Law for Partial Amendments to the Eugenic Protection Law
The Eugenic Protection Law (Law No.156 of 1948) shall be partially amended as follows:
In Article 3 paragraph 1 item (1), "the hereditary psychopathological disease, hereditary morbid character" shall be amended as "the hereditary psychopathias" ;and in item (2) of the same paragraph, "hereditary psychopathological disease, hereditary morbid character" shall be amended as "hereditary psychopathias" , and "and that is considered to be inherited to the descendant" shall be deleted.
In Article 4 "even though he does not obtain the consent required in the preceding Article" shall be deleted, and "may apply to" shall be amended as "must apply to" .
In Article 13 paragraph 1 items (1) to (3) inclusive shall be amended as follows, and item (4) shall be item (3):
(1) In case the person in question or the spouse has mental disease or mental weakness;
(2) In case the continuance of pregnancy or the delivery seems remarkably injurous for the health of the mother owing to her physical or financial condition.
Paragraph 2 of the same Article shall be amended as follows:
2 An application mentioned in the preceding paragraph shall be attached with opinion of another physician in the case of item (1) of the said paragraph;with opinion of another physician in the case of item (2) of the said paragraph if it is due to physical conditions, and with opinions of another physician and the Welfare Commissioner if it is due to financial conditions;and with opinion of the Welfare Commissioner in the case of item (3) of the said paragraph.
Paragraph 3 of the same Article shall be amended as follows:
3 As to the consent prescribed in paragraph 1, provisions prescribed in Article 3 paragraph 2 shall apply correspondingly.
4 In case the person in question, owing to mental derangement, can not express her own intention;the consent of the person in parental right, the guardian or the assistant may be substituted for that of the person in question if any of them is found;if, however, the person in parental right, the guardian or the assistant is not found, consent of a relative may be substituted for her consent;and if none of the above stated is found, consent of the person in question is not needed.
Article 20 shall be amended as follows:
(The Eugenic Marriage Consultation Office)
Article 20. In response to consultation on marriage affairs from the view-point of eugenic protection and simultaneously in attempting popularization and elevation of necessary knowledge relating to inheritance and other eugenic protection as well as popularization and guidance of proper methods concerning conception adjustment, the Eugenic Marriage Consultation Office shall be established.
In Article 28, "eugenic operation" shall be amended as "operation or the application of X-ray to incapacitate a person for reproduction" .
In Article 33, "If a person, in contravention of the provisions of Article 28, has exercised the eugenic operation," shall be amended as "If a person contravenes the provisions of Article 28" .

Supplementary Provision of the First Amended Law:
This Law shall come into force as from the day of its promulgation.
