Law for Partial Amendments to the Ship's Law
船舶法(明治三十二年法律第四十六号)の一部を次のように改正する。
A part of the Ship's Law (Law No.46 of 1899) shall be amended as follows:
第五條の次に次の一條を加える。
The following Article shall be added next to Article 5:
第五條ノ二 日本船舶ノ所有者ハ主務大臣ノ定ムル期日マデニ船舶国籍証書ヲ其船舶ノ船籍港ヲ管轄スル管海官庁(其船舶ノ運航上ノ都合ニ因リ已ムコトヲ得ザル事由アルトキハ最寄ノ管海官庁)ニ提出シ其検認ヲ受クルコトヲ要ス
Article 5-(2). The owner of a Japanese ship shall submit the certificate of nationality of the ship to the marine authorities having jurisdiction over its port of registry (or the nearest marine authorities when necessary through unavoidable circumstances of the ship's operation) by the date to be fixed by the competent Minister, to have the certificate inspected and its validity verified by the said marine authorities.
前項ノ期日ハ船舶国籍証書ノ交付ヲ受ケタル日又ハ船舶国籍証書ニ付前回ノ検認ヲ受ケタル日ヨリ総噸数百噸以上ノ鋼製船舶ニ在リテハ四年ヲ総噸数百噸未満ノ鋼製船舶ニ在リテハ二年ヲ木製船舶ニ在リテハ一年ヲ経過シタル後タルコトヲ要ス
Before the date as referred to in the provision of the previous paragraph there shall be a lapse, of four years for a steel ship of 100 gross tons or more, of two years for a steel ship of less than 100 gross tons, and of one year for a wooden ship, after the date of the delivery of the certificate of nationality or of the previous inspection thereof.
船舶ガ外国ニ在ル場合其他已ムコトヲ得ザル事由ニ因リ第一項ノ規定ニ依リ主務大臣ノ定ムル期日マデニ船舶国籍証書ヲ提出スルコトヲ得ザル場合ニ於テ其期日マデニ其船舶ノ所有者ヨリ理由ヲ具シテ申請アリタルトキハ船籍港ヲ管轄スル管海官庁ハ提出期日ノ延期ヲ認ムルコトヲ得延期セラレタル期日マデニ提出スルコトヲ得ザル場合亦同ジ
In case the owner is, for such unavoidable reasons as in the case where a ship is in a foreign country and so forth, unable to submit the certificate of nationality by the date to be fixed by the competent Minister in accordance with the provision of paragraph 1, the marine authorities having jurisdiction over its port of registry will, when the owner has, stating the reason, applied to them by the said date, be authorized to extend the date for submitting the certificate. This shall also apply to the case where the owner is unable to submit the certificate by the new date which was fixed by way of extension.
日本船舶ノ所有者ガ第一項ノ規定ニ依リ主務大臣ノ定ムル期日又ハ前項ノ規定ニ依リ延期セラレタル期日マデニ船舶国籍証書ヲ提出セザルトキハ船舶国籍証書ハ其効力ヲ失フ此場合ニ於テ船籍港ヲ管轄スル管海官庁ハ船舶原簿ニ付職権ヲ以テ抹消ノ登録ヲ為スコトヲ要ス
In case the owner of a Japanese ship fails to submit the certificate of nationality by the date to be fixed by the competent Minister in accordance with the provision of paragraph 1 or by the date which has been fixed by way of extension in accordance with the preceding paragraph, the said certificate shall lose its validity. In this case, the marine authorities having jurisdiction over its port of registry shall ex officio cancel the registration of the said ship on the ship's register.
第六條の次に次の一條を加える。
The following Article shall be added next to Article 6:
第六條ノ二 第五條第一項ノ規定ニ依リ登録ヲ為シタル船舶ニ付所有者ノ変更アリタルトキハ新所有者ハ船舶国籍証書ノ書換ノ申請ヲ為シタル後ニ非ザレバ其船舶ヲ航行セシムルコトヲ得ズ但其事実ヲ知ルニ至ルマデノ間及其事実ヲ知リタル日ヨリ二週間内ハ此限ニ在ラズ
Article 6-(2). In case of a change in the ownership of a ship registered in accordance with the provisions of Article 5 paragraph 1, the new owner shall not operate the said ship unless he has applied for rewriting of the certificate of nationality of the ship;provided that this shall not apply until he comes to know the fact and also for two weeks after the date when he has come to know the fact.
第二十條中「前十六條」を「第四條乃至前條」に改める。
In Article 20, "the preceding sixteen Articles" shall be amended as "Article 4 to the preceding Article inclusive" .
第二十二條を次のように改める。
Article 22 shall be amended as follows:
第二十二條 日本船舶ニ非ズシテ国籍ヲ詐ル目的ヲ以テ日本ノ国旗ヲ掲ゲ又ハ日本船舶ノ船舶国籍証書若クハ仮船舶国籍証書ヲ以テ航行シタルトキハ船長ヲ二年以下ノ懲役又ハ十万円以下ノ罰金ニ処ス此場合ニ於テ船長ノ所有又ハ占有ニ係ル其船舶ヲ没收スルコトヲ得
Article 22. In case any ship other than a Japanese ship has displayed a Japanese flag with the object of misrepresenting her nationality or sailed with a certificate of nationality or a provisional certificate of nationality of a Japanese ship, the master thereof shall be liable to penal servitude not exceeding two years or to a fine not exceeding one hundred thousand yen, and if, in this case, the ship is owned or possessed by the master the ship may be liable to forfeiture.
前項ノ規定ハ船舶ガ捕獲ヲ避ケントスル目的ヲ以テ日本ノ国旗ヲ掲ゲタルトキハ之ヲ適用セズ
The provision of the preceding paragraph shall not apply in case the ship has displayed the Japanese flag with the object of avoiding capture.
日本船舶ガ国籍ヲ詐ル目的ヲ以テ日本ノ国旗以外ノ旗章ヲ掲ゲタルトキ亦前二項ニ同ジ
The provisions of the preceding two paragraphs shall apply in case a Japanese ship has displayed a flag other than a Japanese flag with the object of misrepresenting her nationality.
第二十二條の次に次の一條を加える。
The following one Article shall be added next to Article 22:
第二十二條ノ二 船長ガ当該官吏吏員ノ臨検ニ際シ之ニ呈示スル目的ヲ以テ他ノ船舶ノ船舶国籍証書又ハ仮船舶国籍証書ヲ船内ニ備置キ其船舶ヲ航行セシメタルトキハ船長ヲ二年以下ノ懲役又ハ十万円以下ノ罰金ニ処ス此場合ニ於テ船長ノ所有又ハ占有ニ係ル其船舶ヲ没收スルコトヲ得
Article 22-(2). In case a master of any ship has operated the ship, keeping aboard a certificate of nationality or a provisional certificate of nationality of any other ship with the object of presenting it to the competent government or public official on the occasion of the spot inspection, he shall be Iiable to penal servitude not exceeding two years or to a fine not exceeding one hundred thousand yen, and if, in this case, the ship is owned or possessed by the master, the ship may be liable to forfeiture.
第二十三條を次のように改める。
Article 23 shall be amended as follows:
第二十三條 第三條、第六條又ハ第六條ノ二ノ規定ニ違反シタルトキハ船長ヲ二年以下ノ懲役又ハ十万円以下ノ罰金ニ処ス此場合ニ於テ船長ノ所有又ハ占有ニ係ル其船舶ヲ没收スルコトヲ得
Article 23. In case of a violation of the provisions of Article 3 Article 6 or Article 6-2, the master shall be liable to penal servitude not exceeding two years or to a fine not exceeding one hundred thousand yen, and if, in this case, the ship is owned or possessed by the master, it shall be liable to forfeiture.
第二十五條を次のように改める。
Article 25 shall be amended as follows:

Article 25. Deleted.
第二十六條及び第二十七條中「五千円」を「五万円」に改める。
In Articles 26 and 27, "five thousand yen" shall be amended as "fifty thousand yen" .
第二十七條ノ二中「千円」を「三万円」に改める。
In Article 27-(2), "one thousand yen." shall be amended as "thirty thousand yen" .
附 則
Supplementary Provisions:
1 この法律は、公布の日から施行する。
1. This Law shall come into force as from the day of its promulgation.
2 第五條ノ二第一項の規定によりこの法律施行後最初に受けるべき検認の期日については、同條第二項の規定は、適用しない。
2. The provisions of Article 5-(2) paragraph 2, shall not apply to the date of the first inspection and verification after the enforcement of this Law, to be effected in accordance with the provision of Article 5-(2) paragraph 1.
