(Purpose)
Article 1. The purpose of this Law is to have the police wire telecommunication facilities in the possession of the local public bodies transferred to the State, for the purpose of improving the police wire telecommunication facilities (those for firefighting included;hereinafter the same).
(Extent of Facilities to be Transferred)
Article 2. The local public bodies shall transfer to the State such as are listed below among the police wire telecommunication facilities in their possession that are usable and which can be amalgamated into the public telecommunication system at the time of the enforcement of this Law, as well as apparatuses and materials for the construction and maintenance thereof:
(1) Lines other than those beginning and ending in one and the same building or premises;
(2) Telephone apparatuses (appurtenances included) other than those connected with a switchboard and located in one and the same building or permises as that of the switchboard of those connected with lines beginning and ending in one and the same building or premises;
2 In case the police wire telecommunication facilities, apparatuses and materials have been transferred to the State in accordance with the provisions of the preceding paragraph, the State shall pay the price in compliance with the provisions of this Law. This shall not, however, apply to the lines and the telephone apparatuses connected thereto beginning and ending in one and the same telephone subscription area or the area under jurisdiction of one and the same municipal police.
(Police Wire Telecommunication Facilities Evaluation Committee)
Article 3. The Police Wire Telecommunication Facilities Evaluation Committee shall be established in the Ministry of Telecommunications (hereinafter referred to as "Evaluation Committee" ) for the purpose of determining the price of the police wire telecommunication facilities, apparatuses and materials to be transferred to the State in accordance with the provisions of the preceding Article.
2 The Evaluation Committee shall be composed of a Chairman and Seven Members.
3 The members shall be appointed by the Minister of Telecommunications from among the following persons:
(1) Two out of the personnel of the Ministry of Telecommunications;
(2) One out of the personnel of the Ministry of Finance;
(3) Two out of the Commissioners of the National Public Safety Commission or the personnel of the headquarters of the National Rural Police;
(4) Two out of the Members of the Local Autonomy Committee or the personnel of the Local Autonomy.
4 The Minister of Telecommunications shall be the Chairman.
5 The Chairman shall preside over the affairs of the Committee.
6 The Evaluation Committee can not open its proceedings nor take decisions unless a majority of the Members are present.
7 The proceedings of the Evaluation Committee shall be decided by a majority of the Members present. In cases of a tie, the Chairman shall decide the issue.
(Determination of Price)
Article 4. The price of the police wire telecommunication facilities to be transferred to the State in accordance with the provisions of Article 2 shall be the sum to be determined by the Evaluation Committee on the basis of the expense of original construction at the time of the enforcement of this Law With the deduction of the value of depreciation computed in the light of the years of durability and with consideration for the extent of the facilities which can be utilized.
2 The price of the apparatuses and materials to be transferred to the State in accordance with the provisions of Article 2 shall be determined by the Evaluation Committee on the basis of the controlled price on the day of the enforcement of this Law with regard to the apparatuses and materials, for which controlled prices exist, and the market price on the above-stated day, with regard to the apparatuses and materials for which no controlled prices exist.
(Method of Payment and Interest)
Article 5. The State shall pay, as the price provided for in Article 2 paragraph 2, not less than one fifth of the sum determined by the Evaluation Committee in accordance with the provisions of the preceding Article each year starting from the 1950 fiscal year.
2 For the price provided for in Article 2 paragraph 2 interest at 5 per cent per annum on the unpaid balance shall be paid from the day of transfer.
(Period of Transfer)
Article 6. The transfer under the provisions of Article 2 shall be completed within six months after the day of enforcement of this Law.
(Exemption for Installation Charge)
Article 7. The State shall not collect the installation charge, in case the telephone facilities coming under the proviso of Article 2 paragraph 2 among those transferred to the State in accordance with the provisions of the same Article, are used as local leased telephone circuits (including the equipments connected thereto) at the places where they have been located.
(Lease of Facilities)
Article 8. The State shall take steps to furnish wire telecommunication facilities for lease of the National Public Safety Commission, the Local Public Safety Commissions or the Special District Safety Commissions, in order that the police communication services being conducted at the time of enforcement of this Law, by means of wire telecommunication facilities owned by the local public bodies, may not be interrupted.
Article 9. The State shall, in addition to those prescribed in the preceding Article, furnish the wire telecommunication facilities required for police activities for lease of the National Public Safety Commission, the Local Public Safety Commissions or the Special District Public Safety Commissions at any time on their request;however, in case no wire telecommunication facilities are available for the use of the police or the payment of the charge for lease of wire telecommunication facilities is impracticable on account of budgetary circumstances, the same shall not apply.
2 The State shall not cancel or suspend the lease of the wire telecommunication facilities of the National Public Safety Commission, the Local Public Safety Commissions or the Special District Safety Commissions, without their approval. In the case, however, of default of the charge for the lease, the National Public Safety Commission, the Local Public Safety Commissions or the Special District Safety Commissions shall approve the cancellation or the suspension of the lease, in so far as they do not take proper steps necessary for the payment of such charge.
