse examination committee" as "the examination committee."
Article 8. The Medical Service Law (Law No.205 of 1948) shall be partially amended as follows:
Article 32 shall be amended as follows:
Article 32. The Medical Service Council under the supervision of the Minister of Welfare shall be established to make research and deliberation, in response to the request of the Minister of Welfare, on important matters concerning adjustment of the medical care facilities and medical treatment fees.
2 The Medical Care Facilities Adjustment Council under the supervision of the governor of To, Do, Fu or prefecture shall be established in To, Do, Fu and prefecture to make research and deliberation, in response to the request of the governor of To, Do, Fu or prefecture, on important matters concerning adjustment of the medical care facilities.
3 The organization, term of office of Commissioners, method of resolution and other necessary matters concerning the Medical Care Facilities Adjustment Council shall be determined by by-law of To, Do, Fu or prefecture.
In Article 34 paragraph 1, "the Council for the arrangement of medical facilities" shall be amended as "the Medical Service Council."
Article 38 shall be amended as follows:
Article 38. The Minister of Welfare shall, in advance, hear the opinions of the Medical Service Council in making the determination under the provision of the preceding Article.
Supplementary Provision:
This Law shall come into force as from April 1, 1950.
